AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain pronerty situated on the east side of South 38th Avenue, north of Webster Avenue, in the City of Yakima, Washington, from B-2, Local Business Zone, to R-3, Multiple Family Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of July, 1968, upon the recommendation of the Planning Commission that real property situated on the east side of South 38th Airehile north of Webster Ave- nue, within the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from B-2, Local Business Zone, to R-3, Multiple Family Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commisgion for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do. not onpose the change in classifi- • cation; that the needs of the City and community do require such change and that the highest and best use of said property is for multiple family purposes, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated on the east side of South 38th Avenue, north of Webster Avenue, in the City of Yakima, Washington, and more particularly described as follows, to-wit: The west 300 feet of the south 200 feet of the following des- cribed property: the west half of the northeast quarter of the northwest quarter of the northeast quarter of Section 27, Township 13 North, Range 18, E.W.M., EXCEPT the south 125 410 feet of the north 155 feet of the east 125 feet of the west 150 feet and EXCEPT the north 30 feet and the west 25 feet for road, Situated in the County of Yakima, State of Washington; be rezoned from B-2, Local Business Zone, to R-3, Multiple Family Zone, be, and the same is hereby, approved and said real property is hereby rezoned, to R-3, Multiple Family Zone. � s Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this Ordinance. Section 4. This Ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
