ORDINANCE NO. /1 7/ AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated southwest of the intersection of Nob Hill Boulevard and South 16th Avenue in the City of Yakima, Washington, from R-2, Two-Family Zone, and B-2, Local Business Zone, to a Planned Develop- ment Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 3rd day of January, 1972, and continued to the 10th day of January, 1972, upon the recommenda- tion of the Planning Commission that real property situated southwest of the intersection of Nob Hill Boulevard and South 16th Avenue in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-2, Two-Family Zone, and B-2, Local Business Zone, to a Planned Development Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with Amk the General Plan of the City of Yakima; that the majority of property IIP owners in the vicinity do not oppose the change in classific4tion; that the needs of the City and community do require such change and that the highest and best use of said property is for a Planned Development Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated southwest of the intersection of Nob Hill Boulevard and South 16th Avenue in the City of Yakima, Washington, and more particularly des- cribed as follows, to wit: That part of the northeast quarter of the southeast quarter of Oil Section 26, Township 13 North, Range 18, E.W.M., described as follows: Beginning at a point on the west line of South 16th Avenue, south 159.4 feet and west 30 feet from the northeast corner of said subdivision; thence southalong the west line of South 16th Avenue 200 feet to the south line of the north 359.4 feet of said subdivision; thence west along the south line of said north 359.4 feeta distance of 299.3 feet to the centerline of South 17th Avenue; thence north along the centerline of said South 17th Avenue, a distance of 11.8 feet, more or less, to the easterly extended south line of Lot 5, Washburn's Plat, as recorded in Volume "R" of Plats, page 47, records of Yakima County, Washing- ton; thence west along said south line 159 feet to the southwest corner of said Lot 5; thence south along the east line of Lot 4 of said plat, 56 feet to the southeast corner of said Lot 4; thence 111/ west along the south line of Lots 4 and 3 of said Plat 120.3 feet to a point 20 feet east of the southwest corner of said Lot 3; thence north parallel with and 20 feet east of the west line of said Plat 227.6 feet to a point 20 feet east of the northwest corner of Lot 2 of said Plat; thence west 10.4 feet to the west line of the east 619 feet of said subdivision; thence north along said west line of the east 619 feet a distance of 150 feet to a point 26 feet south of the north line of said subdivision and on the south line of Nob Hill Boulevard; thence east parallel with and 26 feet south of the north line of said subdivision 449.35 feet to the west line of the east 169.65 feet of said subdivision; thence south parallel with the east line of said subdivision 133.4 feet; thence east 139.65 feet to the point of beginning; be rezoned from R-2, Two-Family Zone, and B-2, Local Business Zone, to a Planned Development Zone, be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan 40 and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
