ORDINANCE NO. /37,
AN ORDINANCE authorizing and directing the City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of real property
for the widening and improving of a portion of Mead
Avenue and for theinstallation of curbs, gutters, side-
walks, drainage facilities and public utility facilities
related thereto; providing for the condemnation and
taking of such real property and declaring the condemna-
tion and taking thereof to be necessary for a, public use
required by the public interests; and directing that
compensation for such taking be paid from the Urban__
Arterial Fund of the City of Yakima; and declaring an
emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney of the City of Yakima is hereby
authorized and directed to institute and prosecute an action in the
Superior Court of the State of Washington, in and for Yakima County,
for the condemnation and acquisition of the hereinafter described
real property for the widening and improving of that portion of Mead
Avenue between South 3rd Avenue and South 10th Avenue, in the City of
Yakima, Washington, and for the installation of curbs, gutters, side-
walks, drainage facilities and public utility facilities related
thereto, all in accordance with plans for such improvement, project
as depicted on a drawing prepared by the office of the Yakima City
Engineer, a copy of which drawing is attached to this ordinance and
by reference made a part hereof, said real property being legally.
described on "Exhibit A to Condemnation Ordinance" attached to this
ordinance and by reference made a part hereof.
Section 2. The acquisition of said real property for the pur-
poses herein mentioned is required for the interests of the public and
of the City of Yakima, and the uses and purposes herein mentioned do
411 constitute a public use of said property, and said real property is.
necessary for the use and purposes mentioned herein.
Section 3. The compensation for said real property to be taken
shall be payable from the . Urban Arterial Fund of the City of Yakima.

Section 4. In conducting said condemnation proceedings, the
City Attorney is hereby authorized to stipulate to any matters for
the purpose of minimizing damages.
Section 5. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 24th day
of January, 1972.

EXHIBIT A TO CONDEMNATION ORDINANCE
Each of the following parcels is situated in the City of Yakima
Yakima County, Washington:
Parcel 1: The north 11.5 feet of Lots 1 and 2 of Broadway -Mead
Half -Acre Tracts No. 1, according to plat thereof
recorded in Volume "I" of plats, page 38, records
of Yakima County, Washington, and beginning at the
northeast corner of said Lot 1, thence southerly
along the east line of Lot 1 a distance of 24 feet
to true point of beginning, thence northerly 12.5
feet along said east line, thence westerly parallel
to the north line of Lot 1, a distance of 15 feet,
thence southeasterly to the true point of beginning,
except beginning at the northeast corner of said
Lot 1, thence southerly 7 feet along the east line
of Lot 1 to the true point of beginning, thence
northerly to the northeast corner of Lot 1, thence
westerly 15 feet along the north line of Lot 1,
thence southeasterly to the true point of beginning.
Parcel 2: The north 8 feet of the south 13 feet of Lot 10,
of Ledwich Addition, according to plat thereof re-
corded in Volume UH" of plats, page 35, records of
Yakima County, Washington, and a triangular parcel
beginning at the southeast corner of said Lot 10,
thence northerly along the east line 25 feet to the.
true point of beginning, thence southerly along
said east line 12 feet, thence westerly and parallel
to the south line of said Lot 10 a distance of 15
feet, thence northeasterly to the true point of
beginning, and a triangular parcel beginning at the
southwest corner of said Lot 10, thence northerly
along the west line 28 feet to the true point of
beginning, thence southerly along said west line 15
feet, thence easterly parallel to the south line of
said Lot 10 16.5 feet, thence northwesterly to the
true point of beginning.
Parcel 3: The north 3 feet of Lots 19 and 20 of Marshall Homes
according to plat thereof recorded in Volume "M" of
plats, page 29, records of Yakima County, Washington,
and a triangular parcel beginning at the northwest
corner of said Lot 20; thence southerly along the
west line 8 feet to the true point of beginning,
thence northerly along said west line 5 feet; thence
easterly and parallel to the north line 11.5 feet;
thence southwesterly to the true point of beginning.
Parcel 4: The south 7 feet of Lot 11, Block 1, of Broadmead
according to the plat thereof recorded in Volume "L"
of plats, page 33, records of Yakima County, Washing-
ton.
Parcel 5: The north 3 feet of the west 88.4 feet of Lot 1, of
Cornell Tracts, according to the plat thereof re-
corded in Volume "3" of plats, page 42, records of
Yakima County, Washington, and a triangular parcel

beginning on the northwest corner of said Lot 1,
thence southerly along the west lot line 8 feet to
the true point of beginning, thence northerly along
the west lot line 5 feet, thence easterly and
parallel to the north lot line 11.5 feet, thence
southwesterly to the true point of beginning;
Parcel 6: The south 7 feet of Lot 9, Block 2, of Broadmead
according to the plat thereof recorded in Volume "L"
of plats, page 33, records of Yakima County, Washing-
ton, and a triangular parcel beginning at the south-
east corner of said Lot 9, thence northerly along
the east lot line 12 feet to the true point of
beginning, thence southerly along said line 5 feet,
thence westerly and parallel to the south lot line
11.5 feet, thence northeasterly to the true point of
beginning.
Parcel 7: The north 5 feet of Lot 7 except the west 15 feet,
and the north 5 feet of Lot 8, Coonse State Addition
#2, according to the plat thereof recorded in Volume
"J" of plats, page 17, records of Yakima County,
Washington, also a triangular parcel beginning at
the northeast corner of said Lot 8, thence southerly
along the east lot line 8 feet to the true point of
beginning, thence northerly along said east line 3
feet, thence westerly and parallel with the north
lot line 11.5 feet, thence southeasterly to the true
point of beginning.
Parcel 8: The north 5 feet of the east 47.5 feet of Lot 6 and
the north 5 feet of the west 15 feet of Lot 7, Coonse
State Addition #2, according to the plat thereof
recorded in Volume "J" of plats, page 17, records of
Yakima County, Washington.
Parcel 9: The north 5 feet of the south 10 feet of the west 43
feet of Lot 1, of Valley Addition No. 1 according to
the plat thereof recorded in Volume "H" of plats, page
36, records of Yakima County, Washington, also a
triangular parcel of land beginning at the southeast
corner of said Lot 1, thence westerly along the south
lot line 25 feet, thence northerly and parallel with
the east lot line 15 feet to the true point of
beginning; thence southerly and parallel to said
east lot line 5 feet, thence westerly and parallel
with the south lot line 11.5 feet; thence northeaster-
ly to the true point of beginning.
Parcel 10: The north 5 feet of the south 10 feet of Lot 3 of

of Yakima County, Washington.
Parcel 11: The north 5 feet of the south 10 feet of Lot 5,

Parcel 12: The north 5 feet of the south 10 feet of Lot 6,
Valley Addition No. 1, according to the plat thereof
recorded in Volume "H" of plats, page 36, records
