AN ORDINANCE relating to tank truck, operation in the City of Yakima,
• . and amending, Sub-sections - (a) . and (c) of Section 9.64.010,
amendingSection '9,64.040, repealing Section - 9.64.030 and
adding a new section to be known as Section 9.64.060 of
• the City 'of Yakima Municipal Code.

BE IT ORDAINED BY THE CITY OF YAKIMA:

Section 1. That Sub-section (a) of Section 9.64.010 of the City
of Yakima Municipal Code is hereby amended to read as follows:
. n (a) Tank trucks used in the City for the transportation
• - of flammable liquids shall conform to the regulations as
• . eatablishedin Chapter 10 . .

Section 2. That Sub-section (c) of Section 964.010 of the City
. .
of Yakima Municipal Code is hereby -amended to read as ;follows: . .
" (c) Each tank truck or tank truckoand trailer operating
as a for carriage of flammablealiquids shall be equipped
with at least one portable fire extinguisher having at least
111 'a.12-B,C rating or two or more portable fire
. each of which shall have at least a6 rating, as such ratinge'
are defined by the National Board of Fire Underwriters" : a

Sectlm That Section 9.64.040 of theCity of Yakima:Municipal

• Code is hereby. amended to read as follows;

" 9.64.040' PARKING OF TANK TRUCKS. No tank truck or tank.
truck and trailer shall park on any publiestreet or alley
in the City of Yakima except while actually engaged in the
Process of unloading flammable liquids having a flash point
above 70 Fahrenheit. Provided, however, that temporary
parking due to traffic congestion temporary disability
of such vehicle, only, may be perfaitted. No tank trailer
shall., at any time, be parked on any street or alley unless
the saMe is attached to a vehicle capable of immediately
removing the same from such location, and then, only in
such cases as provided in this section."
Section 4. That Section 9.64.030 of the City of Yakima 'Municipal
Code is hereby repealed®

0 Seotion 5. That Chapter 9.64 of the City of Yakima Municipal Code

is hereby amended by adding thereto, following Section 9.64.050, a new
section numbered 9.64.060 to read as follows:

4IP ° 9.54.060 DELIVERY. Vo flammable liquid shall be de
livered from a tank truck or trailer in the City of Yakima
unless the operator in charge thereof shall remain in
constant attendance and in such a position as to be able
to immediately control the flow of such liquid."
Section 6, This ordinance shall be in full force and effect 30
days after its final passage, approval and publication as provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 27th day of
September, 1961.
