AN ORDINANCE providing for the vacation of unimproved street right -of-
way in the City of. Yakima, Washington.
WHEREAS, a petition has been filed with the City Council of. the
City of Yakima requesting the vacation of the hereinafter described
unimproved street right -of -way, and
WHEREAS, a hearing by the City Council was duly held on said
petition, and as a result of such hearing the City Council finds it
to be in the best interests of the City of Yakima that said petition
be granted and that said unimproved street right -of -way be vacated,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described unimproved street right -of-
way in the City of Yakima, Washington, to -wit:
That portion of Willow Street right -of -way adjacent to Lot 5,
as dedicated by Plat of Subdivision of east half of Lot 25,
Hathaways Five Acre Tracts, according to the official plat
thereof recorded in Volume "E" of Plats, page 29, records of
Yakima County, Washington;
II I be and the same is hereby, vacated.
Section 2. The City of Yakima hereby reserves all necessary ease-
ments and rights -of -way for the installation and maintenance of any
and all water mains, sewers or utilities of any and all kinds which
may now exist in said right -of -way or which it may hereafter desire
to construct thereon, and no buildings shall be constructed on any
portion of said vacated unimproved street right -of -way without the
prior approval of the City.
Section 3. This ordinance shall be in full force and effect 30
days after its passage, approval and publication as provided by law
and by the City Charter.
PASSED BY THE CITY COUNCIL, sigp.0 and approved this 22nd day
of June, 1970. 7
