AN ORDINANCE relating to city employees; specifying working hours,
leaves of absence and overtime compensation; amending
Sections 2.22.030, 2.40.080 E, 2.40.080 H, 2.40.090 A
and 2.40.100 of the City of Yakima Municipal Code; and
declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 2.22.030 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"2.22.030 Time-Off Privileges.
A. Vacation and holidays specified. All firemen,
regularly employed as such shall be granted time-off
privileges as follows:
(1) Vacation Leave:
(a) After one year's service each member of
the fire department shall be eligible for five days
of vacation leave per year with pay. The term "day"
wherever used in regard to firemen shall mean one
twenty-four hour working day as the same is used
with respect to the employees of the fire depart-
ment; it being understood that all firemen work
for a period of twenty-four hours and are then
1111 off for a period of forty-eight hours;
(b) After ten years of continuous service,
each member of the fire department shall be
eligible to seven days vacation leave with pay
for each year worked thereafter;
(c) Vacation leave shall accrue from the
date of employment but shall not be available
until the completion of one year of service. The
same regulations shall apply to the scheduling and
granting of vacation leave as established in Sec-
tion 2.40.020 (d) of this code for other city
employees insofar as the same are applicable.
(L) Holidays. Each member of the fire department
shall be entitled to three days off with pay per year
in lieu of holidays. Such time off with pay in lieu
of holidays shall be scheduled so as to meet the
operating requirements of the fire department, and,
insofar as the same may be practicable, the preference
of the members.
411 B. Vacation and holidays accrual. Unused vacation and
holiday.: leave may accrue to a maximum of 14 days.
C. Sick Leave. Each member of the fire department
shall be entitled to one-half 1 day per month sick leave with
pay, which sick leave may be accumulated to a maximum of
thirty days. The same general rules and regulations shall
apply to the firemen as set forth in Section 2.40.030 of
this code for other city employees.
D. Day Men and Alarm Operators. All members of the
fire department working straight day shifts and alarm
operators shall be entitled to vacation leave, sick leave,
and holiday time off, which shall be computed on the same
basis as for the other employees in the city working on a
forty -hour week basis."
• Section 2. Section 2.40.080 E.of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.080 Holidays With Pay.
E. When employees below the level of department head,
other than those working on jobs where employees are
scheduled to work in shifts in a service that is rendered
seven days per week and twenty -four hours per day, are
required to work on a holiday they shall be paid for such
work at the rate of time and one -half in addition to their
regular pay."
Section 3. Section 2.40.080 H of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.080 Holidays With Pay
H. In the police department, and other departments
required to render service 24 hours each day, employees shall
be granted time off in lieu of holidays in an amount equal
to the actual number of holidays enjoyed by other employees
during the calendar year. The amount of time off in lieu
of holidays to be granted during each year shall be computed
each January and scheduled to be taken during that calendar
year. The amount of time off in lieu of holidays to be
granted an employee who is employed for a partial calendar
year shall be pro rated for the period of the calendar year
during which that individual is employed, and a deduction
shall be taken from the salary of any employee who ceases
employment and who has taken time off in lieu of holidays
in excess of the pro rata amount to be granted him by the
provisions of this section. Any time off in lieu of holi-
days not taken by December 31 of each year shall be forfeited
unless the City Manager extends the time within which such
time off may be taken because of an emergency or other
unusual circumstances."
Section 4. Section 2.40.090 A of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.090 Work Week.
A. The basic work week shall be forty hours and the
standard work day shall be eight hours with the exception of
the fire, transit and parks and recreation departments and
some other few jobs which require special consideration by
mutual agreement between the employee and the appointing
authority."

Section 5. Section 2.40.100 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"2.40.100 Overtime Pay and Compensatory Time.
A. Overtime Pay.
(1) Overtime payment will be allowed for an
employee below the rank of division head, police captain
and battalion chief, when ordered to work, at the rate
of time and one -half except as follows:
(a) When police officers are required to
appear in municipal court during their off duty
hours they shall be paid at a straight time rate
for such time. A minimum of 2 hours per day for
court appearance shall be allowed. The officers
shall have the option to take time off, at a
straight time rate, in lieu of payment, and to
accumulate such time off to a maximum of 24 hours
for any one officer.
(b) Overtime payment may be allowed for
division heads, police captains and battalion
chiefs at the rate of time and one -half when
required to work because of an emergency or un-
usual circumstances if approved by the City Mana-
ger.
• (c) Department directors, when required to
work overtime in a non - supervisory capacity because
of an emergency determined by the City Manager, ;a
may be paid overtime at a straight time rate.
(2) Pay for fire department personnel when called
from off shift in order to maintain minimum fire sup-
pression strength as determined by the City Council
shall be computed by dividing each employee's basic
monthly salary by 10 to arrive at a 24 hour shift rate .
and the hourly rate shall be computed by dividing the
shift rate by 24. When personnel are called from off
shift by the fire chief because of a fire the hourly
rate shall be computed by dividing the basic monthly
salary by 173.
(3) - Pay for employees, other than fire department
personnel, who are paid at a monthly rate shall be com-
puted by dividing the basic monthly salary by 173.
(4) Fractions of an hour served on overtime duty
shall be rounded to the next full hour for the purpose
of computing the amount of overtime pay.
(5) All overtime payments shall be contingent on
the availability of departmental funds.
B. Compensatory time.
(1) Compensatory time off shall allowed at the
rate of time and one -half when funds are not available
and for personnel below the rank of department direc-
tor in cases where overtime pay is not authorized by
this chapter.

(2) Allowable compensatory time worked shall be
reported on the monthly time sheets as prescribed by
the director of finance.
(3) Compensatory time off must be requested,
approved and reported in the same manner as prescribed
for vacation leave.
(4) Compensatory time off may be accrued to a
maximum of three working days. Any compensatory time
accrued in excess of three working days will be forfeited
unless the City Manager approves the accrual of addi-
tional compensatory time because of an emergency or
other unusual circumstances.
C. Travel and Training Time. Time spent by an
employee, beyond the normal working day, for training classes
or travel shall not be considered as overtime work."
Section 6. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and welfare
of the people of the City of Yakima and an emergency is hereby declared
to exist and this ordinance shall be in full force and effect
immediately upon its passage, approval and publication as provided by
law and by the City Charter.
