ORDINANCE NO, - 0 AN ORDINANCE providing for the safeguarding of life and property by regulating the installation, alteration, repair, use and operation of electric wires, appliances, apparatus and devices in or about building on private or public property; providing for the licensing for regulation and revenue of electrical contractors, dealers and wiremen; defining approved electrical materials and appliances; prohibiting the sale or u'pe,of unapproved materials and appliances; providing penalties for the -violation hereof; amending Sections 11.16.0304,11.16040; 11.16.050; 11.16.110; 11.16.130; 111 11617O; 11.16.200; 11.16.220; 11.16.240; 11.16.2 fe-(1.16.2e0; 11.16.280; 11.16.290; $' and 11.16.300; and re 1 ealing , e'ction 11.160230 all of the City of Yakima Muillicipal Code, BE IT ORDAINED BY THE CITY OF YAKIMA: Section I. That Section 11-416.030 of the City Yakima Municipal Code is hereby amended to read as follows:- 11.16.030 OBJECT AND SCOPE OF CODE. (a) The object of this chapter is to reduce personal and fire hazards due to electrical causes in the City of Yakima. The requirements set forth herein are intended to provide a minimum standard for electrical installations in the City of Yakima by supplementing the requirements of the electrical code of the State of Washington, latest edition, and the National Electrical Code, N.P.P.A. No 70, latest edition. The attached drawings, No 1 through No 6, indicate the interpretation of all three codes by the City of Yakima. (b) The regulations of this chapter shall apply to all elec- trical wiring, appliances, apparatus, and devices used or maintained in or about buildings (excepting Federal. Buildings under the juris- diction of the U. S. and o private property, and also all wiring upon the public streets and highways; provided, however, that theee regulations shall not apply to wiring equipment under the supervision of the Superintendent of the City Fire Alarm and Police Telegraph, nor to equipment and wires of public utilities which are used for the generation, control or distribution of the utility tend which are installed or maintained upon public streets or highways and in or on the stations and substations of such pub lic utility, (c) All installations shall be made in a neat, workmanlike manner and shall be so designed, constructed, installed and main- , tained as to reduce the personal and fire hazards as far as is reasonably possible.!' 411 -1- Section 2. That Section 11.16.040 of the City of Yakima Municipal Code is hereby amended to read as follows: 111 11.16.040 ADOPTION OF CODES BY REFERENCE. That the National Electric Code, N.F.P.A. Bulletin No 70, 1959 edition; and the Washington State Electric Code Rules and Regulations, 1960 edition, except as the same may be in conflict with the provisions hereof, are hereby adopted as a part of the Electrical Code of the City of Yakima." Section 3. That Section 11.16.050 of the City of Yakima Municipal Code is hereby amended to read as follows: 11.16.050 ADDITIONS, ALTERATIONS AND RENEWALS OF EXISTING INSTALLATIONS. When any additions, extensions, alterations or renewals are made to or increases of load on, or changes in occupancy or use of existing installations are made after the effective date of this chapter, all affected portions of such installa- tions shall be made to conform to all of the applicable re- quirements contained herein, with such exceptions as are approved by the Inspector." Section 4. That Section 11.16.110 of the City of Yakima Municipal • Code is hereby amended to read as follows: 11.16.110 GENERAL WIRING SPECIFICATIONS. A. Bus bars shall be used for installation of 100 ampere - or more B. All structures within Fire Zones 1 and 2 shall be wired within approved metal raceway. C. Al]. structures in Fire Zone 3 shall be wired with an approved metal raceway, excluding single family residences and multiple family residences of three units or less. D. Any structure wired in a non-metallic type wiring shall have a grounding conductor as part of the cable. E. All service drops to any building shall be run from the supply line and from the closest pole supporting the same directly to the service head at such building, and such drops shall not be run over or around the building supported on brackets unless special written permission is given. F. Only approved galvanized or sheridized standard conduit shall be used in concrete or in contact with earth within building lines. -2- (//Ai G. Al]. mechanical stokers, oil burners and other mechanical furnace firing devices and the controls and circulating fan motors therefor shall be wired with metal and shall be connected to an 41 independent circuit installed for that purpose. Romex may be used for the power circuit to a point adjacent to the furnace. A dis- connect shall be installed and an approved metal raceway shall be used from disconnect to furnace. This Rornex circuit may not be used in other than residential installations. H. All conductors shall be secured at boxes or cabinets by approved clamps or connectors. 1 Metal raceway shall be construed to mean any approved metal enclosure in which the conductor may be added or removed without disturbing the enclosure, J. Heavy duty plastic, rubber or other covered cord shall not be used to extend the wiring of a permanent circuit. K. Mast type service shall have a minimum of eighteen (18) inches clearance from roof to the bottom conductor of the service drop. L. The minimum service installation for a single family dwelling, or a multi family dwelling shall be as followss © Service conduit from head to panel shall be 13" or larger, and where same is used as a mast to support power wires, it shall be 2" or larger, 2. Service conductors shall be three No 2 wires, or two No 2 wires with one No 4 neutral or larger. 3. Minimum size of service panel shall be 100 amperes. Where the calculated load exceeds 20,000 watts, the minimum size of service panel shall be of 200 amperes. L Minimum number of circuits shall be sixteen single poles, at least two of which shall be spares. One wire only shall be permitted on each screw terminal. Splicing or tapping of wires inside the panel box is not permitted. Furnace shall be on a separate circuit. Furnace circuit may be Roniex from panel to disconnect, remote of furnace, then balance of circuit shall be approved flex or rigid con- duit E.M.T. 5. In no case shall the meter base be used to sub-feed to additional circuits nor shall the bar type current trans- former be used to sub-feed to other equipment except for emergency circuits. '6. Total disconnect switches shall be installed where re- quired by Section 2351 of the National Electrical Code. Double ocling is permitted only where two circuit- ., breakers are combined to fore one multi-wire circuit. -3- 7, Whenever additional circuits or appliances are installed in an exiting service a complete new service shall be 110 ' installed in accordance with the provision of this ordi- nance.' . S. Holes drilled in studs or plates for the passage of 12-2 and '142 non-metallic cables shall not be larger than . five/eighths of an inch. Holes drilled for other sizes of cable and conduit Shell be not more than one/eighth of an inch larger in diameter than the cable or conduit. 9. Service entrance conduit if installed within the wall - shall be not less than 2" steel conduit size from weather head to panel including a 200 ampere meter base." • - Section 5. That Section 11.16.130 of the City of Yakima Municipal, Code is hereby amended to reed as follows: ' PENALTY WHERE PERMIT REWIRED--TIME OF INSPECTION-- • NOTIFICATION—COVERING INSTALLATIONS. • A. All roughing in of plumbing and duct work shall be in,- stalled and in place before any electric wiring is installed in any residential type structure. • B. , Before ,, beginning the installation of -electrical wiring III or equIpmenc6 it shall. be AepessaJ.y to file an application for Electrical Permit with the office of the Electrical Inspector upon blanke provided for this purpose showing the nature of the work to be done o location of street and number for whom the work is to be done and the name of the contractor to whom the permit is to be issued. As soon as it is possible to determine the amount of the permit fee, the contractor shall pay said fee y and the Electrical Permit will be issued. • C. The Electrical Inspector shall cause work called for in - such aPplicetion•to be inspected withka forty-eight (48) hours from the date of the same, or within fortyeight (46) hours from comple- tior••of . If said work is found to Comply with the provisions of this chapter, the Inspector shall attach a notice to that effect; and if not done in accordance with the proVisions of this chapter notice shell so state, enumerating items to be -corrected, No electrical wiring' shall be covered or concealed until the 'Inspector has approved the installation and given permission • to cover or conceal the 'same, Should the Inspector condemn any of said work oP equipment as not being in accordance with the pro-, visions of this Chapter, notice to that effect shall be given by him to the person engaged in the work, or the party or parties having the work installed. Within a reasonable tims:thereafter such work or equipment shall be removed or altered as the as may require, and the necessary changes shall be made so that ell work III and equipment may fully comply - with the provisions of this ordi- nance before any further work in connection with such omIdemned -4- work or equipment is done on the building. In default such elec- trical contractor shall be liable to the penalties of this chapter and any and every owner contractor or other person engaged in the 411 construction of the building or structure or otherwise covering or allowing to be Covered Suchportion of work or e€��a;pment or removing - any, seal or notice not to cover same placed -thereon by the inspetor shall likewise be liable to the penalties of this chapte•." • ' . Section Ci. That Section 11.16.160 of the City of Yakima Municipal • Code is hereby amended to read as followsg 11.16,160 PERMIT REQUIRED. Before any electrical work provided for in this chapter; ex-- cep t in connection with the meters and service wires installed by the City or other light and power service companies and the in. stallativn in the power houses and substations of the light and power service companies operating under franchises, may be in . stalled altered• or repaired, a request for a permit to perform the shall be made to the Inspector setting forth the name of the .owner u his address,tmithe nature and extent of such work." Section 7,-•That Section 11.160170 of the City of Yakima Municipal Code-is hereby amended to read as follows • . . 11.16170 PERMTT TO OWNER.LIMITATION. 411 (a) A permit to perform electrical work in or about his own building Shall be issued to an owner provided that all work there-, under shall be performed by such owner. The Inspector however shall not issue such permit unless the person who is to perform the work be named in the permit and appears before the Inspector and shows by answering such questions as may be asked by the Inspector or otherwise that he has - sufficient knowledge of the matter to properly perform ouch. work. .' • (b) If such work, or any portion thereof, -shall not conform to the requirements of this chapter may require such work or portions thereof to be changed, .altered or repaired by a licensed contractor at the expense of the owner. A permit under such circumstances shall be issued (without fee) to such contractor and the permit to the owner shall be cancelled. Section 8.. • That-Section 11.16..200 of the City of Yakima Municipal Code is hereby amended to read as follows 11.16.200 TEMPORARY DECORATIVE AND FESTOON LIGHTING. .. . . . . . A. Permits shall be secured prior to the installation of any decorative or festoon system ever street or sidewalk areaa..Or•in il l outdoor places of public assembly. • -5- B. The voltage between any two conductors of a festoon lighting circuit shall not exceed 250 volt nor shall the voltage to ground from any conductor of the circuit exceed 150 volts, un- less by special written permission. 0, Festoon lighting strings or messengers shall not be eup- , ported by or secured by any fire escape or drain pipe. They shall be insulated•from their supports by approved strain insulators." Section 9. That Section 11.16.220 of the City of Yakima Municipal , Code is hereby amended to read as follows 11.16,220 INSPECTION FEES—GENERAL PROVISIONS. • All electrical inspection fees shall be based upon the fol- . lowing scheduleg ACTUAL•COST PEE MRCENTAGE OF ACIMAI_22§2) Up to $400.00, inclusive 2 Priroimiro of $3 00 N01.-00 to 8800,00 $10.00 plus 2°A over 8400.00 $801.00 to $1 S18.00 plus 1% over S800.00 $1, to 82,200,00 $27.00 plus 3/4% over $1 $2„20140 $4, 833.00 plus 1/2% over 82 $4p601,00 to 814,600.00 S45.00 plus 2/10% 'over 84 Over $14,,601,00 865,00 plus 1/10% over $14 111 Section 10. That Section 11.16,240 of the City of Yakima Municipal Code is hereby amended to read as followm 11.16.240 CLASSIFICATION OP LICENSES. (a) It shall be unlawful for any person to engage ,in the business of or receive compensation for, insta11ing altering maintaining or repairing electrical wiring equipment, apparatus or fixtures in or about buildings in the City of Yakima without having an Electrical Contractor License. (b) Every licensee shall display or pst such license in a conspicuous place in his place of business." Section 11. That Section 11.16.'250 of the City of Yakima Cede is hereby amended to read as follows "11.16.250 APPLICATION FO LIOENSE. Any person who, desire to procure a 'license as required by Section 11.16.240 shall make application to the City Clerk for the license giving his name dress, business telephone number and the location of his place of business. Such application shall be • ' made on a for provided by the Clcy C-e, k , Up on filing of su application with the City Clerk and the payment to the Treasurer of the City of Yakima for the license foe provided for by Section -6- 11.16.280 of this chapter for the license applied for the City Clerk shall issue a license to such applicant to do the things pertaining to the class of license for which this application was made aucept that an electrical contractor's license shall not be issued until the applicant submits proof that he has a state license; the number and date of expiration of which shall be re- corded on the city license. Section 12. That Section 11.16.260 of the City of Yakim Municipal Code is hereby amended to read as follows: 11.16.260 REVOCATION OF LICENSE. (a) If any licensed applicant refuses or neglects to comply with the provisions of this chapter within a reasonable time after having received written notice of any violation discovered by the Inspector, the license may be cancelled by the City Council after an opportunity to appear in person and by counsel and be heard. In addition thereto, the penalty provided in Section 11.16.320 of this chaoter may be enforced, and all work shall be corrected and made to comply therewith. A new license shall not be issued until all violations, theretofore committed, shall have been corrected. (h) The license of a registered electrician may be revoked if, at any time, the affidavit filed is shown to be false or if the person licensed refuses or neglects to comply with any of the provisions of this ordinance. If such license has been revoked no renewal of said license shall be allowed ,,or a period of three months thereafter.° Section 13. That Section 11.16.230 of the City of Yakima Municipal _ Code is hereby amended to read as follows: "11.16.280 LICENSE FEES—DURATION. (a) The license fees for electrical contractors Shall be 150.00 per year, renewal $50.00 per year (b) All licenses shall be for the following fiscal year or fraction thereof and shall be obtained on or before January 1 of each year and shall explire at midnight on December 31 following- In cases where the license is obtained after July 1 the respective license fees shall be half the amount noted in paragraph (a) of this section, SectionM. That Section 11.16.290 of the City of Yakima Municipal Code is hereby amended to read as follows: 11.16.290 RIGHT OP APPEAT Any person, firm or corporation feeling aggrieved by a de- l l cision of the Electrical Insoector shall have the right of appeal to a Board of Appeals consisting of an architect, an engineer e an -7- • electrical contractor the Fire Marshal, and one journeyman elec- trician. The Electrical Inspector shall be an ex-officio member 111 and shall act as secretary of the Board. The Board of Appeals shall be appointed by the City Manager and shall hold office at his pleasure, The Board shall adopt reasonable rules and regula- . tions for -conducting its investigation and shall render all de- cisions and findings in writing to the Electrical Inspector with a duplicate copy to the applicant and may recommend to the City . Council such new legislation as is consistent therewith." Section 15. That Section 11.16.300 of the City of Yakima Municipal Code is hereby amended to read as follows: "11,163300 RIGHT OF ENTRY FOR INSPECTION. • • Upon presentation of proper credentials the Electrical Inspector or his duly authorized representatives my enter at reasonable times any building structure or premises in the City to perform any duty imposed upon him by this chapter," Section 16, That Section 11. of the City of Yakima Municipal Code is hereby repealed. Section 31, Thls ordinance shall be in full force and effect 30 days after its final passage approval and publication as provided by 411 law and by the City Charter.
