HomeMy WebLinkAbout1962-350 ORDINANCE NO. 411 AN ORDINANCE relating to zoning; permitting the operation of pet shop businesses in B-2, Local Business Zones, and regulating the type of pet shop business so allowed; amending Sec- tion 12.32.010 of the City of Yakima Municipal Code; and declaring an emergency. WHEREAS, the Yakima City Council on May 21, 1962, passed a reso- lution declaring its intention to amend Section 12.32.010 of the City of Yakima Municipal Code to permit pet shops to operate in B-2, Local Business Zones, and referred the same to the Planning Commission for study and recommendation, and WHEREAS, after due notice, the Planning Commission held a public hearing on June 5, 1962, and thereafter on June 11, 1962 notified the City Council of a recommendation against the proposed amendment, 40 qualifying the recommendation by suggesting that such a proposed amendment would not be objectionable if a restricted pet shop opera- tion were allowed, and WHEREAS, a hearing was held by the City Council on June 18, 1962, on the desirability of such an amendment with restrictions as sugges- ted by the Planning Commission; and, as a result of such hearing, the Council finds that such amendment is desirable and in accord:with proper zoning and regulation of property uses in B-2, Local Business Zones, and that the interests of the people of the City of Yakima would best be served by passing such an amendment, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Section 12.32.010 of the City of Yakima Munici- pal Code is hereby amended by adding thereto a sub-section 34, to 411 read as follows: -1- 4 " 12.32.010 USE REGULATIONS. In a B-2 Zone, no building • shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purpose except as hereinafter specifically provided and allowed by this chapter, subject to the provisions of Chapter 12.56 governing off-street parking requirements. In .a B-2 "Zone, the following uses only are permitted: . • • 34. Pet shops; provided that the business conducted on the premises shall be limited to the selling at retail of pet supplies and small pets such as birds, mice, fish, guinea pigs, lizards, turtles, dog puppies under the age of four months, and other pets of like nature not exceeding 15 pounds in weight, excluding poisonous creatures pro- vided further no creatures shall be displayed or kept outside the building at any time." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety of the people of the City of Yakima, and an emergency is hereby declared to • exist, and this ordinance shall be in full force and effect immedi- ately upon its passage, approval and publication as provided by law and by the City Charter.
