AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located between. South 38th
and South 40th Avenues and between the Metropolitan Park
District Golf Course and Tieton Drive in the City of
Yakima, Washington.
WHEREAS, on the 10th day of May, 1961 at a regularly scheduled
meeting of the City Council a hearing was had upon the recommendation
of the Planning Commission that certain specified property in the City
of Yakima, to -wit:
The East Half of the Northwest Quarter of the Northwest
Quarter of the Northeast Quarter and the East 20 feet of
the West Half of the Northwest Quarter of the Northwest
Quarter of the Northeast Quarter, Except the North 169.44
feet and Except the East 20 feet for road AND Lots 2, 3,
4, 5, 6, 7 8, 9, 10, 11, 12 13 and 14 of Walnut Grove
Addition according to the official plat thereof now on
file and of record in the office of the Auditor of Yakima
• County, Washington;
be rezoned from R -1, Single Family Residence Zone, to R -3, Multiple
Family Residence Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the fol-
lowing reasons, to-wit: That such rezoning is in accord with good
planning and with the Comprehensive Plan of the City of Yakima; that
the majority of property owners in the vicinity do not oppose the
change in classification; that the needs of the City and community do
require . -such change; and that the highest and best use is for Multiple
Family Residence purposes, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated be-
tween South 38th and South 40th Avenues and between the Metropolitan
• Park District Golf Course and Tieton Drive in the City of Yakima, Wash-
ington, and more particularly described as follows, to -wit:
The East Half of the Northwest Quarter of the Northwest
Quarter of the Northeast Quarter and the East 20 feet of
the West Half of the Northwest Quarter of the Northwest
Quarter of the Northeast Quarter, Except the North 169.44
feet and Except the East 20 feet for road AND Lots 2, 3,
4, 5, 6, 7, 8 , 9, 10, 11, 12, 13 and 14 of Walnut Grove
Addition according to the official plat thereof now on
file and of record in the office of the Auditor of Yakima
County, Washington;
be rezoned from R -1, Single Family Residence Zone, to R -3, Multiple
Family Residence Zone, be, and the same is, hereby approved, and said
real property is hereby rezoned to R-3, Multiple Family Residence Zone.
Section 2, The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the said City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall become effective thirty days
after its passage, approval and publication, as provided by law and
by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 17th day of
May, 1961.
