' AN ORDINANCE relating to public services and utilities; specifying the rates of sewer service charges; levying a tax on the com- bined water and sewer department of the City of Yakima; specifying the rates of water service charges; amending Sections 7.60.020, 7.60.050, 7.64.010, 7.68.043, 7.68.250, 7.68.252, 7.68.255 and 7.68.280 of the City of Yakima O Municipal Code; adding Section 7.68.282 as a new section of the City of Yakima Municipal Code; repealing Section 7.68.285 of the City of Yakima Municipal Code; and de- claring an emergency. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Section 7.60.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.020 SEWER SERVICE CHARGE. There is hereby charged to all premises within the city of Yakima served by city domestic water a sewer service charge which is hereby fixed at fifty percent of the water charge for domestic water furnished to the premises; provided, in no event shall . said sewer service charge be less than two dollars per month." Section 2. Section 7.60.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.050 METERS ON WATER DISCHARGED- -SEWER SERVICE CHARGES FOR PREMISES NOT RECEIVING CITY WATER. All premises shall have approved meters on all water supplies which are ultimately discharged into the city sanitary sewer system, or in the alternative shall meter the liquid waste so dis- charged. The amount of sewer service charges for occupied or improved premises which do not receive city domestic water service, or which have auxiliary water supplies, shall be fifty percent of the water service charge for a like quantity of city water, provided in no event shall the sewer service charge be less than two dollars per month." Section 3. Section 7.64.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.64.010 WATER -SEWER TAX RATE. There is hereby levied and there shall be collected from the combined water and sewer department of the City of Yakima a tax at rate of twelve and one -half percent of the total gross revenues of said department; provided, however, that in computing said gross revenues there shall be deducted therefrom, and the tax provided for herein shall not apply to, amounts received by the Water Department for new services and from revenues derived from the construction or extension of water or sewer facilities." Section 4. Section 7.68.043 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.043 SERVICE INSTALLATION CHARGES. Applicants for new water service installations shall pay to the City Treasurer the installation charges as provided below which payment shall be made prior to such installation being commenced: 3/4" service pipe with 5/8" x 3/4" meter . .$130.00 3/4" service pipe with 3/4" x 3/4" meter . . 150.00 1" service pipe with 1" meter 200.00 Additional charge for paved street where main is tapped 25.00 Additional charge where meter set in asphalt S behind curb (if patching is to be done by City) 20.00 Additional charge where meter set in con- crete behind curb (if patching is to be done by City) 10.00 Additional charge where heavy -duty meter cover is required 15.00 Additional charge where meter is set more than 50 feet from center line of street or roadway: 3/4" services, per foot .75 1" services, per foot 1.00 The installation charge for a new water service where a meter larger than one inch in diameter is to be installed shall be an amount adequate to pay all costs of materials and installa- tion as computed by the Director of Public Utilities." Section 5. Section 7.68.250 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.250 WATER SERVICE bHAkGES. The one -month period is defined as any period of time from one day up to and including one month and 14 days, and the two -month period is defined as any period of time from one month and 15 days to two months and 14 days." Section 6. Section 7.68.252 of the City of Yakima Municipal Code thereby amended to read as follows: "7.68.252 IRRIGATION RATE ON DOMESTIC WATER. Domestic • water may be delivered to consumers during the irrigation season at a special irrigation rate under the following conditions: (a) In order to secure said irrigation rate, applica- tion must be made to the utility accounts division by the consumer, who will certify that the domestic water delivered under said rate will be used for irrigation purposes on pro- perty not adequately served by separate irrigation systems. (b) The charge for such water supplied shall be com- puted as follows: An amount . equal to the maximum water meter reading taken during the previous non - irrigation season shall be charged under the regular domestic water rates. All water used on premises inside the city limits in excess of such maximum usage during the previous non - irrigation season shall be charged during the irrigation season at the rate of ten cents per one hundred cubic feet and all water used on premi- ses outside the city limits in excess of such maximum usage during the previous non - irrigation season shall be charged during the irrigation season at the rate of twelve cents per one hundred cubic feet, provided, the rate for domestic water consumed by the State of Washington or any agency thereof, or any municipal corporation, and used exclusively for irri- gation purposes on property owned or occupied by such con - sumers shall be ten cents per one hundred cubic feet, regard- less of whether the property served is situated within or without the corporate limits of the City of Yakima. In com- puting amounts to be charged, the provisions of Section 7.68.030 shall apply. -3- (c) The cash discounts for prompt payment provided for in Section 7.68.267 shall not apply to that portion of the billings made for water delivered under the irrigation rate. (d) For the purpose of this section, the irrigation rate will commence at the regular water meter reading during the months of February or March, as the case may be for any particular consumer; and will terminate at the regular water meter reading during the months of October or November, as 411 the case may be for any particular consumer. In the event an application is made during the irrigation season for the irrigation rate, the irrigation rate will commence at the next regular meter reading after the time of such applica- tion. (e) The sewerage service charge provided for in Chapter 7.60 shall not apply to the indicated consumption of water billed at the irrigation rate. (f) Consumers who have installed domestic water services exclusively for irrigation use will be billed at the irriga- tion rate without regard to dates of commencement or termina- tion of service, subject only to the minimum billings provided for in Section 7.68.255." Section 7. Section 7.68.255 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.255 MINIMUM SERVICE CHARGES. Section 7.68.280 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.280 FIRE SERVICE INSPECTION. The Domestic Water Division or Utility Accounting Division shall inspect all fire service connections with piping, valves and other appurten- ances thereto, and the premises served thereby, at regular • intervals and as often as found necessary. The inspector shall keep a record of all inspections made. Should an inspector find that water is used through a fire service for any purpose other than the extinguishing of fire upon the premises, the owner or occupant will be given notice to discontinue such use. If such use is not discontinued within ten days from such notice being given, water service to the premises shall be discontinued until such time as the owner or occupant complies with the requirement of such notice. No charge will be made for water used in extinguishing fire." Section 9. There is hereby added to the City of Yakima Municipal Code a new section, to be numbered Section 7.68.282, which new section shall read as follows: "7.68.282 FIRE SERVICE CHARGES The monthly charge for each active fire service shall be as follows: Size of Service Inside City Outside City 2" $ 2.00 $ 4.00 3" 3.00 6.00 4" . . including hydrant only. 4.00 8.00 6" . . including hydrant only. 6.00 12.00 8" 9.00 18.00 10" 12.00 24.00 The inside diameter of the pipe leading to a fire hydrant shall determine the service charge. Any fire hydrant installed and maintained by the city outside the city limits will be billed as a fire service, which charge shall be terminated at such time as the responsible consumer's property is annexed to the city." Section 10. Section 7.68.285 of the City of Yakima Municipal Code is hereby repealed in its entirety. • Section 11. (a) The service rates specified in this ordinance shall apply to sewer and water service rendered commencing January 1, 1968. Service rates, as the same are now specified by the various sections of the City of Yakima Municipal Code prior to their amendment by this ordinance, shall be charged and collected for sewer and water service rendered through December 31, 1967, and shall not be affected by this ordinance. -5- (b) The rate of tax levied on the combined water and sewer departments of the City of Yakima by Section 3 of this ordinance (amending Section 7.64.010 of the City of Yakima Municipal Code) shall be effective commencing January 1, 1968, and all taxes levied under the provisions of Section 7.64.010 of the City of Yakima Municipal Code through December 31,_1967, shall be collected based on the rates specified in Section, 7.64.010 prior to its amendment by this ordinance and shall not be affected by the passage of this ordinance. Section 12. This Ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby de- clared to exist and this Ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
