HomeMy WebLinkAbout1969-1130 ORDINANCE NO. //36 AN ORDINANCE relating to public safety, welfare and morals, prescrib- ing penalties for violation of Title 6, PUBLIC SAFETY AND MORALS, of the City of Yakima Municipal Code; adding new Section 6.02.030, Severability; adding new Section 6.02.040, Defining Person; adding new Section 6.02.050, Prescribing Penalties; repealing Sections 6.04.590, 6.04.595, 6.16.030, 6.20.140, .6.20.160, 6.22.070, 6.24.070. 6.24.080, 6.28.020, 6.32.050, 6.36.030, 6.48,020, 6.52,040, 6.56.250, 6.56.260, 6.56.270, 6.60,040, 6.64.060, 6.70.030, 6.72.040, 6.74.020, 6.74.030 and 6.76.030, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. There is hereby added a new section to the City of Yakima Municipal Code which shall read and be numbered as follows: 6.02.030 Severability. If any clause, part or section of this Title shall be adjudged invalid or unconstitutional, such judgment shall not affect .or invalidate the remainder of this Title nor the application of any such clause, part or section to any other person, but shall be confined in its operation to the clause, part or section directly involved in the controversy in which such judgment was rendered. Section 2. There is hereby added a new section to the City of Yakima Municipal Code which shall read and be numbered as follows: 6.02.040 Person Defined. The word "person" whenever used in this Title shall when necessary be held and construed to mean and include natural persons of either sex, associations, partnerships and corporations, whether acting by themselves or by servant, agent or employee. The singular number shall be held and construed to include the plural and vice versa, and the masculine pronoun to include the feminine pronoun. Section 3. There is hereby added a new section to the City of Yakima Municipal Code which shall read and be numbered as follows: 6.02.050 Violation -- Penalty. It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of Title 6 of the City of Yakima Municipal Code. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Title, or who is convicted of being a disorderly person or a vagrant, or who is convicted of having committed a misdemeanor, unless provision is otherwise herein made, shall be punished by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the City Jail for not more than six (6) months, or by both such fine and imprisonment. Section 4. The following enumerated sections of the City of Yakima Municipal Code are hereby repealed: Sectio.,s 6.04.590, 6.04.595, 6.16.030, 6.20.140, 6.20.160, 6.22.070, 6.24.0 6.24.080, 6.28.020, . 6.32.050, 6.36.030, 6.48.020, 6.52.040, 6.56. 6.56.260, 6.56.270, 6.60.040, 6.64.060, 6.70.030, 6.72.040, 6.74.020, 6.74.030 and 6.76.030, all of the City of Yakima Municipal Code. Section 5. This Ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
