AN ORDINANCE authorizing and directing the City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of real property
for the widening and improving of a portion of West Nob
Hill Boulevard and a portion of South 32nd Avenue and
for the installation of curbs, gutters, sidewalks,
drainage facilities and public utility facilities
related thereto; providing for the condemnation and
taking of such real property and declaring the condemna-
tion and taking thereof to be necessary for a public use
required by the public interests; and directing that com-
pensation for such taking be paid from • the Arterial
Street Fund of the City of Yakima, and declaring an emer-
gency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney of the City of Yakima is hereby
authorized and directed to institute and prosecute an action in the
Superior Court of the State of Washington, in and for Yakima County,
for the condemnation and acquisition of the hereinafter described
real property for the widening and improving of that portion of West
Nob Hill Boulevard between its intersection with South 31st Avenue and
II I r South 33rd Avenue, and for the widening its intersection with So th 33r ve , g and
improving of a portion of South 32nd Avenue at and near its intersec-
tion with West Nob Hill Boulevard, all within the City of Yakima,
Washington, and for the installation of curbs, gutters, sidewalks,
drainage facilities and public utility facilities related thereto, all :r
in accordance with plans for such improvement project as depicted on
a drawing prepared by the office of the Yakima City Engineer, a copy
of which drawing is attached to this ordinance and by reference made
a part hereof, said real property being legally described on "Exhibit
A to Condemnation Ordinance" attached to this ordinance and by
reference made a part hereof.
Section 2.. The acquisition of said real property for the purposes
herein mentioned is required for the interests of the public and of
the City of Yakima, and the uses and purposes herein mentioned do con-
stitute a public use of said property, and said real property is neces-
sary for the use and purposes mentioned herein.

Section 3. The compensation for said real property to be taken
shall be payable from the Arterial Street Fund of the City of Yakima.
Section 4. In conducting said condemnation proceedings, the
11 1 City Attorney is hereby authorized to stipulate to any matters for
the purpose of minimizing damages.
Section 5. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and welfare
of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.

EXHIBIT A TO CONDEMNATION ORDINANCE
Each of the following described parcels is situated in the
City of Yakima, Yakima County, Washington:
Parcels 1 and 2: Not applicable.

Parcel 3: All that portion of the following described proper-
ty designated Parcel #3 lying north of a line drawn
parallel to and 36 feet south when measured at
right angles to the north line of the southwest
quarter of Section 26, Township 13 N., Range 18,
E.W.M.
Description of Parcel #3:
That portion of the west half of the west half of
the northwest quarter of the southwest quarter of
Section 26, Township 13 North, Range 18, E.W.M.,
described as follows:
Beginning at a point on the south right of way line
of Nob Hill Boulevard 150 feet east of the west
line of said Section 26; thence east along said
right of way line 64 feet; thence south parallel
with the west line of said section 175 feet; thence
west parallel with said south right of way line 59
feet; thence north parallel with the west line of
411 said section 50 feet; thence west parallel with
said south right of way line 5 feet; thence north
to the point of beginning.
Parcel 4 All that part of the following described property
designated Parcel #4 lying northerly of the follow-
ing described line:
Beginning at the point on the west property line of
Parcel #4 said point being 36 feet south when
measured at right angles of the north line of the
southwest quarter of Section 26, Township 13 North,
Range 18, E.W.M., thence easterly and parallel to
said north line 80.8 feet; thence southeasterly to
a point on the east property line; said point being
53 feet south, when measured at right angles, to the
north line of the southwest quarter of Section 26,
Township 13 North, Range 18, E.W.M.
Description of Parcel #4:
That part of the west half of the west half of the
S northwest quarter of the southwest quarter of Sec-
tion 26, Township 13 North, Range 18, E.W.M., des-
cribed as follows:
Beginning at a point on the south tight of way line
of Nob Hill Boulevard, 214 feet east of the west
line of said Section 26; thence south 87.5 feet;
thence east parallel to said south right of way
line 117.8 feet, more or less, to the east line of
the west half of the west half of the northwest
quarter of the southwest quarter of said section;

thence north 87.5 feet; thence west along the south
right of way line of Nob Hill Boulevard; 117.8 feet
• to the point of beginning, except the east 20 feet
thereof for street.
Parcel 5: The south 10 feet of Lot 7, Mantey Addition, as
recorded in Volume II B: u of plats, page 4, records
of Yakima County, Washington, also a triangular
parcel beginning at the southeast corner of said
Lot 7, thence northerly along the east property
line 21 feet to the true point of beginning, thence
southerly along said east line 11 feet, thence
westerly parallel to the south property line 11.5
feet; thence northeasterly to the true point of
beginning.
Parcel 6: The south 10 feet of the south 80 feet of Lot 1, •
Mantey Addition, recorded in Volume of plats,
page 4, records of Yakima County, Washington, also
a triangular parcel beginning at the southwest cor-
ner of said Lot 1, thence northerly along the west
lot line 23.5 feet to the true point of beginning,
thence southerly along the west lot line 13.5 feet,
thence easterly parallel to the south lot line 15
feet, thence northwesterly to the true point of
beginning.
Parcel 7: The south 10 feet of the following described proper-
ty designated Parcel #7, also a triangular parcel
beginning at the southeast corner of said Parcel #7,
thence northerly along the east property line 26
feet to the true point of beginning, thence souther-
ly along the east property line 16 feet, thence
westerly and parallel with the south property line
