AN ORDINANCE relating to public safety and morals, prohibiting loiter-
ing and similar conduct by minors under the age of eight-
een years during certain hours; declaring it to be un-
lawful for a parent, guardian, or other person having
supervision of a minor under the age of eighteen years
to permit such minor to loiter and engage in similar
conduct during certain hours; making exceptions to such
prohibited and unlawful acts; and amending Section
6.04.445(a) and Section 6.04.445(b) of the City of
Yakima Municipal Code.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section I. That Section 6.04.445(a) of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"6.04.445 LOITERING OF MINORS--RESPONSIBILITY OF
PARENTS--PENALTY. (a) It shall be unlawful for any minor
under the age of eighteen years to loiter, idle, wander,
stroll, play, be or remain upon the public streets, highways,
sidewalks, alleys, parks, playgrounds, public buildings,
public places, places of amusement and entertainment, vacant
lots or other unsupervised places between the hours of 10
p.m. and 6 a.m. on the following day, official city time;
provided, however, that the provisions of this section do not
apply to a minor accompanied by his or her parent, guardian
or other adult person having the authorized care and custody
of the minor, or where the minor is upon an emergency errand
or legitimate business directed by his or her parent, guardian
or other adult person having the authorized care and custody
of the minor.
Each violation of the provisions of this section shall
constitute a separate offense."
Section 2. That Section 6.04.445(b) of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"6.04.445(b) It shall be unlawful for the parent,
guardian, or other adult person having the care and custody
of a minor under the age of eighteen years to knowingly per-
mit such minor to loiter, idle, wander, stroll, play, be or
remain in or upon the public streets, sidewalks, highways,
alleys, parks, playgrounds, or other public grounds, public
places and public buildings, places of amusement and enter-
tainment, vacant lots or other unsupervised places, between
the hours of 10 p.m. and 6 a.m. of the following day, official
city time; provided, however, that the provisions of this
section do not apply when the minor is accompanied by his
or her parent, guardian or other adult person having the author-
ized care and custody of the minor or when the minor is upon
an emergency errand or legitimate business directed by his or
her parent, guardian or other adult person having the authorized
care and custody of the minor.
Each violation of the provisions of this section shall
constitute a separate offense."
SerAion 3. That Section 6.04.445(c) of the City of Yakima Muni-
cipal Code shall continue in effect as it exists at the time of the
passage of this ordinance without any alteration or amendment thereto.
Section 4. This Ordinance shal I be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
