AN ORDINANCE providing for the vacation of a portion of North 4th Street
and certain alleys in the City of Yakima, Washington.
WHEREAS, a petition has been filed with the City Clerk of the City
of Yakima, petitioning the Yakima City Council for the vacation of a
portion of North 4th Street and certain alleys all fully described be-
e low, and
WHEREAS, by resolution adopted by the City Council, a hearing on
said petition was set for the 8th day of January, 1968, and due notice
thereof has been given in the manner required by laWi and
WHEREAS, said hearing was continued to and held on March 11, 1968,
and
WHEREAS, upon the hearing on said petition and vacation, the City
Council finds the granting of said petition to be in accord with the
General Plan for the City of Yakima in that such vacation would accom-
modate the construction of a downtown mall and shopping center as pro-
posed by said General Plan; the City Council further finds that all per-
sons having any right, title: or interest in and to all property abutting
• on the street and alleys to be vacated have consented to such vacation
and have executed deeds conveying title to the vacated right of way to
Yakima Mall - Shopping Center Corporation, which deeds are held in escrow
under instructions which protect the interests of the public in the
event the construction of the downtown mall and shopping center is not
carried out as contemplated; the City Council further finds that the va-
cation is requested to be effective at a future date, and ought to be
effective on July 1, 1968, so that the public will not be deprived of
the use of the street and alleys to be vacated until such time as the
vacation must necessarily be effective so as to accommodate construction
of the downtown mall and shopping center; the City Council further finds
that plans for constructing the downtown mall and shopping center have
been agreed to by the various property owners affected by the vacation
so that suitable loading and receiving dock areas and access thereto
from public streets will be provided to the premises included in
and affected by the proposed construction of the downtown mall
and shopping center; the City Council finds that easements should
be reserved through the vacated rights of way to
accommodate public and private utilities, as provided hereinbelow; and
the City Council further finds that to grant said petition so as to
vacate said streets and alleys would be in the best interests of the
people of the City of Yakima, and that said petition should be granted
as provided hereinbelow, now, therefore,
• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The following described street and alleys in the City
of Yakima, Washington, to -wit:
That portion of North 4th Street lying between East Yakima
Avenue and East "A" Street adjacent to Block 70 and Block
90, the Town of North Yakima, now Yakima, according to the
plat thereof filed in Volume E of Plats, Page 1, records of
Yakima County, Washington.
The entire "T" alley in Block 70, the Town of North Yakima,
now Yakima, according to the plat thereof filed in Volume
E of Plats, Page 1, records of Yakima County, Washington.
The entire "T" alley in Block 90, the Town of North Yakima,
now Yakima, according to the plat thereof filed in Volume
E of Plats, Page 1, records of Yakima County, Washington;
be, and the same are hereby, vacated, provided, that the vacation
• thereof shall be effective on July 1, 1968.
Section 2. The City of Yakima hereby reserves all necessary ease-
ments and rights of way for the installation and maintenance of any anc
all water mains, sewers or utilities of any and all kinds which may noti
exist in said street or alleys or which it may hereafter desire to
construct therein, and the City Council does hereby consent to the con-
struction of buildings and other improvements over and along the ease-
ments hereby reserved, provided that the construction and existence of
any such buildings or other improvements shall not interfere with the
maintenance and operation of any existing or new water mains, sewers,
or utilities situated within such easements.
• Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
