AN ORDINANCE relating to planning; adopting a comprehensive plan for
the City of Yakima; providing a procedure for amending
such plan; and repealing Section 1.42.070 of the City of
Yakima Municipal Code.
WHEREAS, the Planning Commission of the City of Yakima has here-
tofore held several public hearings on the matter of adopting a cam-
prehensive plan, called the "General Plan for the City of Yakima", and
as a result of such hearings has recommended to the City Council that
the plan contained in Exhibit A attached hereto be adopted as the
official comprehensive plan of the City of Yakima, and
WHEREAS,. the City Council of the City of Yakima has heretofore
held several public hearings on the matter of adopting such plan as
recommended by the Planning Commission, and as a result of such hear-
ings the City Council finds it in the best interests of the people of
the City of Yakima that the plan contained in Exhibit A attached here-
to be adopted as the official comprehensive plan for the City of Yak-
ima, and
WHEREAS, three or more copies of Exhibit A hereto have been and
0 now are on file in the office of the Yakima City Clerk, now, therefore,
BE IT ORDAINED BY THE C(TY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The document attached hereto marked Exhibit A,
entitled "General Plan for the City of Yakima", dated February, 1966,
including the maps marked "General Plan, 1980, Yakima, Washington",
and "Local Planning Areas, General Plan, 1980, Yakima, Washington"
appended to such General Plan and incorporated therein, of which not
less than three copies have been and now are on file in the office of
the Yakima City Clerk, is hereby adopted as the official comprehensive
plan for the City of Yakima.
Section 2. Amendments to the comprehensive plan for the City of
Yakima may be initiated by a motion of the City Council declaring its
intention to amend said comprehensive plan, which motion shall set
forth the proposed amendments and request the Planning Commission to
hold a public hearing and make a recommendation to the City Council
with respect to such proposed amendments.
Amendments to said comprehensive plan may also be initiated by a
motion of the Planning Commission declaring its desire to amend said
comprehensive plan, which motion shall set forth the proposed amend-
ments and set a date for a public hearing thereon.
The Planning Commission shall hold at least one public hearing,
pursuant to notice required by law, on any proposed amendment to the
comprehensive plan, and pursuant to such hearing, make a recommenda-
tion to the City Council with respect to such proposed amendment. The
City Council shall hold at least one public hearing, pursuant to notice
required by law, on any proposed amendment to the comprehensive plan,
which hearing shall be held after the Planning Commission's hearing,
at which time the City Council shall consider the recommendation of
the Planning Commission with regard to such proposed amendment. The
City Council may, by motion, refer any proposed amendment back to the
Planning Commission for further consideration and recommendation be-
fore final action is taken by the City Council.
At the conclusion of the hearing, or hearings, by the City Council
on any such proposed amendment, the City Council may, by ordinance,
0 amend the comprehensive plan, or may, by resolution, reject any pro-
posed amendment; and the action of the City Council in passing or
adopting any such ordinance or resolution, as the case may be, shall
be final.
Section 3. Section 1.42.070 of the City of Yakima Municipal Code
is hereby repealed in its entirety.
Section 4. This Ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
