HomeMy WebLinkAbout1967-963 ORDINANCE NO. 96 3 AN ORDINANCE relating to traffic control; prohibiting the operation of a motorcycle or a motor - driven cycle without a valid license; specifying required equipment for motorcycles, motor - driven cycles and their operators; regulating the rental of motorcycles and motor- driven cycles; providing for a penalty for violations; and adding Chapter 9.34 "Motorcycles" as a new Chapter of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. There is hereby added a new chapter to the City of Yakima Municipal Code, which new chapter shall be numbered and entitl- ed Chapter 9.34 "Motorcycles ", and which shall read as follows: CHAPTER 9.34 MOTORCYCLES Sections: 9.34.010 Motorcycle Driver's License 9.34.020 Motorcycle Equipment 9.34.030 Motorcycle Regulations 9.34.040 Penalty Clause 9.34.010 MOTORCYCLE DRIVER'S LICENSE. It shall be unlawful for any person to operate, drive or be in physical • control of a motorcycle, as defined in Section 46.04.330 of the Revised Code of Washington, or a motor- driven cycle, as defined in Section' 46.04.332 of the Revised Code of Washington, on any street, alley or other public way within the City of Yakima without having first obtained, and being the authorized holder of, a valid driver's license specially endorsed by the Director of Motor Vehicles of the State of Washington to enable the holder of such license to drive such vehicle. The licensee shall have such vehicle driver's license in his immediate possession at all times when operat- ing any such vehicle, and shall display it upon demand to any peace officer or to any other person when and if re- quired by law to do so. 9.34.020 MOTORCYCLE EQUIPMENT. (1) HELMETS. It shall be unlawful for a driver of, or a passenger on, a motorcycle or motor- driven cycle to ride thereon on any street, alley or public way without wearing a helmet of a type approved by the Washington State Commission on Equipment which helmet must include a chin strap which must be securely fastened while the vehicle is in motion. (2) WINDSHIELD, GOGGLES AND FACE SHIELDS. It shall be unlawful to operate a motorcycle or motor - driven cycle on any street, alley or other public way in excess of 35 miles per hour unless the vehicle is equipped with a windshield or unless the driver is equipped with goggles or a face shield of a type approved by the Washington State Commission on Equipment. (3) SEATS AND FOOT PEGS FOR PASSENGERS. (a) It shall be unlawful for a passenger to ride on a motorcycle or motor- driven cycle on any street, alley or other public way except on a permanent seat provided for a passenger or on the regular seat if it is designed to accommodate two people. Both the driver and passenger shall be deemed to be in violation of this subsection if the requirement of this subsection is violated. (b) It shall be unlawful for either a driver or passenger of such a vehicle to ride such vehicle on any street, alley or other public way with both feet of either the driver or passenger, or both, on one side of the vehicle, except in a sidecar. (c) It shall be unlawful for the driver of any such vehicle to carry a passenger thereon on any street, alley or other public way unless there is provided on the vehicle foot pegs for the passenger. (4) HANDLEBAR RESTRICTIONS. It shall be unlawful for any person to operate a motorcycle or motor - driven cycle on any street, alley or other public way if the vehicle has handlebars, or grips More than 15 inches higher than the seat of such vehicle. (5) MUFFLERS. (a) It shall be unlawful for any person to operate a motorcycle or motor - driven cycle on any street, alley or other public way if such vehicle is not equipped with a muffler in good working order and in constant operation to prevent extensive or unusual noise; and it shall further be unlawful to so drive such a motor vehicle equipped with a muffler cut -out, by -pass or similar device. (b) It shall be unlawful for any person to operate a motorcycle or motor- driven cycle on any street, alley • or other public way if such vehicle has its exhaust system modified in a manner so as to amplify or increase the noise emitted by the engine of such vehicle above that emitted by the muffler originally installed on the vehicle. (6) MIRRORS. It shall be unlawful for any person to operate a motorcycle or motor- driven cycle on any street, alley or public way if such vehicle is not equipped with a mirror on each side of the handlebars of such vehicle which will provide the driver thereof with a complete view of the roadway for a distance of at least 200 feet to the rear of the vehicle. 9.34.030 MOTORCYCLE RENTALS. (1) It shall be unlaw- ful for any person to rent or loan a motorcycle or motor - driven cycle to any person unless the latter person is then duly licensed as a motorcycle or motor- driven cycle operator in this state or, in the case of a non - resident, then that he is duly licensed as an operator of such a vehicle under the laws of the state or country of his residence, except a non - resident whose home state or country does not require that the operator of such motor vehicle be so licensed. (2) It shall be unlawful for any person to rent a motorcycle or motor - driven cycle to another person unless the bailor of such vehicle has inspected the vehicle operator's license of the bailee and compared and verified his signature thereon with the bailee's signature written in the bailor's presence. (3) It shall be unlawful for any person to rent a motorcycle or motor - driven cycle to another person unless the bailor keeps a record of the vehicle license number of the vehicle so rented, the name and address of the -2- person to whom the vehicle is rented, the number of the vehicle operator's license of the bailee of the vehicle and the date and place when and where such vehicle operator's license was issued. It shall further be un- lawful for any person required to keep such records, or for any person in custody thereof, to refuse inspection of such records by any peace officer or anyone duly acting as an inspector of such records for the Director of Motor Vehicles of the State of Washington. III (4) It shall be unlawful for any person to rent a motorcycle or motor - driven cycle to another unless the bailor of such vehicle also has available for rent helmets of a type approved by the Washington State Commission on Equipment. (5) It shall be unlawful for any person to rent a motorcycle or motor - driven cycle to another unless the bailee thereof has in his possession at the time of rent- ing such vehicle a helmet Of a type approved by the Wash - ington,State Commission on Equipment, regardless from whom the helmet is obtained. 9.34.040 PENALTY FOR VIOLATION. Any person violating any provision of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine in any amount not exceeding $500.00, or by im- prisonment in the City Jail for a period not exceeding 120 days, or by both such fine and imprisonment. Section 2. This ordinance shall be in full force and effect • thirty days after its passage, approval and publication as provided by law and by the City Charter.
