HomeMy WebLinkAbout1962-352 ORDINANCE NO 0 AN ORDINANCE providing for the improvement of certain property by con- structing a pipe sewer with the necessary wye branches and manholes and by constructing a sewer lift station; estab- lishing a Local improvement District; providing for the method of payment thereof; and creating a special fundd BE IT ORDAINED BY THE CITY OF YAKIMA: Sectionl. That the following property shall be improved by con- structing a pipe sewer with the necessary wye branches and manholes: On Conestoga Boulevard from a point 735 feet East more or less of the centerline of North Nob Hill Road to the centerline of North Nob Hill Road. On North 46th Avenue from Conestoga Boulevard to 150 feet more or less South of Modesto Way. On Modesto Way from North 46th Avenue to the centerline of North fob Hill Road. On North 47th Avenue from Modesto Way to Englewood Avenue. On North Nob Hill Road from Modesto Way to Englewood Avenue. 410 Section 2. That the following property shall be improved by con- structing a sewer lift station: Beginning at the Southwest corner of Section 15 Townehip 13 North, Range 18 E.W.M.; thence Easterly along the South line of said section a distance of 462 feet; thence Northerly along the East line of Larson's Lots a distance of 707 feet; thence Easterly to a point 126 feet East of the East line of Larson's Lots; thence Northerly a distance of 366 feet, more or less; thence Easterly to a point on the Westerly right-of-way of the Yakima Valley Canal; thence Northeasterly along the Westerly right-of-way of said canal to a point on the North line of the Southwest Quarter of Section 15, Township 13 North, Range 18, E.W.M.; thence Westerly along said North line a distance of 1,247.84 feet to a point on the centerline of County Road; thence South 39°45 West a distance of 85.93 feet; thence South 33°14' West a distance of 86.50 feet; thence along an 18°00' horizontal curve to the right, a dis- tance of 133 ©1 feet; thence South 67°11' West a distance of 122.4 feet; thence along an 8°00' horizontal curve to the left a distance of 274.8 feet; thence South 45°12' West a distance of 40.8 feet; thence along a 26°00' horizontal curve to the left a distance of 173.8 feet to the West line of Section 15, Township 13 North, Range 18, E:W.M.; thence Southerly along said West line a distance of 2,061.9 feet to the point of beginning. Section 3. There is hereby created a Local Improvement District -1- to be called "Local Improvement District No pa," which said district shall include all of the property adjacent to the above-mentioned improve- ment s which are subject to assessments, said property being described aboVe. Section 4. The assessments shall be made according to special benefits derived from the improvements without regard to the zone And termini method. Section 5. All costs and expenses in connection with the construe tion of said improvements, including the engineering, inspection, adver- tising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by the laws and as above described, except a proportional cost of the sewer lift station, force main and trunk sewer shall be paid by the Water-Sewer Fund. • Section 6. All of the aforesaid improvements shall be constructed in accordance with the plans and specifications, profiles, maps and de- tailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 7. All of the work necessary to be done in connection with the making of said improvements shall be done and made by contract 'upon competitive bids, and the City shall have the power to reject any and all bids. Section 8. There is hereby created a special fund, to be called- "Local improvement Fund District Yo0 )E6n," into which shall be plaCed all sums paid on account of the aforesaid special assessments, including all interest, and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. -2- actlal_2. Bonds bearing interest at the rate of per annum 41 1 payable on or before LL years from the date of issuance, shall be issued in payment of the costs and expenses of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at the rate of per annum, interest payable annually, under the mode of payment "payment by bonds," as defined by the statutes of the State of Washington and the ordinances of the City of Yakima. Section 10. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter. • PASSED BY THE CITY COUNCIL, signed and approved this 18th day of June, 1962.
