• AN ORDINANCE p r o v i d i n g for the Improvement of certain property by con-
structing a pipe sewer with the necessary wye branches
and manholes; establishing a Local improvement District,
providing for the method of payment thereof, and creating
a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section I. That the following property shall be improved by con-
structing a pipe sewer with the necessary wye branches and manholes:
Lots 5, 6, 7, 8, 9 and 10 of Scenicview Terrace.
Lot 6 Coonse State Addition.
The south 110 feet of the north 135 feet of the east two acres
of the west four acres of the southwest quarter of the south-
west quarter of the southeast quarter of Section 22, Township
13 North, Range 18 E.W.M. (Walnut Street between South 39th
Avenue and South 40th Avenue).
• Beginning at a point 1019.3 feet east of the southwest corner
of the southwest quarter of Section 14, Township 13 North,
Range 18 E.W.M., and on the south line of said section; thence
north 54° west a distance of 33.85 feet to the true point of
beginning; thence north 54 west a distance of 58.5 feet;
thence north 40° 49' east a distance of 287.15 feet; thence
south 40° 30' east a distance of 320.4 feet to the north
right of way line of Englewood Avenue; thence west along the
north Line of Englewood Avenue and parallel with the south line
of said section to the true point of beginning. (Englewood
Avenue from Powerhouse Road approximately 350 feet east).
The west 150.7 feet of Tract 49, State Addition to the City of
North Yakima No. 2'(now Yakima) except the south 262.5 feet.
(North 58th Avenue from Englewood Hill Place to Tieton Canal).
The west half of the southeast quarter of the northwest quarter
of the northeast quarter, Section 23, Township 13 North, Range 18
E.W.M., except the west 150 feet of the south 140 feet.
Block 31, plat of Section 36, Township 13 North, Range 18 E.W.M.
except the east 278.8 feet of the south 247.7 feet and except the
south 225 feet of the east 75 feet of the west 358.7 Feet.
Lot 9 and 10 West Hill Court.
Section 2. There is hereby created a Local improvement District

to be called "Local Improvement District NO._4(6 ", which said
41O trict shall include all of the property adjacent to the above mentioned
improvements which are subject to assessMents, said property being de-
scribed above.
Section 3. The assessments shall be made according to special

benefits derived from the improvements without regard to the zone and

termini method.
Section 4. All costs and expenses in connection with the construc-
tion of said improvement, including enaincering, inspection, advertising,
publication of notices, and all other expenses incident thereto, shall
be levied and assessed against a of the property legally and properly
assessable therefor as provided by law and as above described.
Section 5. f of the aforesaid construction work shall be in
accordance with the plans and specifications, profiles, maps and detailed
drawings which have been prepared by the City Enaineer, filed with the
City Clerk, and which are hereby approved and adopted.
Section (3. All of the work necessary to be done in connection with
the making of said improvements shall be done and made by contract upon
competitive bids, and the City shall have the power to reject any and
arl bids.
There is hereby created a special fund, to be called
"Local Improvement Fund, District No....,41LL", into which shall be placed
ail sums paid on account of the aforesaid special assessments, including
a;! interest and penalties thereon, and, in the event of the sale of
loal improvement bonds by the,City, aii premium and interest :on said
bnds issued for said improvement

Section_ 8. Bonds bearing interest at the rate of 4% per annum,
III payable on or before 12 years from the date of issuance, shal I be issued
in payment of the costs and expenses of said improvements, which bonds
shalt be redeemed by the col lection of special assessments to be levied
and assessed upon the property within said district, payable in ten equal
annual instal lments with interest at the rate of 4% per annum, interest
payable annually, under the mode of payment 'payment by bonds", as de-
fined by the statutes of the State of Washington and the ordinances of
the City of Yak ima; provided, that this improvement may be financed by
the issuance of promissory notes under the authority of R.C.W. 35.45.150.
Section 9. This ordinance is one relating to local improvements
or assessments therefor and shall become effective immediately upon its
0 passage, approval and publ /cation as provided by law and the City Charter.
