HomeMy WebLinkAbout1969-1195 ORDINANCE NO. // AN ORDINANCE relating to licenses and business regulations; requiring licenses and permits aired prescribing license and permit fees for various persons, businesses and activities; amending Sections 4.16.180 (b), 4.30.040 (c), 4.40.120 (e), 4.52.030, 4.56.020, 4.64.030 (d), 5.02.090, 5.06.040, 5.08.010, 5.09.020, 5.09,070, 5.12.020 (a), 5.14.160, 5.18.020, 5.20.040, 5.26.120, 5.28.060, 5.28.070, 5.36.000, 5.38.040, 5.40.030, 5.48.020, 5.54.020, 5.58.030, 5.60.010, • 5.62,030, 5.64.030, 5.78.060, 5.78.170 (b), 6.22.050, 11.32.100, 11.32.130 and 11.44.090, and repealing Sections 5.42.020 (b) and 5.64.090, all of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 4.16.180 (b) of the City of Yakima Municipal Code is hereby amended to read as follows: "4.16.180 Collection of garbage in business class—Regula- tions. There are hereby established the following rules and regulations pertaining to the collection of garbage, refuse or debris in the Business Classification: (b) The fee for such license shall be the sum of $100 per year for each truck used by the collector." Section 2. Section 4.30.040 (c) of the City of Yakima Municipal • Code is hereby amended to read as follows: "4.30.040 Application for license -- Fee -- Term -- Inspection. (c) The fee for such license shall be the sum of $25.00 per year, which fee shall also be deposited with the City Clerk at the time of applying for such license. The license year shall commence on July 1 of each year. If the application shall be rejected, the fee deposited for such license shall be returned to the applicant, but the fee required for the investigation of applicant's premises shall be retained by the City of Yakima." Section 3. Section 4.40.120 (e) of the City of Yakima Municipal /Code is hereby amended to read as follows: "4.40.120 License required -- Application procedure - -Fee. (e) The license fee for a public eating place or public kitchen shall be Twenty Dollars ($20.00) per year. All licenses issued shall terminate one year from the date said license is issued. All licenses issued hereunto shall be S kept posted at all times in a conspicuous place in such pub- lic eating place or public kitchen and licenses issued under this chapter shall not be transferable to any other person." Section 4. Section 4.52.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "4.52.030 Fee for license -- Expiration. The fee for such wholesaler's license is hereby fixed in the sum of One Hundred Dollars ($100.00) per annum. Said license shall expire one year after the date of its issuance." Section 5. Section 4.56.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "4.56.020 License -- Application -- Fee- •Term. The fee for a license shall be the sum of Fifty Dollars ($50.00per year or fraction thereof. All licenses shall be issued annually and shall expire on the 31st day of March of each year. Every appli- cation for a license shall be in writing and signed by the appli- cant on a form to be furnished by the City Clerk and filed in his office and shall state the place where the business is to be conducted." Section 6. Section 4.64.030 (d) of the City of Yakima Municipal Code is hereby amended to read as follows: "4.64.030 Permit- - License -- Application -- Fee - -Term. (d) The license fee for the sale or disposal of milk or cream in the City of Yakima shall be as follows: For selling milk or cream, each wagon, truck or other vehicle, Forty Dollars ($40.00); for each cart or other method propelled by hand or by hand carried, Five Dollars ($5.00)." Section 7. Section 5.02.090 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.02.090 Transient Merchants. Every person, firm or • corporation, who, either in person or by aent, sells or offers to sell any goods, wares or merchandise within the City of Yakima, without any manifest intention of permanently Settling, locating or tesiding in the City of Yakima, and who is not permanently located or residing in the City of Yakima, for the purposes of carrying on a temporaty or transient business in the City of Yakima, shall hire, or lease or occupy any building, tent or other structure for the exhibition and sale of any such goods, wares and merchandise, shall be deemed to be an itinerant or transient merchant. Such merchant selling or in any manner offering for sale any goods, wares or merchandise within the City of Yakima shall pay as a license fee therefor, for any period less than one month, at the rate of Fifty Dollars ($50.00) per day. Where such license shall be taken out for the period of one month, the fee therefor shall be the sum of Three Hundred Dollars ($300.00) and for each succeeding month thereafter the fee shall be the sum of Two Hundred Dollars ($200.00) per month." Section 8. Section 5.06.040 of the City of Yakima Municipal Code is hereby amended to read as follows: • "5.06.040 License Fee. The annual license fee for all licenses provided for by this chapter shall be Seventy -five Dollars ($75.00), payable in advance on January 1 of each year, provided, a license may be issued for any application filed after August 31 of any year on payment of one -half the annual license fee, which license shall expire and be subject to renewal on or before December 31 of that year." Section 9. Section 5.08.010 of the City of Yakima Municipal Code is hereby amended to read as follows: - 2 - "5.08.010 License required- -Fee. It shall be unlawful for any oil company, association, corporation, firm, person or concern to make delivery of gasoline or oil, other petroleum products or aviation fuel to the Yakima Municipal Airport without first secur- ing a license so to do hereby designated as 'airport petroleum license'. Such license shall be obtained from the City Clerk and shall expire on the first day of July of each year. The annual fee for such license is hereby fixed in the sum of Twenty -five Dollars ($25.00)." Section 10. Section 5.09.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.09.020 Application for license- -Fee. (a) Any person, firm or corporation desiring to obtain an ambulance service business license shall file with the Clerk of the City of Yakima an application on forms to be furnished by him containing the following information: (1) Name of applicant. (2) Address of applicant. (3) Business address or location from which busi- nexx will be operated. (4) A list of all vehicles to be used in connec- tion with the business, with make and model of each. i (5) A list of all personnel to be engaged as employees in the business, with a designation of the position of each employee. (6) Whether any owner of business (or any officer if applicant is a corporation) has ever been charged with or convicted of any felony or misdemeanor, includ- ing violations of City ordinances and moving traffic offenses; and, if so, details as to when, where and for what offense. (7) Whether applicant has engaged in ambulance service business prior to making the application; and, if so, when and where. (b) An application hereunder shall be accompanied by a fee of Fifty Dollars ($50.00) for each ambulance regardless of whether the license applied for is issued. Such license shall be valid for a period of one year from its date of issue unless revoked as provided in this chapter. Any appli- cation for renewal, or re- issuance of an ambulance business license shall be accompanied by a fee of Fifty Dollars :a(' • ($50.00) for each ambulance listed on the application form for renewal or re- issuance of the license. (c) In the event a licensee intends to use an ambulance in connection with his business during the license year which ambulance is not listed on the application form for the license he then holds, licensee shall notify the City Clerk in writing of that fact, which notice shall be given prior to the time such ambulance is actually so used, and which notice shall designate the make and model of any such ambulance, which notice shall be accompanied by a fee of Fifty Dollars ($50.00) for each such ambulance." - 3 - Section 11. Section 5.09.070 of the City of Yakima Municipal Code is hereby amended to read as follows: 411 "5.09.070 Application for permit--Fee. (a) Any person desiring to obtain an ambulance driver and attendant permit shall file with the City Clerk an application on forms to be furnished by him containing the 111 - 3 A - following information: (1) Name of applicant; (2) Address of applicant; (3) Date and place of birth; • (4) Applicant's places of residence for three years immediately previous to the time of making appli- cation; (5) Marital status; (6) Physical description of applicant, including height, weight, color of eyes and hair, and distin- guishing or identifying marks, scars or tatoos; (7) Whether applicant has ever been convicted of or charged with any crime, including misdemeanors and violations of city ordinances and including moving traffic offenses; (8) Whether applicant's driver's license has ever been suspended or revoked-, and; if so, when, where and for what cause; (9) Whether applicant holds a valid Washington State Motor Vehicle Operator's Permit; (10) Whether applicant does now suffer or has eversuffered from epilepsy, vertigo, heart trouble, color blindness, or tuberculosis; and, if so, when the condition existed and the name and address of the treat- ing doctor; (11) Whether the applicant is addicted to the use of narcotics or intoxicating liquor; (12) A list of all illnesses suffered by appli- cant within a year preceding the date of application, together with the name and address of treating doctor; (13) Any physical defects of applicant; (14) Whether applicant has successfully completed an advanced first aid course as prescribed by the American Red Cross; (15) Whether applicant has ever been engaged as an ambulance driver or attendant; and, if so, when, where, and name and address of prior employer. • (b) An application hereunder shall be accompanied by an application fee of Ten Dollars ($10.00) which fee shall be retained by the City regardless of whether the permit applied for is issued. Such a permit shall be valid for a period of one year from its date of issue unless revoked as provided in this chapter, and may be renewed from year to year there- after by an application to the City Clerk accompanied by a renewal fee of Ten Dollars ($10.00) for each annual renewal." - 4 - Section 12. Section 5.12.020 (a) of the City of Yakima Municipal Code is hereby amended to read as follows: "5.12.020 Licenses re.uired for certain amusement devices- - Fees. (a) It shall be unlawful for any person, firm, corpora- 1, tion or association to install, maintain or operate, in any business establishment or for the purpose of profit, any of the following amusement devices without first obtaining from the City Clerk a license so to do and without first paying to the City the applicable license fee in the following res- pective amounts: (1) Pin -ball machines or games, games of skill or amusement, and similar amusement devices, including any automatic machine or device, except as hereinafter men- tioned and except an automatic music machine, wherein a person deposits a coin, disc or slug and in return therefor receives the opportunity of playing or operat- ing such machine; Two Hundred Dollars ($200.00) for each such machine or device in any location. (2) Shuffleboards; Fifty Dollars ($50.00)each. (3) Miniature bowling machines or bowling board, ray guns, dart throwing devices and similar amusement devices; Twenty -five Dollars ($25.00) each. • The fees specified are annual fees, and shall be paid in full in advance of January lrof each year, to be effective for the following year." Section 13. Section 5.14.160 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.14.160 License Fees. Before any license shall be issued, the following license fees shall be paid to the City Treasurer: Auctioneers shall pay a license fee of Two Hundred Dollars ($200.00) per annum; but, for a shorter period than one year, the rates shall be as follows: For any period of one month or less, at the rate of Ten Dollars ($10.00) per day; For any period of more than one month and not to exceed three months, at the rate of Six Dollars ($6.00) per day; For a period exceeding three months and not to exceed six • months, at the rate of Four Dollars ($4.00) per day; Auction merchants shall pay a license fee of Five Hundred Dollars ($500.00) per .annum; and, for a shorter period than one year, at the following rates: For a period of less than one year, Three Hundred Fifty Dollars ($350.00), but no license shall be issued for a shorter period than six months. For temporary auctions and closing out auctions, there shall he paid a license fee of Three Hundred Fifty Dollars ($350.00) per - 5 - month and, for every day less than one month, the sum of Fifty Dollars ($50.00) per day." Section 14. Section 5.18.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.18.020 Fees. The license fee for each billiard table or pool table shall be the sum of Thirty -five Dollars ($35.00), and for each bowling alley shall be the sum of Twenty Dollars ($20.00), payable annually to the City Clerk in advance; provided that the full amount thereof shall be payable each year when such license is issued hereunder." Section 15. Section 5.20.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.20.040 Fees. The license fee for any license is hereby fixed at the amount of Three Hundred Dollars ($300.00) for each card table, based on the total number of tables in such location or establishment available for use (whether or not actually in use), which fee shall be payable to the City Clerk annually in advance; provided that the full annual amount thereof shall be payable during each year when such license is issued hereunder. No part of any license feel shall be refunded upon revocation of any license for violation of any ordinance." Section 16. Section 5.26.120 of the City of Yakima Municipal Code is hereby amended to read as follows: • "5.26.120 License fee. The license fee for each sale of distress merchandise under this chapter shall be and is hereby fixed in the sum of Fifty Dollars ($50.00), plus Five Dollars ($5.00) for each One Thousand Dollars or fraction thereof of the value of inventory submitted with the application for license." Section 17. Section 5.28.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.28.060 License fee. The license fee for each dance hall or each cabaret shall be Fifty Dollars ($50.00) per year." Section 18. Section 5.28.070 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.28.070 Permit fee for public dance. The permit fee for public dances shall be as follows: Two Hundred Fifty Dollars ($250.00) for one year; Seventy -five Dollars ($75.00) for three months and Fifteen Dollars ($15.00) for one night." Section 19. Section 5.36.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.36.010 Clocks -- License required- -Fee. It shall be un- lawful for any bona fide legitimate lodge or club to own, main- tain or operate any gaming device or amusement device of the nature generally known as 'clocks' without first obtaining from the City Clerk a license so to do and without first paying to the City a license fee in the sum of Three Hundred Dollars ($300.00) for each such device payable annually in advance on January 1 of each year, or for any portion of a year; provided, however, that the full annual amount thereof shall be payable during each year when such license is issued hereunder." - 6 - Section 20. Section 5.38.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.38.040 Term and transfer of license. All licenses pro- vided for in this chapter shall be issued annually and shall expire on the first day of December of each year. Upon the issu- ance of any license there shall be paid to the City Clerk there- for the sum of Twenty -five Dollars ($25.00), and no license shall • be issued for any less amount. No such license shall be trans- ferable without the written consent of the City Manager." Section 21. Section 5.40.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.40.030 Fee. The annual license fee for a juke box license shall be Twenty -five. Dollars ($25.00) per year, payable on or before the 1st day of July of each year. In the event that such license shall be surrendered or revoked for cause, no part of the license fee shall be refunded. The license herein pro- vided for shall not be trarisferabie from one person to another, or from one location to another, or from one juke box to another." Section 22. Section 5.48.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.48.020 License required -- Fees - -Term. It shall be unlaw- ful for any person, firm or corporation to be or to become a mer- chant patrolman or solicit business as a merchant patrolman with- out being the holder of a valid and subsisting license issued • under the provisions of this chapter, such license to be desig- nated as 'Merchant Patrolman's License.' The fee for such license shall be Fifty Dollars ($50.00) per year, or in case of a temporary employee as such, shall be Ten Dollars ($10.00) per month. All annual licenses shall expire on the 31st day of Octo- ber of each year, and no reduction in fee for such licenses shall be made for any partial year." Section 23. Section 5.54.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.54.020 License required -- Application -- Bond -- Fee -- Transfer. No person shall engage in the business of a pawnbroker in the City of Yakima without first procuring a license therefor, and in order to procure a license he shall present to the City Clerk an appli- cation which shall contain the name of the applicant, the place where he proposes to conduct his business, the name under which the same shall be conducted, the names of persons interested in the business, fif a co- partnership or corporation, and in addition thereto shall supply the City Clerk with such other and further information as may be required to administer the provisions of • this chapter. If such application is approved the City Clerk shall issue a license to the applicant upon his executing and delivering to the City of Yakima a bond to be approved by the City Attorney in the sum of One Thousand Dollars ($1,000.00) conditioned that he will conduct such business in compliance with all of the ordinances of the City of Yakima and the laws of the State of Washington. The license fee shall be the sum of Seventy -five Dollars ($75.00) per annum. Said license shall not be assignable or transferable." - 7 - Section 24. Section 5.58.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.58.030 License fee. The license fee for a photographer operating a photographic studio in the City of Yakima shall be in the sum of Twenty -five Dollars ($25.00) per year." Section 25. Section 5.60.010 of the City of Yakima Municipal • Code is hereby amended to read as follows: "5.60.010 License required. Every person, firm or corpora- tion desiring to carry on the business of house moving in the City. of Yakima and . every person, firm or corporation who shall within the city limits of the City engage in or carry on said business of house moving shall obtain a license from the City of Yakima and pay therefor a fee of One Hundred Dollars ($100.00) per annum, and no license shall be issued to carry on such busi- ness for a less period than one year. Provided, however, that the owner of any building may move the same without the annual license as provided in this paragraph by complying with all the other terms of this chapter and with the provisions of Chapter 11.50, 'Control of Moved Buildings,' of this code." Section 26. Section 5.62.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.62.030 Fee - Term -- Transfer. The fee for a private detec- tive agency license shall be Fifty Dollars ($50.00) per annum. The fee for a private detective license shall be Twenty -five • Dollars ($25.00) per annum. All licenses shall expire on the 31st day of December of the year of issue. No license shall be transferable." Section 27. Section 5.64.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.64.030 License required -- Application. No person shall engage in the business of a secondhand dealer in the City of Yakima without first procuring a license therefor, and in order to procure a license he shall present to the City Clerk an application which shall contain the name of the applicant, the place where he proposes to conduct his business, the name under which the same shall be conducted; if a co- partnership, the names of the members of the firm; if a corporation, the names of its officers; and in addition thereto shall supply the City Clerk with such other and further information as may be required to administer the provisions of this chapter. If such application is approved the City Clerk shall issue a license to the applicant upon his paying a license fee of Twenty -five Dollars ($25.00). Said license shall not be assignable or transferable." Section 28. Section 5.78.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.78.060 Fees. The license fee for the respective types of for -hire vehicles shall be as follows: (a) Taxicab - -Fifty Dollars ($50.00) per year, or for any portion of a year; (b) Sight- seeing car - -One Hundred Dollars ($100.00) per vehicle per year, or for any portion of a year." - 8 - Section 29. Section 5.78.170 (b) of the City of Yakima Municipal Code is hereby amended to read as follows: "5.78.170 City driver's license -- Application and renewal fee. (b) The fee for a city driver's license is hereby fixed • at Ten Dollars ($10.00) each year, Section 30. Section 6.22.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "6.22.050 License, fees. For the year from February 1, 1970, through January 31, 1971, and for each year thereafter, the annual license fees for owning, keeping or having control of dogs, and dog and cat kennels, in the City of Yakima shall be as follows: Each dog, male or female $4.00 Dog kennel ., $25.00 Cat kennel- -six or more cats $10.00 Provided, that in the case of dogs or kennels previously licensed, there shall be an additional fee of Two Dollars ($2.00) for each dog or kennel license which is purchased more than thirty days after the first day of February of any year." Section 31. Section 11.32.100 of the City of Yakima Municipal • Code is hereby amended to read as follows: "11.32.100 Fee for installer's license. The fee for such heating and /or comfort cooling installer's license shall be Fifty Dollars ($50.00) per annum for each establishment or place of business of each such heating and /or comfort cooling instal- ler, to be taken out in case of individuals in the name of the person owning the business, and in the case of firms or corpora- tions, in the name of such firm or corporation, which license expires one year from date of issue." J Section 32. Section 11.32.130 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.130 Journeyman's license or apprentice permit - -Fee. The fee for such journeyman's license shall be Ten Dollars ($0.00) and Ten Dollars ($10.00) for renewal, per year for each person, payable to the City Clerk. The fee for such apprentice permit shall be Five Dollars ($5.00) per year for each person payable to the City Clerk. Each separate examination will require pay- ment of a fee of Five Dollars ($5.00), payable to the Inspection • Department of the City." Section 33. Section 11.44.090 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.090 Addition of new Section 2.15 to Uniform Plumbing. Code. There is hereby added to Part Two, Qualifications of Plumbers, of the Uniform Plumbing Code, adopted by this chapter, following Section 2.14, a new Section 2.15 to read as follows: - 9 - • • 'Section 2.15 -- LICENSE PROCUREMENT AND FEES. Original and renewal licenses may be issued by the City Clerk to any applicant who holds a valid Certificate of Qualification or Registration, as provided for in this Chapter or whose application is approved by the Inspection Division. License fees shall be paid to the City of Yakima at time of issuance in accordance with the follow- ing schedule: Original Renewal Plumbing Contractor's License . . . $100.00 $100.00 Journeyman Plumber's License . . . 10.00 10.00 Side -Sewer Contractor's License . . . 50.00 50.00 Journeyman Sewer Installer's License 10.00 10.00 Licenses expire on December 31st of each year'." Section 34. Sections 5.42.020 {b) and 5.64.090 of the City of Yakima Municipal Code are hereby repealed in their entirety. Section 35. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by • law and by the City Charter.
