HomeMy WebLinkAbout1967-869 ORDINANCE NO. AN ORDINANCE annexing property to the City of Yakima, and zoning said property. WHEREAS, proceedings have been held in accordance with all appli- cable laws for the annexation to the City of Yakima of the property hereinafter described, and WHEREAS, the Planning Commission of the City of Yakima duly held a public hearing on the zoning of said property hereinafter described and annexed and, as a result of said hearing, duly recommended that said property be annexed to the City of Yakima and zoned as hereinafter specified, and WHEREAS, a hearing was duly held on such annexation by a Review Board as required by law and as a result of such hearing the Review Board made and entered its findings and recommendations with respect to such annexation and recommended to the City Council that the said property be annexed to the City of Yakima, and • WHEREAS, pursuant to due and legal notice, the City Council held a public hearing on said annexation on the 16th day of January 1967 ; and, as a result thereof, finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as hereinafter set forth for the reasons that such zoning and classification is in accord with good planning and with the General ix� Plan of the City of Yakima, that the majority of the property owners in the vicinity do not oppose.the classification or the annexation, that the needs of the City and community do require the hereinafter set forth zoning classification, and that the highest and best use for said property is as hereinafter determined, now, *therefore, • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section I. The following described property contiguous to the City of Yakima is hereby annexed to the City of Yakima, Washington: Beginning at the intersection of the centerlines of Summitview Avenue and North 56th Avenue; thence west, along the centerline of Summitview Avenue, to a line parallel to and 165 feet east of the west line of Lot 9 of Huxtable Model Orchards according to plat thereof recorded in Volume "E" of plats, page 41, re- cords of Yakima County, Washington; thence north and parallel to the west line of Lot 9 of said Huxtable Model Orchards, to the north line of said Lot 9; thence east, along the north line of Lot 9 of said Huxtable Model Orchards, to the east line of said Lot 9; thence south, along the east line of Lot 110 9 of said Huxtable Model Orchards,. 20 feet; thence east, parallel to the north line of Lot 8 of said Huxtable Model Orchards, to the east line of said Lot 8; thence south, along the east line of Lot 8 of said Huxtable Model Orchards, to the centerline of the Yakima Valley Canal Company right of way; thence in a northerly direction, along the centerline of the Yakima Valley Canal Company right of way, to the south line of Valley Vale Addition according to plat thereof record- ed in Volume "P" of plats, page 25, records of Yakima County, Washington; thence east, along the south line of said Valley Vale Addition, to the centerline of North 56th Avenue; thence north, along the centerline of North 56th Avenue, to the centerline of the Yakima Valley Canal Company right of way; thence in a southerly direction, along the Yakima Valley Canal Company right of way, to the extended west lines of Lots 16 and 17 of Carolyn Addition according to plat thereof recorded in Volume "U" of Plats, page 36, records of Yakima County, Washington; thence north, along the extended west lines of Lots 16 and 17 of said Carolyn Addition, to the extended south line of Lot 4 of said Carolyn Addition; thence west, along the south line of Lot 4 of said Carolyn Addition, to the west line of said Carolyn Addition; thence north, along the west line of said Carolyn Addition, to the centerline of West Lincoln Avenue; thence east, abng the centerline of West Lincoln Avenue, to the west line of North 58th Avenue as platted in 57th Avenue Addition according to plat thereof re- corded in Volume "T" of Plats, page 37, records of Yakima County, Washington; thence north, along the west line of said 58th Avenue, to the extended south line of Lot 4 of said 57th Avenue Addition; thence east, along the south lines of Lots 4 and 5 of said 57th Avenue Addition, to the east line of said Lot 5; thence north, along the east line of Lot 5 of said 57th Avenue Addition, to the centerline of Richey Road; thence east, along the centerline of Richey Road, to the centerline of North 57th Avenue; thence north, along the centerline of North 57th Avenue, to the extended north line of Browne's Homesites according to plat thereof recorded in Volume "0". of Plats, page 26, records of Yakima County, Washington; thence cast, along the north line of said Browne's Homesites, to the centerline of North 56th Avenue; thence south along the centerline of North 56th Avenue, to the centerline of West Lincoln Avenue; thence east, along the centerline of West Lincoln Avenue, to a line paral lel with and 1032 feet east from, when measured at right angles to, the west line of the northeast quarter of Section 21, Township 13 North, 411 Range 18, E.W.M.; thence south, parallel with the west line of the northeast quarter of said Section 21, to the center- line of the Yakima Valley Canal Company right of way; thence in an easterly direction along the Yakima Valley Canal Com- pany right of way to the east line of the southwest quarter of the northeast quarter of said Section 21; thence south, along the east line of the southwest quarter of the northeast quarter of said Section 21, to the centerline of Summitview Avenue; thence west, along the centerline of Summitview Ave- nue, to the point of beginning; is hereby annexed to the City of Yakima, Washington. -2- Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtednesses of the City of Yakima. Section 3. The hereinbefore described real property annexed to the City of Yakima is hereby zoned as follows: (a) The following described property is hereby zoned as B -2, Local Business Zone: Beginning at the intersection of the centerlines of Summitview Avenue and North 56th Avenue; thence westerly along the center- line of Summitview Avenue to the centerline of Yakima Valley Canal Company right -of -way; thence in a northeasterly direction along the centerline of the Yakima Valley Canal Company right - of -way to the south line of Valley Vale Addition according to plat thereof recorded in Volume "P" of Plats, page 25, records of Yakima County, Washington; thence easterly along the south line of said Valley Vale Addition to the centerline of North 56th Avenue; thence southerly along the centerline of North 56th Avenue to a point 160 feet north of the centerline of Summitview Avenue; thence easterly and parallel to the center- line of Summitview Avenue a distance of 160 feet; thence southerly and parallel to the centerline of North 56th Avenue a distance of 160 feet to the centerline of Summitview Avenue; thence westerly along the centerline of Summitview Avenue a distance of 160 feet to the point of beginning. (b) The following described property is hereby zoned as R -2, III Two - Family Zone: Beginning at a point on the centerline of North 56th Avenue, 160 feet north of the centerline of Summitview Avenue; thence northerly along the centerline of North 56th Avenue to the intersection of the centerline of North 56th Avenue and the south line extended of Valley Vale Addition according to plat thereof recorded in Volume "P" of Plats, page 25, records of Yakima County, Washington; thence easterly and parallel to the centerline of Summitview Avenue a distance of 540.6 feet; thence southerly and parallel to the centerline of North 56th Avenue a distance of 640.8 feet to the centerline of Summit - view Avenue; thence westerly along the centerline of Summit - view Avenue to a point 160 feet east of the centerline of North 56th Avenue; thence northerly and parallel to the cen- terline of North 56th Avenue a distance of 160 feet; thence westerly and parallel to the centerline of Summitview Avenue a distance of 160 feet to the point of beginning. (c) That all of the property hereby annexed to the City of Yakima as described in Section 1 hereof is hereby zoned as R -I, One- Family • Zone, except for that portion thereof zoned B - 2, Local Business Zone, and R - 2, Two - Family Zone, as described and provided in Section 3 (a) and 3 (b) hereof. Section 4. That the next regularly amended Use District Map pre- pared by and for the City_ of Yakima shall show said property as here - inbefore zoned and classified. -3- Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Wash ington.
