That the following streets shall be improved by grading, _ _ bal!asting, surfacing-with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features: The east ha of South 45th Avenue from Arlington Street c(- to Tieton Drive. The west half of out 44th Aven'Ue from Arlington Street to Tieton Drk The north half of Arlington Street from South 44th Avenue to South 45th Avenue. Webster Avenue from South 44th Avenue to South 45th Avenue. (Tri-Skool Addition) South 4th Avenue from Maple Street to Pine Street. 111 South 39th Avenue from West Chestnut Street to West Walnut Street. Casa Court from South 39th Avenue to 23l feet The north half of Douglas Drive from North 44th Avenue to a point 300 feet east tereof. • North 57th Avenue from 94.5 feet south of Douglas Drive to 39.13 feet north of Richey Road. Knobel Avenue from North 40th Avenue to approximately 380 feet eat South 8th Street om Central Avenue to East Lenox Avenue. High View Drive from North 35th Avenue to Englewood Avenue. The west half of North 35th Avenue from Englewood Avenue to appromately 280 feet south. South 37th Avenue from !45 feet north of Bonnie Doone to 323 feet north of Bonnie Doone. Section 2. That the portions of the following streets not now so improved, shall be improved by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and cutters, together with necessary drainage fattures: 411 Walnut Street fom Chisholm Trait to South 48th Avenue. South 46th Avenue from Tieton Drive to Walnut StrPet. South 38th Avenue From 235 it south of Webster Avenue to Nob Hill Boulevard'. Section 3. That the following alleys shall be improved by grading, ballasting and surfacing with asphaltic concrete, together with necessary drainage features: Ailey between South Ilth Avenue and Holton Avenue from Teton Drive to approxiMately 200 feet northwest. Alley in Block 2, Town of North Yakima, now Yakima. Section There is hereby created a Local improvement District, • to be called "Local improvement District No.,a? „ which said dis- trict shall include all of the property adjacent to the above mentioned improvements which are subject to assessments, said property being described above. Section.5. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method, Secton6 Ai costs and expenses in connection with the con struction of said improvements,. including the cost and expense of engineering, inSpection, advertising, publication of notices, and ali other expenses incident thereto, shall be levied and assessed upon all of the property embraced within said Local Improvement District, in the manner and as provided by the Laws of the State of Washington and the ordinances o the City of Yakima, and sad City shall not be liable in any manner for any portion of said costs and expenses of said im- provement. Section2. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and de- tailed drawings which have been prepared by the City Engineer, filed III , with the City Clerk, and which are hereby approved and adopt qectioD All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract. . ' . upon competitive bids, and the City shall have the power to reject any • and all bids. Section 5; There is hereby created a special fund, to be called "Local Improvement Fund, District No.0 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of. the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Sqption_10 Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from the date of issuance,tihall be issued in payment of the costs and expense of said improvement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in III ten equal annual installments with interest at the rate of 4% per annum, interest payable annually under the mode of payment "payment by bonds", as defined by the statutes of the State of Washington and the Ordinances of the City of Yakima; provided that this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W, 35.45.150. Sectsn_il. This ordinance is one relating to ioosi improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
