ORDINANCE NO. 807
AN ORDINANCE relating to fire prevention; amending Section 10.05.010
of the City of Yakima Municipal Code, adopting by
reference the Fire Prevention Code, 1965 Edition, and
the "October, 1966, Revision of the Fire Prevention
Code, 1965 Edition," both of the American Insurance
Association; adopting by reference the National Fire
Codes, 1968 -1969 Edition, of the National Fire Protec-
tion Association; amending Sections 10.054020, .050,
.070, .080, .090, .120, .140 and adding net Section
10.05.145,'A11 of the City of Yakima Municipal Code.
WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within
the State of Washington to pass ordinances adopting by reference,
compilations and codes, and
WHEREAS, the City Council of the City of Yakima has heretofore
examined and understands the scope and purpose of the regulations of
the Fire Prevention Code, 1965 Edition, of the American Insurance
Association, together with the October, 1966, Revision thereof, and
Volumes 1 through 10 of the National Fire Codes, 1968 -1969 Edition
of the National Fire Protection Association, and deems it in the best
interests of the City of Yakima that such codes be adopted as the
law of the City of Yakima, and
WHEREAS, three copies of all such codes have heretofore been
filed in the office of the City Clerk of the City of Yakima for use
and examination by the public, as required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 10.05.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.010 Adoption of Codes. The Fire Prevention Code,
1965 Edition, of the American Insurance Association, including
Appendix A, 'Protection of Tanks .Corttitning Flammable or Com-
bustible Liquid in Locations That May Be Flooded' and Appendix
B, 'Abandonment or Removal of Underground Tanks,' and the
• ' October, 1966, Revision of the Fire Prevention Code, 1965
Edition' of the American Insurance Association, together with
the following numbered and'entitled volumes of the National
Fire Codes, 1968 -69 Edition, of the National Fire Protection
Association, to -wit:
Volume 1, 'Flammable Liquids';
Volume 2, 'Gases';
Volume 3, 'Combustible Solids, Dusts and Explosives'
(except NFPA 4940;
Volume 4, 'Building Construction & Facilities,' (includ-
ing Standards 78, 82 ((Part 1 -- Section 1.12
only)), 82A, 102, 204 and 213 only);
Volume 5, 'Electrical,' (including Standards 75, 76, 79
and 496-only);
Volume 6, 'Sprinklers, Fire Pumps and Water Tanks';
Volume 7, 'Alarm and Special. Extinguishing Systems';
Volume 8, 'Portable, Manual Fire Control Equipment';
Volume 9, 'Occupancy Standards and Process Hazards';
• Volume 10, 'Transportation';
of which not less than three copies each have been and now are
on file in the office of the City Clerk of the City of Yakima,
are hereby adopted and incorporated as fully as if set out in
full herein, as the Fire Prevention Code of the City of Yakima,
except as hereinafter amended, and the provisions and regula-
tions thereof are hereby adopted as the provisions, and regula-
tions of the City of Yakima; and the several sections or numbers
therein shall constitute, and may be referred to as, the numbers
of this Chapter."
Section 2. Section 10.05.020 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.020 Deletions from Fire Prevention Code. Article
13, 'Fireworks,' Article 24, 'Oil Burning Equipment,' and
Article 26, 'Ovens and Furnaces' are hereby deleted in their
entirety from the Fire Prevention Code of the American Insurance
Association adopted by this Chapter."
• Section 3. Section 10.05.050 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.050 Regulation of Alarm Gongs and Chimes. Every
building in the City of Yakima used as a school, church school,
hospital, nursing home, rest home, nursery, sanitarium, orphan-
age, old people's home, children's home, hotel, apartment house
of more than one story with four or more families doing their
own cooking and living independently of each other in said build -
ing, shall have a manually operated fire alarm system capable of
being heard distinctly throughout the building. Such alarm
system shall be operated from alternating current, electrically,
and shall be provided with a manually operated switch and gong
so that they are accessible within 100 feet of any given point
on any floor level.
Every alarm system shall be installed in compliance with
the Electrical Code of the City of Yakima, Washington, and the
State of Washington.
An automatic alarm system meeting NFPA Standard -72A
requirements shall be accepted in lieu of a minimum manually -
operated fire alarm system.
The person in charge of any building where a fire alarm
system is required shall test the system at least once every two
weeks to ascertain whether or not the system is in working order,
and shall immediately correct any defect that might be found.
It shall be the duty of any employee in a building to see
that the fire alarm system is operated immediately after the
discovery of fire in the building.

In all buildings where a continuously ringing fire alarm
system is required, an electrically operated chime system may
be substituted if such chime system is approved for the purpose
by the Fire Marshal."
Section 4. Section 10.05.070 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.070 Establishment of Limits in Which Storage of
Explosives and Blasting Agents is to be Prohibited:
The limits referred to in Section 12.5b of the Fire Pre-
vention Code in which storage of explosives and blasting agents
is prohibited, are hereby established as follows: Within the
City Limits of Yakima, Washington."
Section 5. Section 10.05.080 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.080 Establishment of Limits in Which Storage of
Flammable Liquids in Outside Above Ground Tanks is to be
Prohibited: The limits referred to in Section 16.22a of the
Fire Prevention Code in which bulk plant storage of flammable
liquids in outside above ground tanks is prohibited, are hereby
established as follows: First fire zone and third fire zone.
The limits referred to in Section 16.51 of the Fire Preven-
tion Code in which new bulk plants for flammable or combustible
liquids are prohibited, are hereby established as follows:
First fire zone and third fire zone."
Section 6. Section 10.05.090 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.090 Establishment of Limits in which Bulk Plant
Storage of Liquefied Petroleum Gases is to be Restricted:
The limits referred to in Section 21.6 of the Fire Prevention
Code, in which bulk storage of liquefied petroleum gas is res-
tricted, are hereby established as follows: First fire zone
and third fire zone."
Section 7. Section 10.05.120 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.120 Wooden Box, Tote Bin and Pallet Storage:
1. All empty wood boxes, tote bins and pallets, when
• piled north, northwest or northeast or west of a frame
building or frame platform, shall be not less than
fifty feet therefrom and such piles shall not exceed
twenty feet in width, fifty feet in length, twelve
feet to the eaves, and eighteen feet to the gable
thereof.
2. All empty wood boxes, tote bins and pallets when piled
to the south, southwest, southeast or east of a frame
building, or frame platform, shall be not less than
thirty feet therefrom and such piles shall not exceed
twenty -five feet in width, fifty feet in length,
fourteen feet to the eaves, and twenty feet to the
gable thereof.

3. All empty wood boxes, tote bins and pallets, when
piled to the north, northwest or northeast or west of
a brick, tile, stone or concrete building, shall be
not less than thirty feet therefrom and such piles
shall not exceed twenty -five feet in width, sixty
feet in length, sixteen feet to the eaves, and twenty
feet to the gable thereof.
4. All empty wood boxes, tote bins and pallets, when
• piled to the south, southwest, southeast or east of
a brick, tile, stone or concrete building, shall be
not less than twenty feet therefrom and such piles
shall not exceed thirty feet in width, sixty feet in
length, sixteen feet to the eaves and twenty -four
feet to the gable thereof,.
5. All empty tote bins or pallets may be piled flat on
the top of the pile without a gable. The pile shall
not exceed thirty -five feet in width, sixty feet in .
length, and twenty -five feet in height.
6. The length, height and width of any specific box,
tote bin or pallet pile may be increased upon written
approval of the Fire Marshal.
7. All piles of empty wood boxes, tote bins, and pallets
shall be so arranged that alleys of not less than
twelve feet shall surround each pile and the ground
around said piles shall be kept free of weeds to a
distance of at least six feet from said piles."
• Section 8. Section 10.05.140 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"10.05.140 Injuring or tampering with fire alarm apparatus
or equipment -- Sounding false alarm of fire. Any person who
willfully and without cause tampers with, molests, injures or
breaks any public or private fire alarm apparatus, emergency
phone, radio, or other wire or signal, or any fire fighting
equipment, or who willfully and without having reasonable
grounds for believing a fire exists, sends, gives, transmits,
or sounds any false alarm of fire, by shouting in a public
place or by means of any public or private fire alarm system
or signal, or by telephone, is guilty of a misdemeanor. This
provision shall not prohibit the testing of fire alarm systems
by persons authoriized to do so, by a fire department or state
fire marshal official."

Section 9. There is hereby added a new section numbered
10.05.145 to the City of Yakima Municipal Code, which new section
shall read as follows:
"10.05.145 Removal of Debris After Fire.
(a) Any person having under his control or in his
possession upon any premises in the City of Yakima any
substances or debris which have been rendered useless or
unmerchantable by reason of any fire on such premises must
remove the same within forty-eight hours after notice to
do so has been given by the Fire Marshal to such person.
(b) Whenever any building or other structure in the
City of Yakima is partially burned, the owner thereof, or
the person in charge or control thereof, shall within ten
days after notice from the Fire Marshal or Building Inspec-
tor of the City of Yakima, remove all refuse, debris, and
partially burned lumber from the premises; and if said
building or structure shall be burned to such an extent
that it cannot be repaired, as provided by this code or
the Building Code, the owner of the property upon which
it is located, or the occupant thereof, shall within ten
days after notice from the Fire Marshal or Building Inspec-
tor, remove all the remaining portion of the building or
structure from the premises."
Section 10. This Ordinance shall be in full force and effect
III thirty days after its passage, approval and publication as provided
by law and by the City Charter.
PASSED THE CITY COUNCIL, signed and approved this 3rd day of
March, 1969.
