AN ORDINANCE authorizing and directing the City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of real property
for the widening and improving of a portion of South 24th
Avenue, including the reconstruction of an existing
bridge constituting a portion of South 24th Avenue across
Wide Hollow Creek, and for the installation of curbs,
gutters, sidewalks, drainage facilities and public
utility facilities related thereto, for changing the
grade of a portion of South 24th Avenue and for acquir-
ing necessary slope and fill easements f rom abutting
land in connection with such widening and improving;
providing for the condemnation and taking of such real
property and declaring the condemnation and taking there-
of to be necessary for a public use required by public
interests; directing that compensation for such taking
be paid froth the Urban Arterial Fund of the City of
Yakima; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney of the City of Yakima is hereby
authorized and directed to institute and prosecute an action in the
Superior Court of the State of Washington, in and for Yakima County,
for the condemnation and acquisition of the hereinafter described
real property for the widening and improving of a portion of South
• 24th Avenue, including the reconstruction of an existing bridge
constituting a portion of South 24th Avenue across Wide Hollow Creek,
and for the installation of curbs, gutters, sidewalks, drainage faci-
lities and public utility facilities related thereto, for changing
the grade of a portion of South 24th Avenue, and for acquiring neces-
sary slope and fill easements from abutting land in connection with
such widening and improving, all in accordance with, and as depicted
on, plans and specifications therefor filed in the office of the
Yakima City Engineer for the project designated as South 24th Avenue
(U.A.B. Project No. 8 -4- 180(04)), said real property being situated i:i
the City of Yakima, Yakima County, Washington, and being more parti-
• cularly descried as follows:
Parcel 1. That portion of Parcel A described as follows:
Beginning at the Northwest corner of the Southwest quarter
of the Northeast quarter of Section 35, Township 13 North,
Renge 18 E.W.M.; thence East 20 feet; thence South and
parallel to the West line of said subdivision 177.44 feet;
thence South 3 ° 16'14" East 210.34 feet to a point 32 feet
East of the West line of said subdivision; thence South
and parallel to said subdivision line 52.16 feet; thence
Ew t 18 feet, thence South to the South line of Parcel. A;
thence West 50 feet to the West line of said subdivision;
thence North to point of beginning.
Parcel A:
The West one -third of the North 6 acres of the West 16
acres of the Southwest quarter of the Northeast quarter
of Section 35, Township 13 North, Range 18, E.W.M.
• Parcel 2. All that portion of the following described Parcel B
lying East of a line beginning at a point on the North
property line and 33 feet West, when measured at right
angles, of the East line of the Northwest quarter of
Section 35, Township 13 North, Range 18, E.W.M., thence
South and parallel with said East line 74.1 feet, thence
West 17 feet; thence South to the South property line of
said Parcel B.
Parcel B:
That portion of the Northeast quarter of the Southeast
quarter of the Northwest quarter of Section 35, Township
13 North, Range 18, E.W.M., described as follows:
Beginning at a point 924.1 feet North of the Southeast
corner of the Northwest quarter of said section; thence
West 167 feet; thence South 214 feet, more or less, to the
centerline of Wide Hollow Creek; thence Northeasterly along
said centerline to the East line of said Northwest quarter;
thence North 100 feet, more or less, along said East line
to the point of beginning.
Parcel 3. All that portion of the following described Parcel C
beginning at a point 924.1 feet North of the Southeast
corner of the Northwest quarter of Section 35, Township 1?
North, Range 18, E.W.M.; thence West 35 feet; thence North
3 ° 16'14" West 325.3 feet; thence North 65.6 feet to the
North line of Parcel C; thence East 53.5 feet to the East
line of said Northwest quarter; thence South 390.5 feet
along the East line of said Northwest quarter to the point
of beginning.
Parcel C:
That part of the Northeast quarter of the Southeast quarter
of the Northwest quarter of Section 35, Township 13 North,
Range 18, E.W.M., lying North of the centerline of Wide
Hollow Creek, EXCEPT, beginning at a point 924.1 feet North
of the Southeast corner of the Northwest quarter of said
Section; thence West 167 feet; thence South 214 feet, more
or less, to the centerline of Wide Hollow Creek; Northeas-
terly along said centerline to the East line of said North-
west quarter; thence North 100 feet, more or less, along
• said East line to the point of beginning.
Section 2. That the acggisition of said real property for the
purposes herein mentioned is required for the interests of the public
and of the City of Yakima, and the uses and purposes herein mentioned
do constitute a public use of said property, and that said real
property is necessary for the use and purposes mentioned herein.

Section 3. That the compensation for said real property to be
taken shall be payable from the. Urban Arterial Fund of the City of
Yakima.
Section 4. That in conducting said condemnation proceedings, the
City Attorney is hereby authorized to stipulate to any matters for
the purpose of minimizing damages.

Section 5. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and effect
immediately upon its passage, approval and publication as' provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 13th day of
