HomeMy WebLinkAbout1966-816 ORDINANCE NO. g/c AN ORDINANCE providing for the vacation of a portion of West Walnut Street in the City of Yakima, Washington. WHEREAS, a petition has been filed with the City Council of the City of Yakima requesting the vacation of a portion of West Walnut Street, and 110 WHEREAS, upon due notice being given, a hearing was duly held on said petition on June 20, 1966, and continued to July 5, 1966; and as a result of said hearing the City Council deems it to be in the best interests of the City that a portion of West Walnut Street be vacated as provided hereinbelow, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following described street in the City of Yakima, Washington, to-wit: That part of West Walnut Street lying between the east right of way line of South 44th Avenue and the west right of way line of Chisholm Trail, except that part of the existing right of way which lies within the following described circle: A circle whose radius is 40 feet and whose center is located 29 feet south and 10 feet east of • the Southeast corner of Lot 1, Bel Air Home Sites, accord- ing to the plat thereof recorded in Volume L of Plats, Page 48, records of Yakima County, Washington. be, and the same is, hereby vacated. Section 2. The City of Yakima hereby reserves all necessary easements and rights-of-way for the instal lation and maintenance of any and all water mains, sewers or utilities of any and all kinds which may now exist in said street or which it may hereafter desire to con- struct therein, together with an easement for a pedestrian walk-way on the vacated portion of Walnut Street from Bel Air Drive to 44th Avenue, and no building shall be constructed on any portion of said vacated street without the prior approval of the City. Section 3. This Ordinance shall be in full force and effect 30 1 11/days after its final passage, approval and publication as provided by law and by the City Charter.
