AN ORDINANCE providing for the improvement of certain Property by
grading, ballasting, surfacino with ,asphaltic concrete,
constructing concrete curbs and gutters, together with
neceSsary drainage features; establishing a Local improve-
ment District, providing for the method of payment thereof,
and rreating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section t. That the following streets shaft be improved by grading,
ballasting, surfacing with asphaltic concrete, constructing concrete
curbs and clutters, together with necessary drainage features:
Worth 56th Avenue from 1. co Avenue to Englewood Avenue.
North 58th Avenue from EngiPwood Avenue to the Teton Irri
gation District Canal.
Lis AvenP. from Folsom Avenue to Lincoln Avenue-
Garrett Street from i5th Avenue to 9th Avenue.
Scenic Drive from Fechter Road to ot Drive.
Falioue Drive from Fechter Road to Scenic Drive.

• Section :°?- There is hereby created a Local improvement District,
• to called 'Local improvement District 1o which said district
shall Include ail of the propet ,Fidjacent to the above mentioned improve-
ments which are smbject to assessments, said property being described above.
Section 4- The asseSsments shsil bo i'lade according to special benefits
derived from the. Improvements withou*: regard co the zone and termini method.
Section 5, Ail cOsts and expenes In connection with the construe-
. tion of :said improvements, including the cost and expense of engineeringf
in$pection, advartisinc: pUblAcation of notices, and all other expenses
incident thereto, shall be 1 evied and assessed upon aii of the property

embraced within said Local 1Mprovement District, in the manner and as
provided by the Laws of the State of Washington and the ordinances of
41 / the City of Yakima, and said City shall not be liable in any manner for
any portion of said costs and expenses of said improvemeht.
Section 6. All of the aforesaid ;:onstruction work shall be in
accordance with the plans and specificaions, profiles, maps and de-
tailed drawings which have been preparei'; by the City Engineer, filed
with the City Clerk, and which are hereky approved and adopted.
Section 7. All of the work necess,lry to be done in connection
with the making of said improvement shall be done and made by contract
upon competitive bids, and the City shall have the power to reject any •
and all bids.
Section8. There is hereby created special fund, to be called
, I
• "Local Improvewnt Fund, District No..147", into which slal 1 be placed
all sums paid on account of the aforesaid qoecial assessments, including
al intereFt and penalties thereon, and in the event of the sale of
local iworovement bonds by the City, all proAllium and interest on said
bond issued for said improvement.
Bonds bearing interest at the rate of 5 pur annum,
%frayable on or before 12 years from the date al', issuance, shall be issued
in payment of the costs and expense of said improvement, which bonds
shall be redeemed by the collection of special assessments to be lev;ed
and assessed upon. the property within said district, paqable jn ten eclixil
annual installments with interest at the rate o'F 5 per annum, interest
payable annually under the mode of payment "payment by bonds", as defined
411 by the statutes of the State of Washington and the ordinances of the City
of Yakima; provided that this improvement may be financed by the issuance
of promissory notes, under the authority of R.C.W. 35.45.150.
Section 10. This ordinance is one relating to local improvements
• or assessments therefor, and shal I become effective immediately upon
its passage, approval and publication as provided by law and by the
City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 12th day of
September, 1966.
