ORDINANCE NO. .72
AN ORDINANCE providing for the annexation by the City of Yakima of
certain property contiguous to the City of Yakima and
zoning the same as R-I, One-Family Zone.
WHEREAS, proceedings have been held in accordance with Chapter
128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of
110 1961 for the annexation of the property hereinafter described, and
WHEREAS, at a regularly scheduled meeting of the Planning Commis-
sion of the City of Yakima, a hearing was held pursuant to legal notice
upon the zoning and land use classification of said property herein-
after described and annexed, and
WHEREAS, said Planning Commission duly recommended that said
property be annexed to the City of Yakima and recommended that said
property be zoned R-I, One-Family Zone.
WHEREAS, said proposed area to be annexed to the City of Yakima
is less than ten acres in area and less than $200,000.00 in assessed
valuation, and
411 WHEREAS, in accordance with the provisions of Chapter 282, Laws
of 1961, the Mayor of the City of Yakima, the Chairman of the Board of
County Commissioners of Yakima County, and the County Superintendent
of Schools of Yakima County have al 1 been apprised of the petition
and have agreed that a review proceeding as provided in said Chapter
282 is not necessary for the protection of the interests of the various
parties, and that such review procedures should be dispensed with, and
WHEREAS, pursuant to due and legal notice as provided by law and
City Charter, a publ ic hearing was had upon said petition for annexa-
tion before the City Council of the City of Yakima on the 25th day of
October, 1965, and
Ilk WHEREAS, the City Council finds that such property should be
annexed to the City of Yakima and further finds that the recounenda-
tion of the Planning Commission for the zoning and land use classifi-
cation of said property should be approved for the reasons that such
zoning and classification are in accordance with good planning and
with the Comprehensive Plan of the City of Yakima, that the majority
of the property owners in the vicinity are in favor of the zoning
classification and the annexation, that the needs.of the City and
community do require the hereinafter set forth zoning classification,
and that the highest and best use for said property is as hereinafter
determined, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the following described property contiguous to
the City of Yakima, Washington, to-wit:
Beginning 911.5 feet south 15°23'30" east of the northwest
corner of Tract 31 of State Addition to the City of North
Yakima No. 2 (now Yakima) according to plat thereof record-
ed in Volume "F" of plats, page II, records of Yakima County,
Washington; thence north 85° east to the centerline of North
53rd Avenue which is the true point of beginning; thence
north 85° east to the northerly right of way line of the
Tieton Irrigation District Canal; thence in a southerly
direction, along . the north line of said canal right of way,
to the north line of Tract 43 of said State Addition to the
City of North Yakima No. 2 (now Yakima); thence southwesterly,
along the north line of Tract 43 of said State Addition to.
the City of North Yakima No. 2 (now Yakima), to the extended
,east line of Tract 30 of said State Addition to the City of
North Yakima No. 2 (now Yakima); thence north 15°23'30" west,
along the east line of Tract 30 of said State Addition to the
City of North Yakima No. 2 (now Yakima), to a point 215.5
feet north 15°23'30" west of the southeast corner of said
Lot 30; thence west 227.23 feet; thence north 15°23'30" west
23.5 feet; thence northerly to a point located as follows:
Beginning at the northwest corner of Tract 30 of said State
Addition to the City of North Yakima No. 2 (now Yakima); thence
south 15°23'30" east 468.8 feet; thence south 62°59'30" east
265 feet to said point; thence north 21°54' east 124 feet;
thence east to the east line of Tract 30 of said State Addition
to the City of North Yakima No. 2 (now Yakima); thence north
15°23'30" west, along the east line of Tract 30 of said State
Addition to the City of North Yakima No. 2 (now Yakima), to the
centerline of Scenic Drive; thence easterIV, along the center-
line of Scenic Drive, to a point 15 feet east of the westerly
right of way line of North 53rd Avenue; thence in a southerly
direction, parallel to the westerly line of North 53rd Avenue,
to the true point of beginning;
h6reby annexed to the City of Yakima, Washington.
Section 2. That the owners of the hereinbefore de.7eribed real
property annexed to the City of Yakima shall be required to assume

existing indebtednosses of the City of Yakima.
Section 3. That in accordance with the recommendations of the
P1,nning Commission of the City of Yakima, said property is hereby
zoned as R-I, One-Family Zone.
Section 4. That the next regularly amended Use District Map
prepared by and for the City of Yakima shall show said property as
hereinbefore zoned and classified.

Section 5. The City Clerk is hereby authorized and directed to
file a certified copy of this ordinance with the County Auditor of
Yak ima County and the Board of County Commissioners of Yak ima County.
Sect ion 6 . This ordinance s h a l l be in f u l l force and effect 30
days after its final passage, approval and publication, as provided
1100 by law and by the City Charter.
