AN ORDINANCE rezoning certain property located at 1107 and 1109-A West Yakima Avenue in the City of Yakima from R-3, Multiple Family Residential Zone, to B-2, Local Business Zone. WHEREAS, after proper petition and due notice, a hearing was held before the City Planning Commission on February 6, 1962, upon the petition of Ted Poy et al. to rezone the property located at 1107 and 1109-A West Yakima Avenue in the City of Yakima, Washington, from R-3, Multiple Family Residential Zone, to B-2, Local Business Zone, and WHEREAS, on February 12, 1962, said Planning Commission, by letter, notified the City Council of the City of Yakima of the denial of said petition by the City Planning Commission, and. • WHEREAS, thereafter, on the 16th day of February, 1962, the said petitioners appealed from the denial of said petition to the City Council, and WHEREAS, a hearing was held by the City Council on said appeal on March 12, 1962, which said hearing was continued until March 19, 1962, and WHEREAS, at the conclusion of said hearing on said appeal, after due and careful consideration of all the factors involved in said application, the City Council passed a motion recommending said re- zone, disapproving the recommendation of the Planning Commission that the petition for such rezone be denied, and requesting a further report of the Planning Commission, and. WHEREAS, in a regular meeting of the City Planning Commission on *April 3, 1962, the Planning Commission reviewed said application for -1- rezone and, after due consideration, instructed the Secretary of the III City Planning Commission to notify the City Council of the denial of said petition by the City Planning Commission, and WHEREAS, the City Council finds, after further reviewing the application for rezone, that to deny the petition would have the effect of depreciating the value of the property without increasing or otherwise affecting the value or use of other property in the same general area; that the portion of the property fronting on West Yak- ima Avenue has existed and has been used as business property for more than 30 years last past and is presently being used as business property, and that the highest and .best use of such property is for • business purposes, and WHEREAS, the Council further finds that the majority of property owners in the immediate vicinity of the property do not object to a • change in the classification of the property from a residential zone to a business zone; and that the rezoning of the property will in no way interfere with the vehicular or foot traffic along West Yakima Avenue, nor with the widening of West Yakima Avenue as contemplated by the City of Yakima; and that such rezone is in accord with good planning and with the Comprehensive Plan of the City of Yakima, now, therefore, BE IT ORDAINED BY 'THE CITY OF YAKIMA: • Section 1. The following described real property located at 1107 and 1109-A West Yakima Avenue in the City of Yakima, Washington, and more particularly described as follows, to-wit: Lots 21 and 22, Nob Hill Addition to North Yakima (now • Yakima), according to the plat thereof recorded in Vol ume "A" of Plats, page 78, records of Yakima County, Washington; EXCEPT-the following: Beginning at the -2- w Southwest corner; thence North 71 °46' East along the • South line 81.9 feet to the Southeast corner; thence North along the East line of said lot 21.16 feet to a point midway between said Southeast corner and the North line of Yakima Avenue &Capitol Addition to North Yakima (now Yakima); thence Southwesterly to the point of be- ginning; is hereby rezoned from R -3, Multiple Family Residential Zone, to B -2, Local Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the said City. Section 3. The City Clerk is hereby authorized and direoted to file with the Yakima County Auditor a certified copy of this ordi- nance. Section 4. This ordinance shall become effective 30 days after its passage, approval and publication, as provided by law and by the City Charter.
