AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 2009 to approxi-
mately 2109 Lincoln Avenue, in the City of Yakima, Wash-
ington, from B-2, Local Business Zone, to B-3, General
Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council of the
1111 City of Yakima held a hearing on the 26th day of July, 1965, upon the
recommendation of the Planning Commission that real property located
at 2009 to approximately 2109 Lincoln Avenue, within the City of
Yakima, Washington, the legal description of which is set out herein-
below, be rezoned from B-2, Local Business Zone, to B-3, General
Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the rea-
sons that such rezoning is in accord with good planning and with the
Comprehensive Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification;
410 that the needs of the City and community do require such change and
that the highest and best use of said property is for general business
purposes, now, therefore, 1
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section I. That the recommendation of the Planning Commission of
the City of Yakima that the following described real property located
at 2009 to approximately 2109 Lincoln Avenue, in the City of Yakima,
Washington, and more particularly described as follows, to-wit:
PARCEL A:
Beginning at a point on the South line of the Northwest
quarter of the Northeast quarter of Section 23, Township 13
North, Range 18, E.W.M., 156 feet West of the Southeast
corner of said subdivision; thence continuing West along
said South line, a distance of 174 feet; thence North a dis-
tance of 190 feet; thence East parallel with the South line,
110 a dist ance of 174 feet; thence South 190 feet to the point
of beginning, EXCEPT the West 20 feet and the South 30 feet
for road.
PARCEL B:
The West half of the Southeast quarter of the Northwest quarter
of the Northeast quarter of Section 23, Township 13 North,
Range 18, E.W.M.,
EXCEPT the West 150 feet of the South 140 feet thereof, and
EXCEPT the South 30 feet.
PARCEL C:
The North 206 feet of the South 396 feet of the East half of
the Southeast quarter of the Northwest quarter of the North-
east quarter of Section 23, Township 13 North, Range 18, E.W.M.,
EXCEPT the East 156 feet thereof.
PARCEL D:
The North 50 feet of the South 396 feet of the West 136 feet of
the East 156 feet of the East half of the Southeast quarter of
the Northwest quarter of the Northeast quarter of Section 23,
Township 13 North, Range 18, E.W.M.;
be approved and that said property be rezoned from B -2, Local Business
Zone, to B -3, General Business Zone, be, and the same is hereby, approv
ed and said real property is hereby rezoned, to B -3, General Business
Zone.
Section 2. The above change in zoning shall be included and de-
picted on the next regularly amended Use District Map prepared by and
for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this Ordinance.
Section 4. This Ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 26th day of
July, 1965.
