ORDINANCE NO. 2
AN ORDINANCE proposing to the voters of the City of Yakima that the
City purchase, acquire and construct all properties,
equipment and facilities necessary to establish, operate
and maintain a motor coach system for the transportation
of passengers for hire; specifying and adopting the
system or plan proposed; declaring the estimated cost
thereof, as near as may be; providing for the financing
thereof; authorizing the levy and collection of a housing
unit transit subsidy tax; calling a special election to
410 submit a proposition to the voters of the City of Yakima
for their ratification or rejection of this ordinance;
and declaring an emergency.
WHEREAS, Yakima City Bus Lines, Inc. presently owns and operates
for hire a motor coach transportation system within the City of Yakima
pursuant to a franchise heretofore granted by the City to D. S. Peck
and assigned to Yakima City Bus Lines, Inc., and
WHEREAS, the City has been notified by Yakima City Bus Lines, Inc.
of its intention to surrender its franchise and discontinue service
thereunder on June 1, 1966, and
WHEREAS, Yakima City Bus Lines, Inc. operates the only motor
coach transportation system within the City of Yakima, and no such
service will be available on or after June 1, 1966 unless the City of
Yakima acquires and operates a motor coach transportation system,
and the City Council therefor deems it to be advisable, and in the
best interests of the people of the City of Yakima, that the City
purchase, acquire, construct, operate and maintain a motor coach
system for the transportation of passengers for hire within and,
insofar as allowed by law, without the City of Yakima, and
WHEREAS, in order that the City be authorized to render such
service, it is required by law that the City Council by ordinance
specify and adopt the system or plan proposed, declare the estimated
cost thereof as near as may be, and submit such ordinance and the
provisions thereof to the voters of the City for their ratification
AV or rejection, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section I. That the City of Yakima is hereby authorized to
purchase, acquire and construct all properties, real and personal,
and all equipment and facilities necessary to establish, operate and
maintain a motor coach system for the transportation of 15assengers

for hire within and, insofar as allowed by law, without the City of
Yakima.
Section 2. The system or plan hereby proposed and adopted will
consist of the carrying on, operating and maintaining of a motor coach
system for the transportation of passengers for hire upon and along
• the streets of the City of Yakima,following such routes and schedules,
and at such times, and in such manner, as from time to time may be
established by the City Council or administrative officials of the
City of Yakima,, all for the purpose of and with a view toward pro-
viding an adequate passenger transportation system within and, insofar
as allowed by law, without the City of Yakima, substantially as the
present system is being operated by Yakima City Bus Lines, Inc.
Section 3. In order to carry out said plan or system, the cost
of acquiring, purchasing and constructing the property, real and
personal, and equipment and facilities, which cost is for and shall
include capital purposes only, is approximately S263,900.00, as near
as may be estimated; and said cost includes the items and amounts

Purchase of 9 used buses from $ 12,800.00
Yakima City Bus Lines, Inc.
Purchase of parts and tools from 3,000.00
Yakima City Bus Lines, Inc.
Purchase of 10 new 35 passenger 153,000.00
buses
Pro rata share of land acquisition 70,000.00
and construction of garage and
weather shelters
Purchase of 1 passenger vehicle 2,300.00
Contingencies 22,800.00
TOTAL $263,900.00
• Section 4. The aforesaid cost shall be paid in part by means of
a Mass Transportation Facilities Grant to the City of Yakima from the
Federal Government under the Urban Mass Transportation Act of 1964 to
the extent of approximately $125,550.Q0 or more, as that amount will
be determined by. the Department of Housing and Urban Development of
the Federal Government, and the balance of said cost shall be paid by

a transfer and loan of the approximate amount of $138,350:00 or less,
from any available fund or funds of the City of Yakima to a Transit
Fund, to be created by ordinance of the City Council, said loan, with
interest thereon, to be repaid by the Transit Fund from proceeds of
111 a housing unit transit subsidy tax provided for hereinbelow.
Section 5. Pursuant to Chapter 111, Laws of 1965 of the State
of Washington, Extraordinary Session, there shall be levied against
and collected from all persons within the City of Yakima who are
served by and billed for any one or more public utility services
owned and operated by . Jtie City, a housing unit transit subsidy tax
in an amount to be fixed from time to time by ordinance of the City
Council, which amount shall not exceed one dollar per month for each
housing unit, or such higher amount as may hereafter be authorized
by state law. The proceeds from such housing unit transit subsidy
tax shall be used only for the operation, maintenance and capital
needs of the transportation system proposed by this ordinance.
Section 6. When said transportation system has been acquired
by the City, the City Council shall pass such ordinances and resolu-
tions and make such rules and regulations in regard to the operation
thereof as it may, from time to time, deem advisable, with full
authority to regulate and control the use and Operation of the
vehicles used for such business; and, in connection with the operation
and maintenance of said system, may make such changes, additions, or
deletions in the routes and in the time, manner and means of trans-
portation of passengers as deemed necessary and advisable by the City
Council.

Spction 7. A special election shall be held in the City of
Yakima on the 24th day of May, 1966, in accordance with all applicable
laws, for the purpose of submitting this ordinance to the voters of
the City of Yakima for•thefr ratification or rejection by means of a
ballot title and proposition which.shall read as follows:

Section 8. That the Clerk of the Council is hereby di rected to
notify the County Audi tor of Yakima County, Washington of the passage
of this Ordinance, and to do al I other things necessary in the time
and manner required by law to the end that the proposition set out
hereinabove shall be submitted to the electors.of the City of Yak ima,
Washington, as aforesaid.
Section 9. If the proposition above set forth should be adopted
and approved at said election, as by law provided, the City of Yak ima
III shal l proceed to acquire, ma i ntai n and operate a transportation system
in accordance with the plan or system as herein set forth and shall
have authority to use or borrow any monies or funds l e g a l l y avai lab$e
therefor as by law and this ordinance .authorized.
Sect i On 1 0 . T h i s ordinance is one to provide for the immediate
preservation of the publ ic peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby ,
declared to exist and t h i s ordinance s h a l l be in f u l l force and effect
immediately upon its passage, approval and publication as provided
by law and by the City Charter.
