AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property on the north side of Summitview
between Hall Avenue and Ilth Avenue, in the City of
Yakima, Washington, from R-3, Multiple Family Zone, to
B-I, Modified Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council of

the City of Yakima held a hearing on the1/5 P day of April, 1966, upon
the recommendation of the Planning Commission that property on the
north side of Summitview between Hall Avenue and Ilth Avenue, in the
City of Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-3, Multiple Family Zone, to B
Modified Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the rea-
sons that such rezoning is in accord with good planning and with the
Comprehensive Plan of the City of Yakima; that the majority of proper-
ty owners in the vicinity do not oppose the change in classification;
that the needs of the City and community do require such change and
III that the highest and best use of said property is for modified business
purposes, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the recommendation of the Planning Commission of
the City of Yakima that the following described property on the north
side of Summitview between Hall Avenue and Ilth Avenue in the City of
Yakima, Washington, and more particularly described as follows, to-wit:
That part of Lot II, Cottage Hill Addition to North
Yakima (now Yakima) according to the official plat
thereof recorded in Volume "A" of Plats, page 80,
records of Yakima County, Washington, described as
follows: Beginning at a point on the East line of Hall
Avenue, and 189.8 feet South of the center line of Browne
Avenue; thence running East and parallel with the center line
of said Browne Avenue a distance of 124 feet; thence South
• 6.6 feet; thence East and parallel with the center line of
Browne Avenue a distance of 86.6 feet; thence South 123.2
feet to the North line of Summitview Avenue; thence West
along the North line of Summitview Avenue a distance of
210.6 feet to the East line of Hall Avenue; thence North
along the East line of Hall Avenue a distance of 129.8
feet to the true point of beginning;
be rezoned from R-3, Multiple Family Zone, to B-I, Modified Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned, B-I, Modified Business Zone.
Section 2. The above change in zoning shall be included and de-
picted on the next regularly amended Use District Map prepared by and
for the City.
Section 3. The City Clerk is hereby authorized and directed to
40 file with the Yakima County Auditor a certified copy of this Ordinance.
Section 4. This Ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 25th day of
April, 1966.
