AN ORDINALCE rezoning certain property located at 8 North Eighth Street
in the City of Yakima from R-3, i.ultiple Family Residential Zone,
to B-3, General Business Zone.
WHEREAS, after proper petition and duc notice, a hearing was held
before the City Planning Commission on larch 6, 1962, upon the potition
of i:ayfair Tavern, Inc., to rezone the property located at 8 North 8th
Street in the City of Yakima, 1 Tashington, from R-3, IALltiple Family Res-
idential Zone, to B-3, General Business Zone, and
1:THEREAS, on liarch 12, 1962, said Planning Commission by letter not-
ified the City Council of the City of Yakima of the denial of said pet-
ition by the City Planning Commission, and
WHEREAS, on iarch 12, 1962, the said petitioner filed its notice of
appeal from the denial of the said petition with the City Clerk of the
City of Yakima, and
WHEREAS, a hearing was held by the City Council on said appeal on
iarch 26, 1962, which said hearing was contincd until April 2, 1962, and
WH12EAS, at the conclusion of said hearing on said appeal, and on
the 9th day of April, 1962, alter due and careful consideration of all the
factors involved in said application, the City Council passed a motion
recommending said rezone, disapproving the recommendation of the Planning
Commission that the petition for such rezone be denied and requesting a
further report of the Planning Commission within 40 days, and
WHEREAS, more than 40 days have expired from the time of the filing
of such motion with the Secretary of the Planing Comission, and the
Planning Commission has failed to act with regard to making a further
report to the City Council with regard to such rezone, and

WHEREAS, the City of Yakima klunicipal Code, Section 12.76.120, provides
that in the event of the failure of the Planning Commission to act within
110 days of its receipt of notice of the City Councilts request that the
decision of the City Council shall automatically become final, now,
therefore,
BE IT OfaiLLO BY ThE CITY OF
Section 1. The following described real property located at 8 North
Eighth Street in the City of Yakima, Washington, and more particularly
described as follows:
Lot it, Block 150, liwiraonts Addition to Worth Yakima, now Yakima
Washington, according to the plat thereof recorded in Volume "A" of
Plats, page 11 records of Yakima County, Washington;
is hereby rezoned from R-3, idultiple Family Residential Zone to B-3,
General Business Zone.
• Section 2. The above change in zoning shall be included and depicted
on the next regularly amended Use District Hap prepared by and for the said
City.
Section 3. The City Clerk is hereby authorized and directed to file
with the Yakima County Auditor a certified copy of this ordinance.
Section it. This ordinance shall become effective 30 dayd after its
passage, approval and publication, as provided by law and by the City
Charter.
PASSED BY TIE CITY COUNCIL, signed and approved, this 28th day of
May, 1962.
