AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located southwest of the
intersection of North 16th Avenue and Fruitvale Boulevard,
in the City of Yakima, Washington, from R-3, Multiple
Family Zone, to B-3, General Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council of
• the City of Yakima held a hearing on the 21st day of August, 1967, upon
the of the Planning Commission that real property locat-
ed southwest of the intersection of North 16th Avenue and Fruitvale
Boulevard, within the City of Yakima, Washington, the legal description
of which is set out hereinbelow, be rezoned from R-3, Multiple Family
Zone, to 33-3, General Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the rea-
sons that such rezoning is in accord with good planning and with the
General Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification that
the needs of the City and Community do require such change and that the
• highest and best use of said property is for general business purposes,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property located
southwest of the intersection of North 16th Avenue and Fruitvale Boule-
vard in the City of Yakima, Washington, and more particularly describe6
as follows, to-wit:
Beginning at the southwest corner of the following described
property,
That part of the North 130 feet, less the North 10 feet
for roadway; of Lot 25, of J. H. Hathaway's Five Acre
Tracts, according to the official plat thereof recorded
in Volume of Plats, page 26, records of Yakima County,
Washington, described as follows:
Beginning at the intersection of the south line of Fruit-
• vale Avenue with the East line of 16th Avenue North, as now
existing: thence easterly along said south line of Fruitvale
Avenue a distance of 145.5 feet: thence southerly on a line
parallel with 16th Avenue North, 120 feet' thence westerly
on a line parallel with Fruitvale Avenue, 145.5 feet; thence
northerly along the east line of 16th Avenue Forth 120 feet,
to the point of beginning.
EXCEPT that portion conveyed to the City of Yakima for
street, as disclosed by instrument recorded February 17,
1967, in Volume 687 of Deeds, under auditor's file no.
2118631, records of Yakima County, Washington.
Situated in the County of Yakima, State of Washington;

thence west along the south line extended 30 feet to the true
point of beginning and centerline of North 16th Avenue; thence
west along a line parallel when measured at right angles to
the south line of Lot 13, Lewis-Terry Garden Tracts according
to the plat thereof recorded in Volume of Plats, Page 15,
- records of Yakima County, Washington a distance of 192 feet;
thence north along a line parallel when measured at right
angles to the centerline of North 16th Avenue to the south
boundary line extended of the following described property,
410 The north 130 feet of the east 110 feet of Lot 13, Lewis-
Terry Garden Tracts, according to the plat thereof recorded
in Volume of Plats, page 15, records of said County.
EXCEPT that portion lying north of a line parallel with and
50 feet southerly, measured at right angles from the center
line of Primary State Highway No. 5, conveyed to State of
Washington by instrument recorded under Auditor's file No.
1254778, records of Yakima County;
thence east along the south boundary line and south boundary line
extended of said described property a distance of 192 feet to the
centerline of North 16th Avenue; thence south along the centerline
of North 16th Avenue to the true point of beginning;
be rezoned from R-3, Multiple Family Zone, to B-3, General Business
,Zone, be, and the same is hereby, approved and said real property is
hereby rezoned, to B-3, General Business Zone.
Section 2. The above change in zoning shall be included and de-
picted on the next regularly amended Use District Map prepared by and
• for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this Ordinance.
Section 4. This Ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 21st day of
August, 1967.
