AN ORDINANCE authorizing and directing the City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of a parcel of real
property for the widening and improving of a portion of
5th Avenue and the installation of curbs, gutters, and
public utility facilities related thereto; providing for
the condemnation and taking of such real property and
declaring the condemnation and taking thereof to be
111 necessary for a public use required by the public inter-
ests; and directing that compensation for such taking be
paid from the Arterial Street Fund of the City of Yakima.
BE IT ORDAINED BY THE CITY OF YAKIMA!
Section I That the City Attorney of the City of Yakima is here-
by authorized and directed to institute and prosecute an action in
the Superior Court of the State of Washington, in and for Yakima
County, for the condemnation and acquisition of a parcel of real pro-
perty described hereinbelow for the widening and improving of a por-
tion of 5th Avenue, within the City of Yakima, and for the installa-
tion of curbs, gutters, and public utility facilities related thereto,
said parcel of real property being more particularly described as
follows:
The West 7.1 feet of the South 62 feet of the North 212 feet
of the West 73.1 feet of Lot 4 of Matterson Acre Tracts,
according to plat thereof recorded in Volume "D" of plats,
page 20, records of Yakima County, Washington.
Section 2. That the acquisition of said real property for the
purposes herein mentioned is required for the interests of the public
and of the City of Yakima, and the uses and purposes herein mentioned
do constitute a public use of said property, and that said real pro-
perty is necessary for the use and purposes mentioned herein.
Section 3. That the compensation for said real property to be
taken shall be payable from the Arterial Street Fund of the City of
Yakima.
Section 4. That in conducting said condemnation proceedings, the
City Attorney is hereby authorized to stipulate to any matters for
the purpose of minimizing damages.
Section 5. This ordinance shall be in full force and effect
thirty days after its final passage, approval and publication as
provided by law and by the City Charter.
