ORDINANCE NO. 7
AN ORDINANCE providing for the improvement of certain property by the
construction of concrete sidewalks, together with necess-
ary grading and incidental work; establishing a local
improvement district, providing for the method of pay-
ment thereof, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
• Section 1. That concrete sidewalks, together with necessary
grading and incidental work, shall be constructed along the following
described streets within the City of Yakima, Washington:
Bonnie Doone Avenue from South 20th Avenue to South 24th
Avenue.
Clinton Way from South 24th Avenue to South 29th Avenue.
Grant Street from South 16th Avenue to South 20th Avenue.
Plath. Avenue from South 16th Avenue to South 20th Avenue.
Viola Avenue from South 20th Avenue to South 24th Avenue.
South 20th Avenue from Plath Avenue to Grant Street.
South 22nd Avenue from Viola Avenue to Tieton Drive.
South 24th Avenue from Viola Avenue to Clinton Way and
from 480 feet north of Bonnie Doone to MacLaren Street.
The property to be served by and especially benefitted by and assessed
for the above described improvement is situated in the City of Yakima,
Yakima County, Washington, and constitutes all of the property lying
• within the following described boundary line:
Beginning at the intersection of the centerline of South
24th Avenue and Viola Avenue; thence north, along the
centerline of South 24th Avenue, to the er,tended south
line of Block 2, Shannon Homes; thence . west, along the
south line of Block 2, Shannon Homes, to the east line of
Hamilton Acres Replat; thence north, along the east line
of Hamilton Acres Replat, to the south line of Lot 24 of
Hamilton Acres Replat; thence west, along the south lines of
Lots 24, 25, 13 and 12 of Hamilton Acres Replat, to the east
line of Applewood Manor; thence south, along the east line
of Applewood Manor, to the south line of Lot 2, Block 3,
Applewood Manor; thence west, along the south line of Lot 2,
Block 3, Applewood Manor, to the east line of South 29th
Avenue; thence north, along the east line of South 29th
Avenue, to the north line of Lot 2, Block 2, Applewood Manor;
thence east, along the north line of Lot 2, Block 2, Apple-
wood Manor, to the west line of Hamilton Acres Replat; thence
south, along the west line of Hamilton Acres Replat, to the
north line of Lot 10, Hamilton Acres Replat; thence east,
along the north line of Lots 10 and 27 of Hamilton Acres
Replat, to the west line of Block 2, Shannon Homes; thence
north, to the north line of Block 2, Shannon Homes; thence
east, along tho north l i n e of Block 2, Shannon Homes, to the
west l i n e of Lot 1, Block 2, Shannon Homes; thence south,
to'the centerline of Clinton Way; thence east along the cen-
terline of Clinton Way, to the centerline of South 24th Ave -
nue; thence north, along the centerline of South 24th Avenue,
to a point 66 feet south of the north line of the southwest
quarter of the northwest quarter of the southeast quarter of
Section 26, Township 13 North, Range 18, E.W.M.; thence east,
parallel to the north line of the southwest quarter of the
northwest quarter of the southeast quarter of said Section
26, to the east line of the west half of the southwest quarter
of the northwest quarter of the southeast quarter of said
Section 26; thence north, to the north line of the southwest
quarter of the northwest quarter of the southeast quarter of
said Section 26; thence west, along the north line of the
southwest quarter of the northwest quarter of the southeast
quarter of said Section 26, to a point 170 feet east of the
centerline of South 24th Avenue; thence north, parallel to
the centerline of South 24th Avenue, to a point 139 feet
south of the centerline of West Nob Hill Boulevard; thence,
west, parallel to the centerline of West Nob Hill Boulevard,
to a point 147 feet east of the centerline of South 24th
• Avenue; thence north, parallel to the centerline of South 24th
Avenue, to the centerline of West Nob Hill Boulevard; thence
west, along the centerline of West Nob Hill Boulevard, to the
centerline of South 24th Avenue; thence north, along the
centerline of South 24th Avenue, to the centerline of Tieton
Drive; thence east, along the centerl ine of Tieton Drive, to
the centerline of South 2Ist Avenue; thence south, along the
centerline of South 2Ist Avenue, to the centerl ine of MacLaren
Street; thence west, along the centerline of MacLaren Street,
to a point 20 feet east of the east line of Lot 7, Royal Crest;
thence south to the north line of Lot 4, Royal Crest; thence
east to a point 62.5 feet east of the west line of Lot 4,
Royal Crest; thence south to the north line of St. Helens
Street; thence east, along the north line of St. Helens Street,
to the east line of South 20th Avenue; thence north to the
Naches and Cowiche Canal; thence southeasterly along the
Naches and Cowiche Canal to a point 424.7 feet south of the
north line of the southwest quarter of the northeast quarter
of the northeast quarter of said Section 26; thence east to the
centerline of 5outh 19th Avenue; thence south, along the center-
line of South 19th Avenue, to the centerline of West Nob Hill
Boulevard; thence east, along the centerline of West Nob Hill
Boulevard, to the centerline of South 16th Avenue; thence
south along the centerline of South 16th Avenue, to the south
line of said Section 26; thence west, along the south line
of said Section 26, to the centerline of South 20th Avenue;
thence north, along the centerline of South 20th Avenue, to
the south line of Sutor Addition; thence west, along the
south line of Sutor Addition, to the centerline of South 22nd
Avenue; thence north, along the centerline of South 22nd
Avenue, to the centerline of Viola Avenue; thence westerly,
along the centerline of Viola Avenue, to •the point of be-
ginning.
Section 2. There is hereby created a Local Improvement District,
to be called "Local Improvement District No.10 ", which said dis-
trict shall include all of the property adjacent to the above mentionec
improvements which are subject to assessments, said property being
descriLed above.
Section 3. The assessments shall be made according to special
0 benefits derivcA from the improvements without regard to the zone and
termini method.
Section 4. All costs and expenses in connection with the con-
struction of said improvements, including the cost and expense of
engineering, inspection, advertising, publication of notic,--)s, and all
other expenses incident thereto, shall be levied and assessed upon all
of the property embraced within said Local Improvement District, in

the manner and as provided by the Laws of the State of Washington and
the ordinances of the City oF Yakima, and said City shall not be liable
in any mariner for any portion of said costs and expenses of said im-
provement.
Section 5. All of the aforesaid construction work shall be in
0 accordance with the plans and specifications, profiles, maps and de-
tailed drawings which have been prepared by the City Engineer, filed
with the City Clerk, and which are hereby approved and adopted.
Section 6. All of the work necessary to be done in connection
with the making of said improvement shall be done and made by contract
upon competitive bids, and the City shall have the power to reject any
and all bids.
Section 7. There is hereby created a special fund, to be called
"Local Improvement Fund, District No. ", into which shal 1 be

placed all sums paid on account of the aforesaid special assessments,
including all interest and penalties thereon, and in the event of the
sale of local improvement bonds by the City, all premium and interest
410 on said bonds issued for said improvement.
Section 8. Bonds bearing interest at the rate of 4c7 per annum,
payable on or before 12 years from the date of issuance, shal I be
issued in payment of the costs and expense of said improvement, which
bonds shall be redeemed by the collection of special assessments to be
levied and assessed upon the property within said district, payable in
ten equal annual installments with interest at the rate of 4% per
annum, interest payable annually under the mode of payment "payment by
bodo', as defined by the statutes of the State of Washington and the
ordinances of the City of Yakima; provided that, this improvement may
be financed by the issuance of promissory notes, under the authority
410 of R.C.O. 35.45150.
Section 9. This ordinance is one relating to local improvements
or assessments therefor, and shall become effective immediaLe!y upon

its passage, approval and publication as provided by law and by the
City Charter.
