HomeMy WebLinkAbout1970-1199 ORDINANCE NO 7/ (f .y/ AN ORDINANCE rezoning certain property situated between North 16th Avenue and North 18th Avenue, and south of Lincoln Ave- nue, within the City of Yakima, from R -3, Multiple- Family Zone, to B -2, Local Business Zone. WHEREAS, pursuant to the filing with the City of an application to rezone property described below, and after due notices were given as required by law, public hearings wete held by the Planning Commis- sion and the City Council of the City of Yakima on the matter of the rezoning of property described below from R -3, Multiple - Family Zone, to B -2, Local Business Zone, and WHEREAS, as a result of its most recent public hearing on December 29, 1969, the City Council finds that a substantial change of conditions has occurred since the adoption by the City of its General Plan, among those changed conditions being a growth in popula- tion in the westerly area of the City and within the area which can reasonably be expected to be served by the business proposed for the II I property for which the rezone is sought, and the development and im- provement of streets, including arterials, within the area which can reasonably be expected to be served by the business proposed for the property for which the rezone is sought. The City Council further finds that the area which can reasonably be expected to be served by the business proposed for the property for which the rezone is sought is greater than that contemplated by the General Plan, and that there is a public need to be served by granting the application for rezone. The City Council further finds that a portion of the land for which the rezone is sought is bounded on the north by Lincoln Avenue, and on the east by 16th Avenue, both of which avenues are arterial streets; 5 and that along arterial streets within the City there presently exist. sufficient areas of land classified as R -3, Multiple- Family Zone, so that the public need does not require the perpetuation of the existing R -3, Multiple - Family Zone, for the property for which the rezone is sought. The City Council further finds that the streets in the vici- nity of the property for which the rezone is sought are adequate to accomodate any increase in traffic which may result from the granting of the rezone application, and that no undue traffic congestion or hazard would be thereby created. The City Council further finds that because of the location and physical characteristics of the property, the highest and best use for the property for which the rezone is sought is for B -2, Local Business Zone, and WHEREAS, as a result of its public hearings, and based on its findings, the City Council concludes that it would be in the best public interests and in accord with good planning to grant the appli- cation for the rezone of the property described below from R -3, Multiple- Family Zone, to B -2, Local Business Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The application of John Wade, and others, to rezone the following property within the City of Yakima, Washington, to wit: The North half of the South half of Lots 1 and 2, Summit View Acre Tracts according to the plat thereof recorded in Volume "A" of Plats, page 30, records of Yakima County, Washington. The South half of the South half of Lots 1 and 2, Summit View Acre Tracts according to the plat thereof recorded in Volume "A" of Plats, page 30, records of Yakima County, Washington. Lots 3 and 4, Summit View Acre Tracts, according to the plat thereof recorded in Volume "A" of Plats, page 30, AND that por- tion of Lots 17 and 18 beginning at the northeast corner of Lot 18, thence south 192 feet, thence north 87 degrees west to west line of Lot 17, thence north to northwest corner of Lot 17, thence east to beginning as recorded in Volume "F" of Plats, page 40. Lot 5, Summit View Acre Tracts, as recorded in Volume "A" of Plats, Page 30, AND that portion of Lot 16 except beginning 98 feet south of northeast corner of Lot 16, thence south 80 feet, thence north 87 degrees west to a point 60 feet east of west line of Lot 16, thence west 60 feet, thence north 95 feet, thence east to beginning as recorded in Volume "F" of Plats, page 40. from R -3, Multiple - Family Zone, to B -2, Local Business Zone, is hereby • granted; and said property is hereby zoned as B -2, Local Business Zone Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. - 2 - Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
