AN ORDINANCE relating to working hours and authorizing overtime pay
and compensatory time for certain employees of the City
of Yakima; adding Section 2.22.040 as a new section, and
amending Section 2.40.100, both of the City of Yakima •
Municipal Code.
• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That a new section, following Section 2.22.030 and
numbered 2.22.040, is hereby added to the City of Yakima Municipal
Code to read as follows:
"2.22.040 OVERTIME PAY AND COMPENSATORY TIME. Overtime
pay and compensatory time for Fire Department employees shall
be governed by the provisions of Section 2.40.100 of this Code."
Section 2. That Section 2.40.100 of the City of Yakima Municipal
Code isr hereby amended to read as follows:
"2.40.100 OVERTIME PAY AND COMPENSATORY TIME.
A. Overtime Pay.
(I) Overtime payment will be allowed for employees
paid on an hourly basis, when required to work, at the rate
• of time and one -half.
(2) Employees paid on a monthly basis will not be
allowed overtime pay except as follows:
(a) When, because of seasonal requirements or
work schedules outside of the control of the City, pro-
fessional or inspectional employees of the Engineering
Division are required to work in excess of eight hours
per day or forty hours per week, overtime pay at the
rate of time and one -half may be allowed upon approval
of the City Manager.
(b) Police Department personnel below the rank
of Captain may be paid overtime at a straight time rate
for holidays or days -off worked, or when specifically
called, when off shift, by the Chief of Police for
special police duty. Pay shall be computed by dividing
each employee's basic monthly salary by 173 to arrive at
an hourly rate. No payment shall be made for fractions
of an hour, and fractions of an hour served on overtime
duty shall be rounded to the next full hour for the pur-
pose of computing the amount of overtime pay.
• (c) Fire Department personnel below the rank
of Battalion Chief may be paid overtime at a straight
time rate when called from off shift in order to maintain
a minimum fire suppression strength as determined by the
Fire Chief. Pay shall be computed by dividing each em-
. ployee's basic monthly salary by 10 to arrive at a 24
hour shift rate.
(d) Employees of the Public Works and Public
Utilities Departments below the level of Department
Director may be paid overtime at a straight time rate
when required to work overtime because of an emergency
determined by the City Manager. Pay shall be computed
by dividing each employee's basic monthly salary by
173 to arrive at an hourly rate. No payment shall be
made for fractions of an hour, and fractions of an
hour served on overtime duty shall be rounded to the
next full hour for the purpose of computing the amount
of overtime pay.
111 B. Compensatory Time.
(1) Employees paid on a monthly basis may be allowed
compensatory time off if assigned specifically to overtime work
by the department director or division head.
(2) Allowable compensatory time worked shall be reported
on the monthly time sheets as prescribed by the Director of Finance.
(3) Compensatory time off must be requested, approved
and reported in the same manner as prescribed for vacation leave."
Section 3. This Ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
