V9 • • AN ORDINANCE liMiting and regulating uses of property permitted in a B-2, Local Business Zone; permitting and regulating out- side promotional sales; amending Section 12.32.020 of the City of Yakima Municipal Code; and declaring an emergency. WHEREAS, the Yakima City Council on May 7, 1962, passed a reso- lution declaring its intention to amend Section 12.32.020 of the City of Yakima Municipal Code to permit and regulate outside promotional sales in B-2, Local Business Zone, and referred the resolution to the Planning Commission for study and recommendation, and WHEREAS, after due notice, the Planning Commission held a public hearing on June 5, 1962, and thereafter on June 11, 1962, notified the City Council of a decision recommending the passage of such amend- ment, and • WHEREAS, a hearing was held by the City Council on June 18, 1962, on the desirability of passing such amendment; and, as a result of such hearing, the City Council finds that such amendment is desirable and in accord with proper zoning and regulation of property uses in B-2, Local Business Zones, and that the interests of the people of the City of Yakima would best be served by passing such amendment, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Section 12.32.020 of the City of Yakima Munici- pal Code is hereby amended to read as follows; " 12.32.020 USE REGULATIONS--LIMITATIONS. Every use per- mitted in a Zone shall be subject to the following limitations: • 1. Al].. uses shall be conducted wholly'within a building, except at gasoline service stations; and.no merchandise or other goods, products or containers shall be displayed out- side of the building where such business is carried on, or -1- • v. stored on the premises outside of any building thereon; • provided, that outside promotional sales, where merchan- dise is displayed for sale outside of the building where the business is carried on, may be conducted in a B-2, Local. Business Zone, in accordance with the provisions of Chapter 5.53 of this Code. Where such sale is con- ducted, off-street parking spaces may not be reduced below the minimum requirements of Chapter 12.56; and all entrances . to and exits from off-street parking areas and the business building shall be kept clear at all times. Loading, un- loading and storage of merchandise shall be done on private property in such a manner so as not to interfere in any way with vehicular and pedestrian traffic on public ways or on the off-street parking area. 2. Lighting for all permitted uses shall be so arranged as to reflect the light away from adjoining residential premises. In addition, said lights shall be so arranged so as not to interfere with the safe operation of motor vehicles." • Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety of the • people of the City of Yakima, and an emergency is hereby declared to • exist, and this ordinance shall be in full force and effect immedi- ately upon'its passage, approval and publication as provided by law and by the City Charter.
