AN ORDINANCE proposing to the voters of the City of Yakima that the
City lease and operate a public bus transportation system
and retain National City Management Company as transpor-
tation consultant; specifying and adopting the system or
plan proposed and declaring the estimated capital cost
thereof; levying and providing for the collection of a
housing unit transit subsidy tax and declaring it to be
a misdemeanor to refuse to pay said tax; calling a
special election to submit a proposition to the voters
of the City of Yakima for their ratification or rejection
of this ordinance,
WHEREAS, National City Management Company has proposed that the
City of Yakima lease from National City Management Company all buses,
equipment and facilities necessary to operate a public bus transporta-
tion system within and, insofar as allowed by law, without the City of
Yakima, and retain National City Management Company as transportation
consultant, all according to the Lease Agreement attached hereto; and
WHEREAS, no local public bus transportation system presently
serves the people of the City of Yakima, and the City Council deems it
in the best interests of the people of the City that a municipally
• leased and operated public bus transportation system be organized to
so serve the people of the City, all as proposed by National City
Management Company, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section I. That the City of Yakima is hereby authorized to lease
from National City Management Company and operate a public bus trans-
portation system within and, insofar as allowed by law, without the
City of Yakima, and to retain National City Management Company to
provide transportation consulting services to the City, all according
to the terms of the Lease Agreement attached hereto and by this refer-
ence made a part hereof, which Lease Agreement contains the system or
plan hereby proposed and adopted for furnishing such public bus trans-
portation service, and which Lease Agreement the City Manager and City
Clerk of the City of Yakima are hereby authorized and directed to
execute.
Section 2. It is estimated that no capital cost will be incurred
by the City for acquiring, purchasing or constructing any property as
an incident to the leasing and operating of the public bus.transporta-
tion system proposed by this ordinance.
Section 3. Pursuant to Chapter 35.95 of the Revised Code of
Washington, commencing October 3, 1966, a housing unit transit subsidy
tax in the amount of $ ,‘5"each month for each housing unit, is hereby
levied against, and shall be collected from, all persons within the
City of Yakima who are served by and billed for any one or more public
411 utility services owned and operated by the City of Yakima. The term
"housing unit" as used herein means any building or portion thereof
designed for or used as the residence or living quarters of one or
more persons living together, or of one family. A billing for the tax
hereby levied shall be rendered by the Utility Accounting Division of
the City of Yakima at the same time as each service billing is render-
ed for any public utility service owned and operated by the City, and
the billing for the tax shall be included as an item on each such
service billing. Payment of such tax shall be made at the time pay-
ment is made for any such public utility service. The proceeds from
such housing unit transit subsidy tax shall be used only for the
operation, maintenance and capital needs, if any, of the public bus
III transportation system proposed by this ordinance.
It shall be unlawful for any person served by and billed for any
• one or more public utility servicesowned and operated by the City of
Yakima to refuse to pay the housing unit transit subsidy tax as re-
quired herein. Any such person who violates the provisions of this
section shall be deemed guilty of a misdemeanor, and, upon conviction
thereof, shall be punished by a fine in any amount not to exceed $300
or by imprisonment in the City Jail for a term not to exceed 90 days,
or by both such fine and imprisonment.
Section 4. A special election shall be held in the City of
Yakima on the 20th day of September, 1966, in accordance with all
applicable laws, for the purpose of submitting this ordinance to the
voters of the City of Yakima for their ratification or rejection by
means of a ballot title and proposition which shall read as follows:

Shall Ordinance No. f2J of the City of Yakima, passed
August I, 1966, be ratified; and shall the City of Yakima

lease and operate a public bus transportation system and
retain National City Management Company as transportation
consultant; and shall a housing uuit transit subsidy tax
be levied and collected by the City, and criminal punish-
ment be imposed on conviction of refusol to pay said tax;
all pursuant to said Ordinance No. JT./ .

Section 5. The Clerk of the Council .is hereby directed to notify
the County Auditor of Yakima County, Washington of the passage of this
ordinance, and to do all other things necessary in the time and manner
required by law to the end that the proposition set out hereinabove
shall be submitted to the voters of the City of Yakima, Washington, as
aforesaid.
Section 6. If the proposition above set forth should be adopted
and approved at said election, as by law provided, the City of Yakima
• shall proceed to lease and operate a public bus transportation system,
and retain National City Management Company as transportation consult-
ant, in accordance with the plan or system as herein set forth, and
III shall have authority to use or borrow any monies or funds legally
available therefor as by law and this ordinance authorized.
Section 7. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
