HomeMy WebLinkAbout1961-226 ORDINANCE 410 AN ORDINANCE providing for the licensing, impounding and redemption of dogs; defining and licensing dog and cat kennel's; providing a penalty for the violation hereof; and repealing Ordinance Nos. A-268, B-327 and B-1716 and all other ordinances or parts of ordinances in conflict herewith, saving certain offenses, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: . Section 1. DOG LICENSE REQUIRED. It shall be unlawful for any person to own, keep or have control of a dog of any kind or size over the age of four months in the City of Yakima without having procured a license therefor and without having the license tag hereinafter provided for attached to a collar worn by such dog, In any prosecu- . tion for a violation of this ordinance the absence of the licens4 tag on a dog's collar shall be prima facie evidence that said dog has not been legally licensed. Section 2, KENNELS, DEFINED. A dog or cat kennel is defined as a building, enclosure or portion of any premises in or at which dogs or cat are boarded or kept for hire,or in or at which dogs or cats are kept or maintained by any person other than the owner thereof, or in or at which six or more cats or four or more doge over the age of four months are kept or maintained, . Section APPLICATIONS -- TAGS. Upon payment to the City Clerk of the required license fee hereinafter provided, the Clerk shall issue to the person applying for the same a license which shall remain . in force for one year from the 1st day of February of each year, and no longer, and a metal tag upon which shall be inscribed, "Yakima,- • Ilk (License Number) Dog (Year) Tax l and which tag shall be securely fastened by the licensee to a collar which shall be worn by the dog at all times. • Section 4. LICENSE RECORDS. It shall be the duty of the City 111 Clerk to keep and maintain a list of the names and addresses of all persons to whom the licenses herein provided for are issued, together with the number of the license tag issued to each person. The City Clerk shall turn over to the City Treasurer, in the manner provided by law, all moneys received by him under this ordinance° Section 5. LICENSE FEES. The license fee for the owning, ke or having control of dogs and dog and cat kennels in the City of Yakima shall be as follows: Dogs, male and spayed female, annually $ 2.50 Dogs, fe:Iale, annually 5.00 Dog kennel, less than 10 dogs, annually 10.00 Dog kennel, 10 or more dogs, annually 15.00 Cat kennel, 6 or more cats, annually 10.00 Provided, that in the case of dogs or kennels previously licensed, there shall be an additional fee of $2.00 for each dog or dog or cat 411 kennel annual license fee which is purchased more than 30 days after the effective date of this ordinance or more than 30 days after the let day of February of each year beginning on February 1, 1962. Section 6. IMPOUNDING UNLICENSED DOGS. Whenever an unlicensed dog is found within the City of Yakima, it may be taken up and im- pounded by such officer charged with the enforcement of this ordinanc Any such dog so impounded may be redeemed, sold or destroyed as pr*- vided by Ordinance No. of the City of Yakima. Section 7. VIOLATION PENALTY. Any person violating or failing to comply with the provisions of this ordinance shall be punishable by a fine not to exceed $50.00 or by imprisonment in the City J:il for a period not to exceed 10 days, or by both such fine and imprison- • ment. Section_8. REPEAL SAVING CLAUSE, Ordinance Nos° B-327 and B-1716 and all other ordinances or parts of ordinances in -2- conflict herewith are hereby repealed; provided, however, that the 410 repeal of said ordinances shall not be construed as abating any actions, rights of actions or penalties thereunder, or as waiving any right of the City of Yakima under any ection or provision thereof existing at the time of the passage of this ordinance. Section 9. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety of the people of the City of Yakima, and an emergency is hereby declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
