HomeMy WebLinkAbout1966-859 ORDINANCE NO. 577 AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property. WHEREAS, proceedings have been held in accordance with Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Com- mission of the City of Yakima, a hearing was held pursuant to legal notice, upon the zoning and land use classification of said property hereinafter described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and made recommendations as to the zoning for said property, and WHEREAS, said proposed area to be annexed to the City of Yakima is more than 10 acres in area, and WHEREAS, the City Council has heretofore determined that it • would approve the proposed annexation and that it would require the property owners of such area to assume the existing indebtedness of the City of Yakima, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, a review board comprised of the Mayor of the City of Yakima, the Chairman of the Board of Yakima County Commissioners, the Chairman of the School Board of Yakima School District No. 7, the Representa- tive of the State Department of Commerce and Economic Development, and a Resident and Property Owner of the area proposed to be annexed, met and considered all of the factors set forth in said Chapter 282, Laws of 1961, and at the conclusion of said meeting made and entered their unanimous findings and determinations with respect to such annexation • and recommended to the City Council of the City of Yakima that said proposed area be annexed to the City of Yakima, and WHEREAS, pursuant to due and legal notice as provided by law and by the City Charter, a public hearing was held upon said petition for annexation before the City Council of the City of Yakima on December 19, 1966, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as hereinafter set forth for the reasons that such zoning and classification is in accord with good planning and with the Comprehensive Plan of the City of Yakima, that the majority of the pro- perty owners in the vicinity do not oppose the classification or the annexation, that the needs of the City and community do require the hereinafter set forth zoning classifications, and that the highest and best use for said property is as hereinafter determined, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property contiguous to the City of Yakima, Washington, to-wit: Beginning at the intersection of the centerlines of South 32nd Avenue and West Nob Hill Boulevard; thence west, along the centerline of West Nob Hill Boulevard, to the centerline of South 38th Avenue; thence south, along the centerline of South 38th Avenue, to the south line of Lot 10 of the Paddack Garden Lots, according to plat thereof recorded in Volume "A" of plats, page 56, records of Yakima County, Washington; thence east, along the south line of Lot 10 of said Paddack Garden Lots, to the east line of said Lot 10; thence north, along the east line of Lot 10 of said Paddack Garden Lots, • to the north line of said Lot 10; thence east, along the south lines of Lots 8 and 1 of said Paddack Garden Lots, to the centerline of South 32nd Avenue; thence north, along the centerline of South 32nd Avenue, to the point of beginning; is hereby annexed to the City of Yakima, Washington. Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtednesses of the City of Yakima. Section 3. The hereinbefore described real property annexed to the City of Yakima is hereby zoned as follows: (a) The following described property is hereby zoned as B-2, Local Business Zone: Beginning at the intersection of the centerlines of South 32nd Avenue and Nob Hill Boulevard; thence, westerly along the centerl ine of Nob Hill Boulevard to the centerline of South 38th Avenue; thence southerly 225 feet along the centerline of South 38th Avenue; thence easterly and parallel to the centerline of Nob Hill Boulevard to the centerline of South 32nd Avenue; thence northerly along the centerline of South 32nd Avenue a distance of 225 feet to the point of beginning. (b) That all of the property hereby annexed to the City of Yakima as described in Section I hereof is hereby zoned as R -2- One-Family Zone, except for that portion thereof zoned B-2, Local Business Zone, as described and provided in Section 3 (a) hereof. Section 4. That the next regularly amended Use District Map pre- pared by and for the City of Yakima shall show said property as here- inbefore zoned and classified. Section 5. The City Clerk is hereby authorized and directed to fi le a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Washington.. Section 6 . This ordinance s h a l l be i n f u l l force and effect 30 days after its final passage, approval and publ ication as provided by law and by the City Charter.
