AN ORDINANCE relating to Local Improvement Districts and amending
Ordinance No. 831, passed September 12, 1966, entitled
"AN ORDINANCE providing for the improvement of certain
property by grading, ballasting, surfacing with asphaltic
concrete, constructing concrete curbs and gutters, to-
gether with necessary drainage features; establishing a
Local Improvement District, providing for the method of
payment thereof, and creating a special fund".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That Section I of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
"Section 1. That the following streets shall be im-
proved by grading, ballasting, surfacing with asphaltic
concrete, constructing concrete curbs and gutters, together
with necessary drainage features:
North •56th Avenue from Lincoln Avenue to Englewood
Avenue.
North 58th Avenue from Englewood Avenue to the Tieton
Irrigation District Canal.
Lewis Avenue from Folsom Avenue to Lincoln Avenue.
Garrett Street from 15th Avenue to Ilth Avenue.
Scenic Drive from Fechter Road to Fellows Drive.
Fellows Drive from Fechter Road to Scenic Drive.
Donald Drive."
Section 2. That Section 2 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
"Section 2. That the following alley shall be improved
by grading, ballasting and surfacing with asphaltic concrete
and by constructing necessary drainage features:
Block 26, Town of North Yakima, now Yakima, Wash-
ington, according to the plat thereof recorded in
Volume A of Plats, Page 10, records of Yakima
County, Washington.
Section 3. That Section 3 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
"Section 3 (a).. There is hereby created a Local Im-
provement District, to be called "Local Improvement Dis-
trict No. 960", which said district shall include all of
the property subject to assessments adjacent to the above-
mentioned improvements, except North 56th Avenue from Lin-
coln Avenue to Englewood Avenue.
(b). There is hereby created a Local Improvement
District,. to be called "Local Improvement District No 960-1",
which said district shall include all of the property sub-
ject to assessments adjacent to North 56th Avenue from
Lincoln Avenue to Englewood Avenue".
Section 4. That Section 5 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
111 "Section 5. All costs and expenses in connection with
the construction of said improvements, including the cost
and expense of engineering, inspection, advertising, publi-
cation of notices, and all other expenses incident thereto,
shall be levied and assessed upon all of the property em-
braced within said Local Improvement Districts, in the
manner and as provided by the Laws of the State of Washing-
ton and the ordinances of the City of Yakima, and said City
shall not be liable in any manner for any portion of said
costs and expenses of said improvements."
Section 5. That Section 7 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
411 "Section 7. All of the work necessary to be done in
connection with the making of said improvements shall be
done and made by contract upon competitive bids, and the
City shall have the power to reject any and all bids."
Section 6. That Section 8 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
"Section 8 (a). There is hereby created a special fund,
to be called "Local Improvement Fund, District No. 960",
into which shal 1 be placed all sums paid on account of the
aforesaid special assessments, except the assessments for
North 56th Avenue from Lincoln Avenue to Englewood Avenue,
including all interest and penalties thereon, and in the
event of the sale of local improvement bonds by the City,
all premium and interest on said bonds issued for said
improvement.
(b). There is hereby created a special fund, to be,
called "Local Improvement Fund, District No. 960-1", into

which shall be placed all sums paid on account of the
special assessments for the improvement of North 56th
Avenue from Lincoln Avenue to Englewood Avenue, including
all interest and penalties thereon, and in the event of the
sale of local improvement bonds by the City, all premium and
interest on said bonds issued for said improvement."
Section 7. That Section 9 of Ordinance No. 831, passed September
12, 1966, is hereby amended to read as follows:
"Section 9. Bonds bearing interest at the rate of 51,
per annum, payable on or before 12 years from the date of
issuance, shall be issued in payment of the costs and ex-
pense of improvements included in Local Improvement District
No. 960, which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the pro-
perty within said district, payable in ten equal annual in-
stallments with interest at the rate of 51, per annum, inter-
est payable annually under the mode of payment "payment by
bonds", as defined by the statutes of the State of Washington
and the ordinances of the City of Yakima; provided that, this
improvement may be financed by the issuance of promissory
notes, under the authority of R.C.W. 35.45.150.
(b). Bonds bearing interest at the rate of 4% per annum,
payable on or before 12 years from the date of issuance, shall
be issued in payment of the costs and expense of improvements
included in Local Improvement District No. 960-1, which bonds
shall •be redeemed by the collection of special assessments to
be levied and assessed upon the property within said district,
payable in ten equal annual installments with interest at the
, rate of 41. per annum, interest payable annual ly under the mode
of payment "payment by bonds", as defined by the statutes of
the State of Washington and the ordinances of the City of
Yakima; provided that, this improvement may be financed by
the issuance of promissory notes, under the authority of
R.C.W. 35.45.150."

Section 8. This ordinance is one relating to local improvements
or assessments therefor, and shall become effective immediately upon
its passage, approval and publication as provided by law and by the
City Charter.
