ORDINANCE NO. /©© AN ORDINANCE relating to licenses and business regulations pertaining to auction sales; classifying auctions and regulating certain classes of auction sales; and amending Section 5.14.020 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Section 5.14.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.14.020 CLASSES OF AUCTIONS - REGULATIONS. Auctions shall be divided into three classes: Class One Regular auctions, Class Two Temporary auctions, and Class Three Closing out auctions. Regular auctions shall be those conducted in a fixed place of business and which may be known and advertised as an auction house, but no license therefor shall be issued for a period of less than six months' duratiot,_ Temporary auctions shall be auctions conducted for the sale of any kind of goods, wares or merchandise, real estate and livestock. They shall be deemed and defined to be teth- porary if they consist of goods, wares or merchandise brought to the City of Yakima and so offered within a year of their arrival, or when the party conducting such sale cannot give satisfactory evidence to the contrary upon demands made so to do by the City Manager. All temporary auctions shall be held on successive days, Sundays and legal holidays excepted, and shall not continue for a period of more than thirty days, in all, from the commencement of said sale. Closing out auctions shall be auctions of stock on hand conducted by persons retiring from business and shall not be added to or supplemented by other goods: Provided, how- ever, that no license shall be issued for a closing out auction unless the person applying for such license shall have been continuously in business in the City of Yakima, as a retail or wholesale merchant, for the period of one year next preceding such sale. All closing out auctions shall be held on successive days, Sundays and legal holidays excepted, and shall not continue for a period of more than thirty days, in all, from the commencement of said sale." Section 2. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
