HomeMy WebLinkAbout1970-1209 ORDINANCE NO. 1209 AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to institute and prosecute legal proceedings for the condemnation of any property rights damaged or interfered with in a manner to be legally compensable by the construction and existence of B Street and Lincoln Avenue overcrossings; declaring such condemnation and any such damage or interference to be necessary for a public use required by the pubic interests; directing that any compensation to be paid for any such damage or interference be paid from the Urban Arterial Fund (Bud- get Fund No. 380) of the City of Yakima; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The City Attorney of the City of Yakima is hereby authorized and directed to institute and prosecute an action in the Superior Court of the State of Washington, in and for Yakima County, to condemn property rights, if any, appurtenant to the real property described on "EXHIBIT 'A' to Condemnation Ordinance" attached hereto and made a part hereof, damaged or otherwise interfered with in a manner so as to be legally compensable by the construction and exis- tence of a public improvement project known as "B Street and Lincoln Avenue Bridge Overcrossings" to consist of ramps and overhead struc- tures to be constructed solely on and within existing public street right -of -way in accordance with plans and specifications approved and adopted by the Yakima City Council by Ordinance No. 1200, dated January 19, 1970, entitled "AN ORDINANCE adopting plans and specifica- tions for B Street and Lincoln Avenue Bridge Overcrossings". Section 2. The public convenience and necessity demand the con- struction by the City of the B Street and Lincoln Avenue Bridge Over - crossings public improvement project described in Section 1 hereof; • and any resulting damage to or other interference with any property rights appurtenant to the real property described on EXHIBIT A hereto is required for the interests of the public and for the City of Yakima, and any such resulting damage to or interference with such property rights does constitute a public use of said property rights necessary for the use and purpose aforesaid. Section 3. Any compensation to be paid by the City for damage to or interference with any compensable property rights, directed by 411P this ordinance to be condemned, shall be paid from the Urban Arterial Fund (Budget Fund No. 380) of the City of Yakima. Section 4. In prosecuting such condemnation proceeding, the City Attorney is hereby authorized to stipulate to any matters for the purpose of minimizing damages. Section 5. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
