ORDINANCE NO 7
AN ORDINANCE authorizing and directing the City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of real property
for the widening and improving of a portion of South
Third Avenue and the installation of curbs, gutters,
sidewalks, drainage facilities and public utility facili-
ties related thereto; providing for the condemnation and
taking of such real property and declaring the condemna-
411 tion and taking thereof to be necessary for a public use
required by the public interests; and directing that
compensation for such taking be paid from the Arterial
Street Fund of the City of Yakima.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the City Attorney of the City of Yakima is
hereby authorized and directed to institute and prosecute an action
in the Superior Court of the State of Washington, in and for Yakima
County, for the condemnation and acquisition of the hereinafter
described real property for the widening and improving of that portion
of South Third Avenue situated between West Nob Hill Boulevard and
Mead Avenue, within the City of Yakima, and for the installation of
curbs, gutters, sidewalks, drainage facilities and public utility
0 facilities related thereto, said real property being more particularly
described as follows:
Parcel 1. The West 10 feet of the West half of Lot 5 of Broadway-
Lenox Addition No. 1, according to plat thereof recorded
in Volume "1" of plats, page 24, records of Yakima County,
Washington.
Parcel 2. The West 10 feet of the West half of Lot 7 of Broadway-
Lenox Addition No. I according to plat thereof recorded
in Volume "1" of plats, page 24, records of Yakima County,
Washington.
Parcel 3. The West 10 feet of the West half of Lot 9 of Broadway-
Lenox Addition No. I according to plat thereof recorded
in Volume "I" of plats, page 24, records of Yakima County,
Washington.
Parcel 4. The West 10 feet of the West 145 feet of Lot 10 of Broad-
way-Lenox Addition No. I according to plat thereof re-
corded in Volume "I" of plats, page 24, records of Yakima
• County, Washington.
Parcel 5. The West 10 feet of the West half of Lot 1 of Hackett's
Subdivision according to plat thereof recorded in Volume
"H" of plats, page 50, records of Yakima County, Washing-
ton, and the West 10 feet of the North 11.5 feet of the
West half of Lot 2 of Hackett's Subdivision according to
plat thereof recorded in Volume "H" of plats, page 50,
records of Yakima County, Washington.
Parcel 6. The West 10 feet of the South 50 feet of the West half of
Lot 2 of Hackett's Subdivision according to plat thereof
recorded in Volume "H" of plats, page 50, records of
Yakima County, Washington.
Parcel 7. The West 10 feet of. Lot 3 of Hackett's Subdivision accord-
ing to plat thereof recorded in Volume "H" of plats, page
50, records of Yakima County, Washington.
Parcel 8. The West 10 feet of the West half of Lot 4 of Hackett's
Subdivision according to plat thereof recorded in Volume
"H" of plats, page 50, records of Yakima County, Washing-
ton.
Parcel 9. The West 10 feet of the West half of Lot 6 of Hackett's
Subdivision according to plat thereof recorded in Volume
"H" of plats, page 50, records of Yakima County, Washing-
ton.
Parcel 10. The West 10 feet of Lot 8 of Hackett's Subdivision accord -
ing to plat thereof recorded in Volume "H" of plats, page
50, records of Yakima County, Washington, except the East
100 feet.
Parcel 11. The West 10 feet of the West 150 feet of Lot 10 of Hack -
ett's Subdivision according to plat thereof recorded in
Volume "H" of plats, page 50, records of Yakima County,
Washington.
Parcel 12. The East 30 feet of the North 66 feet of the South 528
feet of the East half of the Northeast quarter of the
Northeast quarter of the Southeast quarter of Section 25,
Township 13 North, Range 18, E.W.M., in the City of Yakima,
• Yakima County, Washington, except the West 25 feet.
Parcel 13. The East 30 feet of the North 66 feet of the South 313
feet of the East half of the Northeast quarter of the
Northeast quarter of the Southeast quarter of Section 25,
Township 13 North, Range 18, E.W.M., in the City of
Yakima, Yakima County, Washington, except West 25 feet.
Parcel 14. The East 30 feet of the North 88 feet of the South 247
feet of the East half of the Northeast quarter of the
Northeast quarter of the Southeast quarter of Section 25,
Township 13 North, Range 18, E.W.M., in the City of Yakima,
Yakima County, Washington.
Section 2. That the acquisition of said real property for the
purposes herein mentioned is required for the interests of the public
and of the City of Yakima, and the uses and purposes herein mentioned
do constitute a public use of said property, and that said real pro-
perty is necessary for the use and purposes mentioned herein.
• Section 3. That the com ensation for said real
p property to be
taken shall be payable from the Arterial Street Fund of the City of
Yakima.
Section 4. That in conducting said condemnation proceedings, the
City Attorney is hereby authorized to stipulate to any matters for the
purpose of minimizing damages.

Section 5. This ordinance shal I be in full force and effect 30
days after its final passage, approval and publication as provided by
law and by the City Charter.
