AN ORDINANCE relating to the sale of liquor at retail on licensed.pre-
mises; specifying hours during which liquor may not be
sold; amending Section 5.44.230 of the City of Yakima
Municipal Code; and declaring an emergency.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA.
Section .1. Section 5.44.230 of the City of Yakima Municipal Code
0 is hereby amended to read as follows:
"5.44.230 CLOSING HOURS SUNDAY CLOSING - ELECTION DAYS.
(a) No retail licensee shall sell, deliver, offer for
sale, serve or allow to be consumed upon the _licensed pre -
mises any liquor, nor permit the removal of any liquor from
the licensed premises in any manner whatsoever
(1) Upon the day of any general, special or
primary election of any state, county or
municipal officers within the state, district,
county or municipal corporation in which such
election is held, and before the polls have
closed (except general or special elections
of any diking district, drainage district,
diking and drainage district, irrigation
district or any other district election which
such elections are held on an isolated date
and the ownership of property is a prerequisite
to voting at such electrons);
(2) Between the hours of 2 a.m. and 2 p.m. on
Sunday;
• (3) Between the hours of 10 p.m. on Sunday and
6 a.m. the following Monday; nor
(4) Between the hours of 2 a.m. and 6 a.m. on any
weekday.
(b) Notwithstanding the provisions of Subsections (a) (2),
(a) (3) , and (a) (4) hereof, on December 31 the hour of opening
shall not be earlier than 6 a.m., except on Sunday when it shall
not be earlier than 2 p.m., and the hour of closing next follow-
ing shall not be later than 3 a.m. New Year's Day.`
Section 2. This Ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and welfare
of the people of the City of Yakima, and an emergency is hereby declaree
to exist and this Ordinance shall be in full force and effect immed-
iately upon its passage, approval and publication as provided by law
and by the City Charter.
