HomeMy WebLinkAbout1965-693 ORDINANCE NO. 9'J AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property as M -I, Light Industrial Zone. WHEREAS, proceedings have been held in accordance with Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Commis- sion of the City of Yakima, a hearing was held pursuant to legal notice upon the zoning and land use classification of said property hereinafter described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and recommended that said property be zoned M -1, Light Industrial Zone. WHEREAS, said proposed area to be annexed to the City of Yakima is more than 10 acres in area, and WHEREAS, the City Council has heretofore determined that it would approve the proposed annexation and that it would require the • property owners of such area to assume the existing indebtedness of the City of Yakima, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, a majority of the review board comprised of the Mayor of the City of Yakima, the Chairman of the Board of Yakima County Com- missioners, the Chairman of the School Board of Yakima School District No, 7, the Representative of the State Department of Commerce and Economic Development, and a Resident and Property Owner of the area proposed to be annexed, met and considered all of the factors set forth in said Chapter 282, Laws of 1961, and at the conclusion of said meet- ing made and entered their unanimous findings and determinations with • respect to such annexation and recommended to the City Council of the City of Yakima that said proposed area be annexed to the City of Yakima, and WHEREAS, pursuant to due and legal notice as provided by law and by the City Charter, a public hearing was held upon said petition for annexation before the City Council of the City of Yakima on the 7th day of September, 1965, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as M -I, Light Industrial Zone for the reasons that such zoning is in accord with good planning and with the Comprehensive Plan of the City of Yakima, that the majority of the property owners in the vicinity do not oppose the zoning classification or the annexa- tion, that the needs of the City and community require that such pro- perty be zoned as M -I, Light Industrial Zone, and that such zoning is the highest and best use for said property, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described real property contiguous to the City of Yakima, Washington, to -wit: Beginning at a brass monument at the point of intersection of the north line of the southeast quarter of Section 30, Township 13 North, Range 19, E.W.M., with the center line of South First Street; thence south 24 ° 12' east 927.4 feet to the true point of beginning; thence south 65 °48' west 339.90 feet; thence south 24 °12' east 100.05 feet; thence south 65 °48' west 21.60 feet; thence south 24 °12' east 140.15 feet; thence south 75 °39' west 114.80 feet; thence south 75 °16' west 272.0 feet to the east right of way line of the Northern Pacific Railway Company; thence northwesterly to the • southwest corner of Lot 51 of St. Paul Acre Lots according to plat thereof recorded in Volume "A" of plats, page 15, records of Yakima County, Washington; thence east, along the south line of Lot 51 of said St. Paul Acre Lots to the southeast corner of said Lot 51; thence north, along the east line of Lots 51 and 52 of said St. Paul Acre Lots to a point 30 feet south of the center line of East Lenox Avenue; thence east and parallel with the center line of East Lenox Avenue 64.8 feet; thence south and parallel with the west line of Lot 36 of said St. Paul Acre Lots, 132 feet, more or less, to the south line of said Lot 36; thence east along said south line 40.4 feet; thence north and parallel with the west line of said Lot 36, 57 feet; thence east and parallel with the center line of East Lenox Avenue to the east line of South First Street; thence south along the east line of South First Street to the north line of Lot 34 of said St. Paul Acre Lots; thence east, along the north line of Lots 34 and 2 of said St. Paul Acre Lots to the center line of South 6th Street; thence south, along the center line of South 6th Street to the south line of Lot 2 of said St. Paul Acre Lots; thence west, along the south line of Lots 2 and 34 of said St. Paul Acre Lots, to the center line of South First Street; thence south 24 °12' east to the true • point of beginning; is hereby annexed to the City of Yakima, Washington. Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtedness of the City of Yakima. Section 3. That the hereinbefore described real property annexed to the City of Yakima is hereby zoned as M -I, Light Industrial Zone. -2- Section 4. That the next regularly amended Use District Map prepared by and for the City of Yakima shall show said property to be zoned as M -I, Light Industrial Zone. Section 5. The City Clerk is hereby authorized and directed to fi le a certified copy of this ordinance with the County Auditor of • Yakima County and with the Board of County Commissioners of Yakima County, Washington. Section 6. This Ordinance shall be in full force and effect 30 days after its final passage, approval and publication as provided by law and by the City Charter.
