AN ORDINANCE relating to fire prevention; adopting by reference the
Fire Prevention Code, 1965 Edition, and the "October,
1966 Revision of the Fire Prevention Code, 1965 Edifice,
both of the American Insurance Association; adopting y
reference the National Fire Codes, 1967 -68 Edition, of
• the National Fire Protection Association; making amend-
ments and additions to such Codes; prescribing fees and
requiring permits and certificates; prescribing regula-
tions governing conditions hazardous to life and properfy
from fire or explosions; prohibiting false fire alarms;
declaring violations to be misdemeanors and prescribing
penalties for such violations; amending Sections 10.05.:10
.020, .030, .040, .050, .060, .070, .080, .090, .100,
.110 and .120, and adding new Sections 10.05.130, .140
and .150, all of the City of Yakima Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within t`c
ta:° of Washington to pass ordinances adopting by reference, compila-
tl_a is ar ►d codes, and
t,,ITREAS, the City Council of the City of Yakima has heretofcre
examined and understands the scope and purpose of the regulations of
Fire Prevention Code, 1965 Edition, of the American Insurance
As:o:'iation, together with the October, 1966 Revision thereof, and
Vc'. 'mes 1 through 10 of the National Fire Codes, 1967 -68 Edition of
a.e national Fire Protection Association, and deems it in the best
interests of the City that such Codes be adopted as the law of the
Clty of Yakima, and
WHEREAS, three copies of all such Codes have heretofore been
CA.ed in the office of the City Clerk of the City of Yakima for us,
ar:d examination by the public, as required by law, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. Section 10.05.010 of the City of Yakima Municipal Cz sic
i hereby amended to read as follows:
• 10.05.010 ADOPTION OF CODES. The Fire Prevention Code,
1)65 Edition, of the American Insurance Association, including
Appendix A, "Protection of Tanks Containing Flammable or Com-
bustible Liquid in Locations That May Be Flooded" and Appen-
dix B, "Abandonment or Removal of Underground Tanks ", and the
"October, 1966 Revision of the Fire Prevention Code, 1963 Edi--
t-ion" of the American Insurance Association, together with the
following numbered and entitled volumes of the National Fire
Codes, 1967 -68 Edition, of the National Fire Protection Assori_ --
t' on, to-wit:
Volume 1, "Flammable Liquids ";
Volume 2, "Gases ";
Volume 3, "Combustible Solids, Dusts & Explosives ";
Volume 4, "Buildirg Construction & Facilities ", (including
Standards 78, 82 (Part 1- Section 1 only), 82A, 102,
204 and 213 only);
Volume 5, "Electrical", (including Standards 75, 76, 79
and 496 only);
Volume 6, "Sprinklers, Fire Pumps & Water Tanks ";
Volume 7, "Alarm & Special Extinguishing Systems";
Volume 8, "Portable, Manual Fire Control Equipment";
Volume 9, "'Occupancy Standards & Process Hazards"; and
Volume 10, "Transportation";
• of which not less than three copies each have been and now are
on file in the office of the City Clerk of the City of Yakima
are hereby adopted and incorporated as fully as if set out in
full herein, as the fire prevention code of the City of Yakima,
except as hereinafter amended, and the provisions and regula-
tions thereof are hereby adopted as the provisions and regula-
tions of the City of Yakima; and the several sections or numbers
therein shall constitute, and may be referred to as, the numbers
of this Chapter."
Section 2. Section 10.05.020 of the City of Yakima Municipal Code
is hereby amended to read as follows:
11 10.05.020 DELETIONS FROM FIRE PREVENTION CODE. Article
13, "Fireworks ", Article 24, "Oil Burning Equipment", and
Article 26, ° Ovens and Furnaces" are hereby deleted in their
entirety from the Fire Prevention Code of the American Insur-
ance Association adopted by this Chapter."
Section 3. Section 10.05.030 of the City of Yakima Municipal CodE
is hereby amended to read as follows:
"10.05.030 PERMITS, CERTIFICATES, FEES. The Fire Mar-
shal, or any officer or member of the Bureau of Fire Preven-
tion designated by the Fire Marshal, is hereby authorized and
empowered to issue permits, certificates of approval and cer-
tificates of fitness required by this code.
A permit fee of ten dollars ($10.00) shall be charged to
each person, firm or corporation engaged in the business of
maintaining fire extinguishers or fumigation.
It shall be unlawful for any person to repair or fill any
portable or other type extinguisher, or to fumigate commercially,
unless such person has obtained from the Fire Marshal a Certi-
ficate of Fitness to do so. Each applicant applying for a
Certificate of Fitness to repair or fill portable fire exting-
uishers or for fumigation, shall be at least twenty -one years
of age, able to speak, read and write the English language
understandably, shall be reliable and have good judgment,
and shall be familiar with the necessary work and the materials
used in repairing and filling portable fire extinguishers.
• Whenever the Fire Marshal shall find that a person holding
such a Certificate of Fitness is careless, negligent or un-
fitted for the work for which it is issued, the Fire Marshal
is hereby authorized to revoke or suspend such Certificate.
Any fees required by local or state law in the enforcement
of this code shall be paid to the Treasurer of the City of
Yakima, Washington.
Any permit required by this code shall be issued to the
recipient on a permanent basis other than those which require
renewal on an annual basis."

Section 4. Section 10.05.040 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"10.05.040 REFUSE CONTAINERS. Only the following types
of containers shall be used in the business district for dis-
nosing of readily combustible refuse:
• The twenty (20) gallon size waste can made of 26 U.S
Standard gauge galvanized sheet metal with the lid fastened
to the can in an acceptable manner.
The stationary metal refuse box made of a 14 U.S. Standard
gauge metal on .a 2 -inch angle iron frame with attached lid or
lids on a 3/4 -inch angle iron frame, six (6) to sixteen (16)
feet in length, three (3 feet wide, four (4) feet high at
the rear, with the lid or lids to operate so that they close
automatically by actuation of a fusible link of 160 - degree
F. or less.
The drop -off bin type box, 1 yard size, 16 U.S. Standard
gauge metal with fusible link actuated lid or lids, made one
(1) yard to forty (40) yard size. Also the drop -off bin type
box twenty (20) to forty (40) yard size of 12 U.S. Standard
gauge steel for sides and bottoms, lids of 14 U.S. Standard
gauge steel, with the lid or lids to operate so that they
close automatically by actuation of a fusible link of 160 -
degree F. or less.
All lids for containers shall be whole without any openings.
• The drop -off bin type container, over 3 yard size, shall not
be located in alley or. street."
Section 5. Section 10.05.050 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"10.05.050 REGULATION OF ALARM GONGS AND CHIMES (New
Provision): Every building in the City of Yakima used as a
school, church school, hospital, nursing home, rest home, nur-
sery, sanitarium, orphanage, old people's home, children's
home, hotel, apartment house of more than one story with four
or more families doing their own cooking and living independent-
ly of each other in said building, shall have a manually operat-
ed fire alarm system capable of being heard distinctly throughout
the building. Such alarm system shall be operated from alter-
nating current, electrically, and shall be provided with a man-
ually operated switch and gong so that they are accessible within
100 feet of any given point on any floor level. NFPA Standard
72A.
• Every alarm system shall be installed in compliance with
t he Electrical Code of the City of Yakima, Washington, and the
State of Washington.
An automatic alarm system meeting NFPA Standard 72A re-
quirements shall be accepted in lieu of a minimum manually-
operated fire alarm system.
The person in charge of any building where a fire alarm
system is required shall test the system at least once every
two weeks to ascertain whether or not the system is in working
order, and shall immediately correct any defect that might
be found.

It shall be the duty of any employee in a building to see
that the fire alarm system is operated im2cdiately after the
discovery of fire in the building.
In all buildings where a continuously ringing fire alarm
system is required, an electrically operated chime system may
be substituted if such chime system is approved for the pur-
pose by the Fire Marshal."
• Section 6. Section 10.05.060 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"10.05.060 CARE OF STANDPIPES AND HOSE
The owner or person in charge of any building in the City of
Yakima, Washington that is equipped or may hereafter be equipped
with wet or dry line standpipes with inlet or outlet connections
with National Standard thread shall cause such connection and
fittings to be kept in proper working order, and ready for
immediate use in case of fire. Caps with approved lugs shall
be installed on all valves and fittings. All hose connected
with any dry or wet standpipes shall be kept ready for immedi-
ate use. All hoses shall be tested at least once each year,
and satisfactory evidence presented to the Fire Marshal showing
fitness for use."
Section 7. Section 10.05.070 of the City of Yakima Municipal Codc
is hereby amended to read as follows:
"10.05.070 ESTABLISHMENT OF LIMITS IN WHICH STORAGE OF
• EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED:
The limits referred to in Section.12.5b, of the Fire
Prevention Code in which storage of explosives and blasting agents
is pro..bited, are hereby established as follows: Within the
City Limits of Yakima, Washington."
Section 8. Section 10.05.080 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"10.05.080 ESTABLISHMENT OF LIMITS IN WHICH STORAGE OF
FLAMMABLE LIQUIDS IN OUTSIDE ABOVE GROUND TANKS IS TO BE PRO-
HIBITED The limits referred to in Section
16.22a, of the Fire Prevention Code in which bulk plant
storage of flammable liquids in outside above ground tanks
is prohibited, are hereby established as follows: First fire
zone and third fire zone.
The limits referred to in Section 16.51, of the Fire Pre-
vention Code in which new bulk plants for flammable or combus-
tible liquids are prohibited, are hereby established as follows:
First fire zone and third fire zone."
• Section 9. Section 10.05.090 of the City of Yakima Municipal Codc .
is hereby amended to read as follows:
"10.05.090 ESTABLISHMENT OF LIMITS IN WHICH BULK PLANT
STORAGE OF LIQUEFIED PETROLEUM GASES IS TO BE RESTRICTED:
The limits referred to in Section 21.6, of
the Fire Prevention Code, in which bulk storage of liquefied
petroleum gas is restricted, are hereby established as follows:
First fire zone and third fire zone."

Section 10. Section 10.05.100 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.100 TARPOTS: No tarpot shall be used inside any
building while such tarpot is being used to heat any asphalt
product for any purpose.
At least one twenty (20) pound (16 B -C UL rating) dry
chemical fire extinguisher shall be maintained at the site where
a tarpot is in operation.
Smaller size extinguishers, the sum of which equals twenty
pounds, may be used in lieu of one twenty (20) pound dry chemi-
cal fire extinguisher."
Section 11. Section 10.05.110 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.110 STORAGE IN UNFINISHED SPACES:
It shall be unlawful to place, store, or keep or permit to be
placed, stored, or kept, in any unfinished attic or other place
directly under a roof or any unfinished basement or unfinished
area under a building except a residence, any furniture, baggage
or other combustible or flammable material. The term "unfinish-
ed" as used in this section, shall apply to any space or area
directly under the roof of any building or under the lowest
story of a building, which, if used for storage of combustible
materials, would be required by the Building Code to have all
walls, and ceilings completed as required for any intermediate
area or space within the building."
. Section 12. Section 10.05.120 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.120 WOODEN BOX, TOTE BIN AND PALLET STORAGE:
1. All empty wood boxes, when piled north, northwest or
northeast or west of a frame building or frame platform,
shall be not less than fifty feet therefrom and such
piles shall not exceed twenty feet in width, fifty feet
in length, twelve feet to the eaves, and eighteen feet
to the gable thereof.
2. All empty wood boxes, when piled to the south, southwest,
southeast or east of a frame building, or frame platform,
shall be not less than thirty feet therefrom and such
piles shall not exceed twenty -five feet in width, fifty
feet in length, fourteen feet to the eaves, and twenty
feet to the gable thereof.
3. All empty wood boxes, when piled to the north, northwest
or northeast or west of brick, tile, stone or concrete
building, shall be not less than thirty feet therefrom and
such piles shall not exceed twenty -five feet in width,
sixty feet in length, sixteen feet to the eaves, and twenty
feet to the gable thereof.
4. All empty wood boxes, when piled to the south, southwest,
southeast or east of a brick, tile, stone or concrete
building, shall be not less than twenty feet therefrom and
such piles shall not exceed thirty feet in width, sixty feet
in length, sixteen feet to the eaves and twenty -four feet to
the gable thereof.

5. All empty tote bins or pallets may be piled flat on the top
of the pile without a gable. The pile shall not exceed
thirty-five feet in width, sixty feet in length, and
twenty-five feet in height.
6. The length, height and width of any specific box, tote bin
or pallet pile may be increased upon written approval of
• the Fire Marshal.
7. All piles of empty wood boxes, tote bins, and pallets shall
be so arranged that alleys of not less than twelve feet
shall surround each pile and the ground around said
piles shall be kept free of weeds to a distance of at
least six feet from said piles.
Section 13. There is hereby added a new Section numbered
10.05.130 to the City of Yakima Municipal Code to follow Section
10.05.120, which new Section 10.05.130 shall read as follows:
• "10.05.130 •DUTIES OF PERSONS IN CONTROL OF PUBLIC
BUILDINGS: The owner, manager or person having con-
trol or management of a place of public assembly shall
notify the Fire Marshal of the intent to use the occu-
pancy except that a continuing program of meeting at
same shall not require any further notice."
Section 14. There is hereby added a new Section numbered
10.05.140 to the City of Yakima Municipal Code to follow Section
10.05.130, which new Section 10.05.140 shall read as follows:
"10.05.140 FALSE FIRE ALARM. It shall be unlawful
for any person to intentionally and 'maliciously transmit,
or cause to be transmitted, a telephone message or a
signal on any portion of the fire alarm system of the
City of Yakima Fire Department, or by conveying a message
by any other means to the Fire Department, signifying the
existence of a fire, when the same does not actually
exist."
Section 15. There is hereby added a new Section numbered
10.05.150 to the City of Yakima Municipal Code to follow Section
10.05.140, which new Section 10.05.150 s read as follows:

" 10.05.150 SEPARATE OFFENSES. Any person, owner,
tenant or occupant who shall violate or fail to com-
ply with any of the provisions of this chapter or
orders or notices lawfully issued thereunder shall
be guilty of a misdemeanor, and upon conviction shall
be punished by a fine in any sum not to exceed Five
Hundred Dollars ($500) or by imprisonment in the

in the City Jail for any term not to exceed six (6) months,
or by both such fine and imprisonment. The failure of a ,
building to comply with any provisions of this Chapter shall
be deemed a violation on the part of both the owner and
occupant. Every person convicted of a violation of any of
the provisions of this chapter shall be deemed guilty of a
separate offense for every day such violation, disobedience,
neglect or refusal shall continue and shall be subject to the
penalty of this section for each and every separate offense."
I I' Section 16. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
