HomeMy WebLinkAbout1962-337 ORDINA NO, 4 AN ORDINANCE providing for the annexation by the City Of Yakima, Wash- ington, of certain property contiguous to the City of Yakima, and zoning the same as B-3, General Business Zone. WHEREAS, proceedings have been had in accordance, with Chapter 128 of the Laws of 1945 for the annexation of the property herein- , after described, and. WHEREAS, at a regularly scheduled meeting of the Planning Com- mission of the City of Yakima, a hearing was had pursuant to legal . notice, on April 3, 1962, and the said Commisson recommended annexa- tion of said property, and • WHEREAS, on May 1, 1962, at a public hearing, the Planning Commission determine, that all of said property hereinafter described 0 be zoned at the time of such annexation as 13-3, General Business Zone, and WHEREAS, said proposed area to be annexed to the City of Yakima is less than ten acres in area and less than $200,00M0 in assessed valuation, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, the Mayor of the City of Yakima, the Chairman of the Board of County Commissioners of Yakima County, and the County Superinten- dent of Schools of Yakima County have all been apprised of the peti- tion and have agreed that a review proceeding as provided in said Chapter 282 is not necessary for the protection of the interests of the various parties, and that such review procedures should be dis- pensed with, and Ilk WHEREAS, the City Council finds that such property should be annexed to the City of Yakima, and further finds that such recommen- . -1- • dation of the Planning Commission for zoning of said property should Ilk be approved for the reasons that such zoning is in accord with good planning and with the Comprehensive Plan of the City of Yakima, that the majority of the property owners in the vicinity do not oppose the Classification, that she needs of the City and community do require such zoning classification, and that the highest and best use for said property is General Business Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property contiguous to the City of Yakima, Washington, to -wit: Beginning at , the intersection of the North_.line of Section 13, Township 13 Yorth, Range 18, E.W.M. , and the East R/W line : of Primary. State Highway No 3; thence East along the North line of Section 13, Town- ship 13 North, Range 18, E.W.M., to the Northeast corner of said section; thence South along the East line of said section to the North line of Phillip's • Suburban Tracts, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington;. thence West along the North line of Phillip's Suburban Tracts to the East R/W line of Primary State Highway. No., 3; thence North along the East R/W line,of,Primary State High- way No 3 to the point of beginning; be, and the same is, hereby annexed to the City of Yakima, Washington. Section 2. The recommendation of the Planning Commission of the City of Yakima that the above - described real property should be zoned B -3, General Business Zone, be, and the sane is, hereby approved, and said property is hereby zoned as B -3, General. Business Zone. Section 'a, The next regularly amended Use District Map prepared by and for the City of Yakima shall show said property as B -3, General Business Zone Section. The City Clerk is hereby authorized and directed to file with the Yakima County Auditc,r a certified copy of this ordinance. • SecLion 5.
