HomeMy WebLinkAbout1969-1135 ORDINANCE NO. 1133' AN ORDINANCE providing for the vacation of a portion of South 6th Avenue, within the City of Yakima, Washington. WHEREAS, by resolution of the City Council, a hearing on the vacation of the street described below was set for the 17th day of ■1111 March, 1969, and was thereafter duly postponed from time to time until May 19, 1969, in the Council Chambers of the City of Yakima, at the City Hall in Yakima, Yakima County, Washington, and notices thereof were duly given in the manner provided by law, and WHEREAS, as a result of said hearing, the City Council finds it to be in the best interests of the City of Yakima that said street be vacated, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described street in the City of Yakima, Washington, to-wit: The entire width of that portion of South 6th Avenue between the southerly right-of-way line of West Walnut Street and the northerly right-of-way line of West Spruce Street, and the entire width of that portion of South 6th Avenue between the southerly right-of-way line of West Spruce Street and the • northerly right-of-way line of West Pine Street, be and the same is hereby, vacated. Section 2. The City of Yakima hereby reserves and retains to itself an easement, and the right to exercise and grant easements, over, under, across and along the entire width and length of the street hereby vacated, for the continued existence of, the subsequent construction of, and for the repair and maintenance of, any and all public utilities and public services of every nature including, but not limited to, the tracks and catenary system of the Yakima Valley T 0 • Transportation Company; and no building or permanent structure shall '$ be constructed on any portion of said vacated street without the prior approval of the City; nor shall any landscaping be done, trees ) or shrubs be allowed to grow or overhang, or other obstruction be created or allowed to exist, which would constitute an obstruction of the clearance of eight feet six inches on either side of the ( centerline of the Yakima Valley Transportation Company tracks for the duration of any franchise or other right or privilege of Yakima le Valley Transportation Company to maintain tracks through the vacated street. Section 3. This Ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
