HomeMy WebLinkAbout1961-244 _5 • ORDINANCE NO - 241 AN ORDINANCE providing for the vacation of that portion of Lenox Avenue situate upon the following described premises: The North 30 feet of Lot 52 and the South 30 feet of Lot 53 all in St. Paul/s Acre Lots, according to the official plat thereof; and the South 30 feet of th4; West 308 feet of the Northeast Quarter of Section 30, Township 13 Forth, Range 19 E.W,N.; all situate in the City of Yakima, Yakima County, Washington. WHEREAS, a petition has been filed with the City Council of the City of Yakima providing for the vacation of the hereinafter described property; and WHEREAS, by resolution adopted by the City Council, a hearing on said petition was set for the 26th day of April, 1961 at the hour of 3:00 o'clock p.m., in the office of the City Council at the City Hall Yakima, Washington, and notices thereof were duly given in the manner provided by statute and by the City Clerk of said City; and WHEREAS, upon the hearing on said petition no objection was made thereon or filed by any abutting property owner, and it being deemed for the best interests of the people of the City of Yakima that said petition be granted and that said portion of Lenox Avenue be vacated, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That that portion of Lenox Avenue situate upon the following described premises, to-wit: The North 30 feet of Lot 52 and the South 30 feet of Lot 53 all in St. Paul's Acre Lots, according to the official plat thereof; and the South 30 feet of the West 308 feet of the Northeast Quarter of Section 30 Township 13 North, Range 19, E.W.M.; all situate in the City of Yakima, Yak- ima County, Washington; be, and the same is, hereby vacated. Section 2. The following portion of said real property and street, to-wit: The South 20 feet of the North 30 feet of Lot 52, St Paul's Acre Lots, according to the official plat thereof, recorded in the office of the Yakima County Auditor, Yakima County, Washington; is hereby reserved as an easement for public utilities, and easement is also reserved for such public utilities as are presently located outside of the above-described easement. All future utilities shall be constructed within the above-described easement reserved herein© If and when ahy utility presently existing outside of the above - described easement is moved or the locatton changed, then such utility shall be constructed within the above-deseribed easement. The right to perform any maintenance or reconstruction work of existing or future utilities is also expressly reserved, and such maintenance or reconstruction shall be without interference from any building 411 constructed on the vacated premises. Section,3. This ordinance shall be in 7u11 force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
